Zusammenfassung: | This analysis of the law's approach to healthcare decision-making critiques its liberal foundations in respect of three categories of people: adults with capacity, adults without capacity and adults who are subject to mental health legislation. Focusing primarily on the law in England and Wales, the analysis also draws on the law in the United States, legal positions in Australia, Canada, Ireland, New Zealand and Scotland and on the human rights protections provided by the ECHR and the Convention on the Rights of Persons with Disabilities. Having identified the limitations of a legal view of autonomy as primarily a principle of non-interference, Mary Donnelly questions the effectiveness of capacity as a gatekeeper for the right of autonomy and advocates both an increased role for human rights in developing the conceptual basis for the law and the grounding of future legal developments in a close empirical interrogation of the law in practice-- |

Focusing primarily on the law in England and Wales, the analysis also draws on the law in the United States, legal positions in Australia, Canada, Ireland, New Zealand and Scotland and on the human rights protections provided by the ECHR and the Convention on the Rights of Persons with Disabilities. Having identified the limitations of a legal view of autonomy as primarily a principle of non-interference, Mary Donnelly questions the effectiveness of capacity as a gatekeeper for the right of autonomy and advocates both an increased role for human rights in developing the conceptual basis for the law and the grounding of future legal developments in a close empirical interrogation of the law in practice--</subfield><subfield code="c">Provided by Publisher.</subfield></datafield><datafield tag="650" ind1=" " ind2="0"><subfield code="a">Medical care</subfield><subfield code="x">Law and legislation</subfield><subfield code="z">England.</subfield></datafield><datafield tag="650" ind1=" " ind2="0"><subfield code="a">Medical care</subfield><subfield code="x">Law and legislation.</subfield><subfield code="0">http://id.loc.gov/authorities/subjects/sh85082879</subfield></datafield><datafield tag="650" ind1=" " ind2="0"><subfield code="a">Medical care</subfield><subfield code="z">England</subfield><subfield code="x">Decision making.</subfield></datafield><datafield tag="650" ind1=" " ind2="0"><subfield code="a">Medical care</subfield><subfield code="x">Decision making.</subfield></datafield><datafield tag="650" ind1=" " ind2="0"><subfield code="a">Decision making.</subfield><subfield code="0">http://id.loc.gov/authorities/subjects/sh85036199</subfield></datafield><datafield tag="650" ind1="1" ind2="2"><subfield code="a">Delivery of Health Care</subfield><subfield code="x">legislation & jurisprudence</subfield></datafield><datafield tag="650" ind1="2" ind2="2"><subfield code="a">Decision Making</subfield></datafield><datafield tag="651" ind1=" " ind2="2"><subfield code="a">England</subfield></datafield><datafield tag="650" ind1=" " ind2="6"><subfield code="a">Prise de décision.</subfield></datafield><datafield tag="650" ind1=" " ind2="6"><subfield code="a">Soins médicaux</subfield><subfield code="z">Angleterre</subfield><subfield code="x">Prise de décision.</subfield></datafield><datafield tag="650" ind1=" " ind2="6"><subfield code="a">Soins médicaux</subfield><subfield code="x">Prise de décision.</subfield></datafield><datafield tag="650" ind1=" " ind2="7"><subfield code="a">decision making.</subfield><subfield code="2">aat</subfield></datafield><datafield tag="650" ind1=" " ind2="7"><subfield code="a">LAW</subfield><subfield code="x">Administrative Law & Regulatory Practice.</subfield><subfield code="2">bisacsh</subfield></datafield><datafield tag="650" ind1=" " ind2="7"><subfield code="a">Decision making</subfield><subfield code="2">fast</subfield></datafield><datafield tag="650" ind1=" " ind2="7"><subfield code="a">Medical care</subfield><subfield code="x">Decision making</subfield><subfield code="2">fast</subfield></datafield><datafield tag="650" ind1=" " ind2="7"><subfield code="a">Medical care</subfield><subfield code="x">Law and legislation</subfield><subfield code="2">fast</subfield></datafield><datafield tag="651" ind1=" " ind2="7"><subfield code="a">England</subfield><subfield code="2">fast</subfield><subfield code="1">https://id.oclc.org/worldcat/entity/E39PBJpYDdYvBpjXV6WpybK68C</subfield></datafield><datafield tag="655" ind1=" " ind2="4"><subfield code="a">Electronic book.</subfield></datafield><datafield tag="758" ind1=" " ind2=" "><subfield code="i">has work:</subfield><subfield code="a">Healthcare decision-making and the law (Text)</subfield><subfield code="1">https://id.oclc.org/worldcat/entity/E39PCFJk9dQgKHYx9JYgpkX7d3</subfield><subfield code="4">https://id.oclc.org/worldcat/ontology/hasWork</subfield></datafield><datafield tag="776" ind1="0" ind2="8"><subfield code="i">Print version:</subfield><subfield code="a">Donnelly, Mary, M.A.</subfield><subfield code="t">Healthcare decision-making and the law.</subfield><subfield code="d">Cambridge ; Autonomy : variations on a principle -- Autonomy in the law -- Capacity : the gatekeeper for autonomy -- Capacity assessment in practice -- Autonomy, rights and decision-making for patients lacking capacity -- Treatment for a mental disorder : a case apart. Print version record. This analysis of the law's approach to healthcare decision-making critiques its liberal foundations in respect of three categories of people: adults with capacity, adults without capacity and adults who are subject to mental health legislation. Focusing primarily on the law in England and Wales, the analysis also draws on the law in the United States, legal positions in Australia, Canada, Ireland, New Zealand and Scotland and on the human rights protections provided by the ECHR and the Convention on the Rights of Persons with Disabilities. Having identified the limitations of a legal view of autonomy as primarily a principle of non-interference, Mary Donnelly questions the effectiveness of capacity as a gatekeeper for the right of autonomy and advocates both an increased role for human rights in developing the conceptual basis for the law and the grounding of future legal developments in a close empirical interrogation of the law in practice-- Provided by Publisher.
