Hi! RESUMÉ Ordeals or judgements of God present a specific phenom enon of medieval law. It consists of religious conceptions, legal practices, and various social impulses. The principle of the ordeal’s operation has been established on the idea that the natural processes will reach the supernatural result with the act of God (God’s dispensation in Christianity). The major impulse should be the natural tendency of God to reveal the truth, save the virtuous man, and won’t let the guilty one escape the punish ment. That is the reason why God will reverse the natural laws and shows the appreciation to the virtuous one, while on the other hand, keeps his restraints towards the guilty one and let him face the consequences of the performed ordeal. There has been a dynamic and even though invisible co-existence of the earthly and celestial world on the background of this specific tool solving the human conflicts. Every human act, the good and bad one, initiated the response in the transcenden tal sphere, and afterward, a man got the reward or ordeal. The failure has been considered as the consequence of previous sins, accomplishment as the consequence of a good and virtuous life. A man didn’t burn himself in case of an ordeal because of some natural reasons (due to the burning iron) but due to the effective immanent justice performed by God. The punishment has been brought into effect when the norms were violated. The synthesis of legal practices, religious conceptions, and various social convictions on how the world works have turned the ordeals into a multitopic subject of
research. Although these methods of proof became the object of the interest of the law historians, their complicated and comprehensive ideological background made the contemporary medievalists and historical 267
Hi! anthropologists interested in it. The goal of this publication is to run over the applied paradigms of older historiography and free itself from the constant reproduction of the formal side of God’s ordeals. However, the presented text is not intended for the mastering or breakthrough paper, but the way the problem atics have been elaborated can outline some opinions which could be determined as historical-anthropological. The aim is to shift away from the stereotypical descriptions of ordeal prac tice and look at its ideological background together with other specifications despite this. The selection of an anthropological approach to the topic enabled us to see the medieval ordeals from a different perspective. The option of reconstruction of thinking, approaches, world-views, faith, and experiencing the spiritual life, mentality, and imagination, and the way of acting of individuals or human communities, etc. opened up within the spirit of the general program of historical anthropology in its relationship towards the ordeals. The chosen approach enabled to interpret of the reception of medieval ordeals with contempo rary society. The interaction of various factors required to apply the interdisciplinarity. Theology has approached the essential conceptions of morality that are common to religious and legal understanding. Religionistics helped explain the experiencing the spiritual background of the entire process and medieval legal history has approached the value chart which found its reflection in performing the law even in the religious liturgies. The
application of the above-mentioned methods and explora tory approaches has been territorially limited to the area of medi eval Hungary. Otherwise, the topic of ordeals or judicial duels in medieval Hungary captured the attention of older Hungarian, or Slovak historians, however, their attention has got limited to the conclusion of the most essential facts to general syntheses only. There is a constant interest in ordeals in contemporary Hungarian and Slovak historiography. The topics that become the subject of research on social history or the history of everyday life become more popular with the influence of foreign social history. The goal of the presented publication is to be inspirational and enrich 268
Hi! the issue knowledge with its results, especially within the area of Central Europe. The set questions divided the text into three larger scopes: the first one is focused on the religious scopes of judgements of God and interaction of law and religion, the second one analyzes the social aspect of medieval ordeals and the third one is dedicated to the institute of the judicial duel which seems to be a quite complex issue. Ihe conclusion of the publication consists of the reflection on the possible reasons for the decay of ordeals in medieval Hungary. It simply meant to subordinate every single significant resource to detailed analysis and get most of the inspirational information from it. Ihe resources of Hungarian provenience, especially the legal ones, were analyzed here. The significant resource of information was the so-called Register of Värad which consists of over 300 records on the performed ordeal in Veľký Varadin (present Oradea, Romania). In the effort to understand the new resource, the “microscopic optics” has been applied when approaching all available reports on the ordeals. Consequently, attention is paid to the sentences, phrases, or even one word only sometimes. The main idea of this publication is to interpret the ideo logical conception of medieval judgements of God through the example of Hungarian relationships. What did the ordeal mean to a contemporary man? Revealing the subjectivity, we can know the way to limit the specific phenomenon. The subjective under standing of ordeal, the world of visions and worldviews which allowed the practice or
approach towards the entire procedure and its result are revealed this way. However, it is necessary to mention that the goal of this approach was not the research of an individual and his subjectivity, but the revelation of his subjective understanding and his world models for the need of interpretation of ordeal within the society as the whole unit. Ihe ordeal was only one of many examples presenting the respected model of world operation. These facts should bring a reader to a discovery that the institute of the judgments of God is a more complicated and ambiguous phenomenon than the definitions present it. The application of ordeal trial shouldn’t always mean 269
Hi! making decisions in the field of truth-lie. From the analyzed resources, it is obvious that it is more about knowing God’s will than revealing the truth. Ordeal presented an ideal communica tion channel through which a man asked, and God signified his decision. However, his sign was against all the indications of rational assessment of the facts and it was necessary to deal with it somehow. Ihe Christian belief in fair-minded, but infinitely merciful Father satisfied any doubts. At this moment, the social scope of medieval ordeals is opening up as they clearly performed a certain social role as the sources of law. They filled the space made by the ambiguousness of human judgements. When neither the human testimonies nor written evidence couldn’t eliminate the doubts of judges, they have created the stability with their acceptable verdict at the place where it’s been missing. The complexity of religious conceptions seems to be the resource of this thinking. Ihe belief that true knowledge can be achieved by the revelation of God only was the characteristics of medieval society. It led to showing far-reaching attention and trust to the knowledge gained through the faith than through the human common sense activity. However, justice shouldn’t be performed only, but it should be seen to be performed. Ihe case that has begun at the secular court was moved on the “big stage” of the local clerical center. Ihe decision making of the argument in two places with two different methods must increase even the number of participants according to objective reasons. Suddenly, bigger
social groups were standing against each other in case of ordeal trial where their mutual argument has sometimes been only the consequence of total social changes. Otherwise, individuals had to bear the pain and danger of judgements of God without any relation to the controversial matters. They have decided to accept the task of the proband and offer their body as the medium for revelation of God’s statement on the represented side from various, sometimes unknown reasons. There was a great performance ofjustice on the day of the ordeal happening which not just requested a numer ous audience and even attracted a great number of viewers. Ihe 270
Hi! bishop, chapter members, and other clergy led the preparation and trial execution as well as its assessment. It has all happened in front of the curious audience gathered to see the power of God in person. However, it has obliged him to accept and respect the statement of God’s judgement. The element of transcendence was the main impulse for general acceptance and validity of decision making established on the idea of interaction of law and religion. God’s judgement announced in the form of ordeal should be without any discussions adopted and considered to be justified and valid forever. This is the way how the risk of creating repeated disagreements in the same matter has been lowered. Society could free itself from the constant quarrels and see a brighter future. The selected approach towards the problem has revealed unlimited individual and collective visions and convictions on ordeals. Ihe consolidation of legal practices, religious concep tions, and various social impulses made the medieval ordeals an extraordinarily interesting research object. There is a much more complicated and interesting world of ideas, opinions, and emotions of medieval man under its surface. The concept, significance, and function of such a specific phenomenon will be revealed. However, the obligatory presupposition is the knowl edge and the right interpretation of religious scopes. Though, ordeals are the judgements of God, not people. 271
