Summary The Privileges of Sigismund Augustus for the Orthodox Church During the reign of Sigismund Augustus the Orthodox Church had a significant influence on the religiosity and customs of the entire PolishLithuanian Commonwealth. At the beginning of the sixteenth century the organisational structure of the Orthodox Church in Poland took its final form. In the sixteenth century, the Orthodox metropolitan possessed an official title of the archbishop metropolitan of Kiev, Halich and of all Rus. He did not usually reside in Kiev but in the northern part of his province, in Novahradak or in Vilnius. The Kiev Metropolis was comprised of ten dio ceses, seven of which lay within the boundaries of the Grand Duchy of Lithuania (Kiev, Polatsk-Vitebsk, Smolensk-Seversk, Chernihiv-Bransk, Turov-Pinsk, Lutsk-Ostroh and Volodymyr-Brest) and three within the Ruthenian territories of the Polish Crown (Khelm-Belsk, Przemysl-Samborsk, and Halych). Two or three names of the bishoprics reflected their historical names, indicating an ordinary’s place of residence or transfer of jurisdiction together with the title to a new place. The total area of the metropolis of Kiev lay within the borders of Poland and Lithuania. After the annexation of the districts of Sievier-Chernihov and Smolensk by the Grand Duchy of Moscow at the beginning of the sixteenth century, the metropolis of Kiev lost the bishoprics of Smolensk and Chernihov. In 1539, the old bishopric of the Greek Church in Halych started to function as the bishopric of Lviv. By the end of sixteenth century, there eight Orthodox dioceses
operated within the borders of the Polish-Lithuanian Commonwealth. On the territories of the Polish Crown, they were divided into “namiestnictwa”, and in the Grand Duchy - into protopopes districts, protopopes and „namestnik’s” districts shaped up under the influence of the state administrative divisions, structure -222-
of property and the development of the network of parishes. A parish was a basic unit of the Orthodox administration. The density of parishes resulted from economic and demographic factors (the level of the economic prospe rity, and the number of the faithful). It was also influenced by the distribution of property and by the religious awareness of the Rhutenians. The greatest number of parishes was established in the seats of dioceses and a protopope’s districts (Pinsk - 13, Vilnius - 12, Volodymyr - 11, Lviv, Brest, Kamianets and Ovruch - 8 each, Halych and Polotsk - 7 each, Lutsk, Kolomyia, Kovel, Hrodno - 6 each, Kholm, Belsk, Kletsk - 5 each). However, the areas with one or two parishes prevailed. The development of the parish network was hindered by the advancement of the Reformation and the spread of Catholicism. It was also influenced by the process of the renunciation of the Orthodox faith by Rhutenian nobility. The power of the Commonwealth was based upon the recognition by the Ruthenian population of Orthodox faith the Crown and the Grand Duchy of Lithuania as their own states. Recent studies have shown that loyalty of Orthodox Christians to the Catholic hospodar was the result of the growing ties with the Grand Duchy of Lithuania, and the commitment of the Ruthe nian population to the rule of Jagiellonian dynasty. The Orthodox hierarchy distanced itself from of the political agenda of the Moscow Duchy promoting a reconstruction of the state from all the lands which once had belonged to the Duchy of Kiev. Subordinating the Ruthenian lands of the Grand Duchy of
Lithuania and the Polish Crown to Moscow meant the elimination of inde pendent ecclesiastical province, metropolis of Kiev. The Orthodox hierarchy shared the conviction that the dukes of the Grand Duchy of Lithuania had been more attached to the religious traditions of Kievan Rus than the rulers of Moscow. Some other facts also testified to the loyalty of the Orthodox elites to the Grand Duchy. At the provinvial diet in Rudniki, in September 1572, none of the three Orthodox senators from the Grand Duchy of Lithua nia (castellan of Vilnius Hrehory Khodkievich, castellan of Novogrod Hrehory Wollovich and Brest-Lithuanian governor George Tyshkievich) supported Ivan IV as the candidate for the Polish throne. During the reign of the last Jagiellon, the Orthodox Church was guaran teed autonomy and self-government. Its position and legal status were -223-
affected by two laws: the right of “appointment” and “ktitors”. Both laws gave Polish kings the right to appoint the clergy to the positions in the ecclsiastical administration and to look after moral and material well-being of the clergy. In accordance with the law of “ktitors”, the highest ktitors (patrons) in the Orthodox Church were the kings. The monarchs benefited from these rights by selecting candidates for bishop’s positions, but rarely were concerned to choose suitable individuals. A similar policy was conducted by lay magnates towards Orthodox clergy in their land estates, which included a monastery and churches. In the sixteenth century, some significant changes within the Orthodox communities took place. The development of the Protestant Reformation also embraced adherents of Eastern Christianity. It spread over a broad range of Ruthenian magnates and boyars. In 1572, among 69 senators from the Grand Duchy of Lithuania only 24 were of Ruthenian nationality, 8 of them were Orthodox, 15 were Protestants and 1 was Catholic. The poli tical role of Ruthenian senators, however, was much more significant than their number. It is worth mentioning that the Lithuanian-Ruthenian digni taries played a key role in creating and implementing Eastern policy of Commonwealth. The principles of harmonious religious coexistence, that had been estab lished in the past centuries, in the lands of the Grand Duchy of Lithuania and Ruthenian lands of the Crown, mad it possible, in the period of the greatest religious conflicts in Europe, to create a new model of the Polish tolerance.
People of different faiths were welcomed to the Commonwealth not only because of their power, but because of the political doctrine, demonstrating the need of ensuring peace between various religions. In the sixteenth century, the adherents of the Reformation cited traditions of peaceful coexistence of various faiths in the Lithuanian and Ruthenian lands. It has been frequently reminded that, in the country of the Jagiellons Catholics and Orthodox lived together with Muslims and Jews. With the arrival of Protestant newcomers Lutherans, Calvinists, Nontrinitarians, Anabaptists, Arians, Mennonites or Quakers, did not make any major impact on the religious status quo of the population of the Grand Duchy of Lithuania. The multireligous Commonwealth continued the great achievements of the religious policy of Grand Duchy of Lithuania. A new model of Christian -224-
civilization was established in the Commonwealth, which varied thoses being in operation in Western Europe and in the East. The principle of tolerance, instead of religious coercion, became an essential element of the Common wealth’s policy. $** The analysis of the privileges of Sigismund Augustus published in the present volume covers the years of his souverain reign in the Grand Duchy of Lithuania and the Polish Crown (1544-1572). In this period many changes took place concerning legal, constitutional and religious relations regulating the rights of the Orthodox community in the Grand Duchy of Lithuania and the Crown. The attitude of Sigismund Augustus {hospodar) towards the Orthodox Church during his reign is mainly reflected in five basic documents (1547, 1551, 1563, 1568, 1572), which provided regulations concerning the rights of the people of the “Greek faith”, the appointment to offices and positions in the Grand Duchy of Lithuania and the Polish Crown. In the first period of his reign, Sigismund Augustus confirmed the restrictions imposed on the Orthodox population by the Horodeł Privilege of 1413 and by the edicts of 1547 and 1551. In the years preceding the conclusion of the Union of Lublin, the privileges of 1563 and 1568 made the members of the Eastern Church equal with Roman Catholics. The documents published in this volume follow a chronological order, limited by the reign of Sigismund Augustus. Due to their form and content, the documents are divided into five sections. Most documents have been available in the antiquated editions which lack modern editorial
apparatus. The purpose of the publication is to produce new critical editions of dozens of key documents, based on manu script originals or copies. -225-
