SUMMARY The author reconstructs and interprets the natural-legal footings and contractual argumentation strategies and pos tulates which Locke employs to establish his protoliberal po litical philosophy. Attention is focused on the way of articu lating, reconciling and legitimizing two fundamental deter minants of modernity: a) the postulate on the equal natural liberty of individuals; and b) the idea of a stable and well ordered communal life in the condition of diverse and even opposite conceptions of good life. The individual freedom of individuals is validated in social collaboration and political cooperation in three essential ways: a) through laying claim to natural goods through work, which legitimizes the trans formation of inclusive ownership rights of all people to ex clusive ownership rights of some people; b) the rational and voluntary consent of individuals legitimizes social and po litical relations, obligations and authorities; c) the separa tion between the public and private spheres, as well as the essentially unbiased political authority represented in the political value of tolerance, is to secure a stable and peaceful coexistence of people of different life orientations. All three argumentations lead to the constitution of an individual as a moral, social and political subject. The book is divided into four parts. The first part deals with the contextual and methodical questions of Locke’s philosophy of politics. Four points are highlighted: a) the special nature of Locke’s philosophy of politics stretched between the need to create the political
platform of radi cal Whigs and his philosophical reflections on individualism and contractualism; b) the layeredness of his theoretical footings and the tension between recognized and concealed influences; c) his parallel use of the theological and secular271
FILOZOFIJA POLITIKE JOHNA LOCKEA rational argumentation contexts; and d) his simultaneous use of two methods: the central method of rational contractualism and the control method of political anthropology. In the second part of the paper the author analyses Locke’s contractualistic narration ֊ which figures as a phi losophy of history, with the aim of morally reinterpreting all social and political ties - through three liberally sepa rated spheres of human existence. The precontractual, i.e. natural and social, state systematically corresponds to the private and social spheres of existence, in which individu als realise their moral subjectivity with an owner’s claim. The purpose of the prohibitive determinants of natural law, which ought to formally prohibit unlimited claims, is in fact to procure the intersubjective recognition of unlim ited claims with the help of tacit consent. The ambivalenc es of the natural state and the need to protect ownership, which Locke defines and employs in the broader and nar rower sense as needed, lead to the reason for the contrac tual creation of a political community. The legitimacy of po litical rule rests on a threefold check: a) the legitimacy of its origin via informed and rational individual consent; b) the legitimacy of functioning based on constitutional order liness; and c) the legitimacy of purpose, which in fact per tains to the preservation of ownership. The political subjec tivity of individuals manifests itself in the contractual cre ation of political communities based on expressly individual consents and on a
distinct type of normative relations - a trust with which political communities as a whole and on the basis of majority decision entrust power to the bearers of political authority. The deconstructionist political subjec tivity of individuals manifests itself in the normative situ ation of the dissolution of government. This is a situation in which rulers breached this trust and placed themselves in the natural state opposite the political community; con sequently, individuals joined in a political community have the moral right to resistance. The third part tackles the genesis, significance and reach of Locke’s idea of religious tolerance. Special attention is given to Locke’s strategies of justifying religious tolerance. The moral justification of religious tolerance, coupled with the request for the separation between the public and pri vate spheres, as well as for the impartiality of political au272

SUMMARY The author reconstructs and interprets the natural-legal footings and contractual argumentation strategies and pos tulates which Locke employs to establish his protoliberal po litical philosophy. Attention is focused on the way of articu lating, reconciling and legitimizing two fundamental deter minants of modernity: a) the postulate on the equal natural liberty of individuals; and b) the idea of a stable and well ordered communal life in the condition of diverse and even opposite conceptions of good life. The individual freedom of individuals is validated in social collaboration and political cooperation in three essential ways: a) through laying claim to natural goods through work, which legitimizes the trans formation of inclusive ownership rights of all people to ex clusive ownership rights of some people; b) the rational and voluntary consent of individuals legitimizes social and po litical relations, obligations and authorities; c) the separa tion between the public and private spheres, as well as the essentially unbiased political authority represented in the political value of tolerance, is to secure a stable and peaceful coexistence of people of different life orientations. All three argumentations lead to the constitution of an individual as a moral, social and political subject. The book is divided into four parts. The first part deals with the contextual and methodical questions of Locke’s philosophy of politics. Four points are highlighted: a) the special nature of Locke’s philosophy of politics stretched between the need to create the political
platform of radi cal Whigs and his philosophical reflections on individualism and contractualism; b) the layeredness of his theoretical footings and the tension between recognized and concealed influences; c) his parallel use of the theological and secular271
FILOZOFIJA POLITIKE JOHNA LOCKEA rational argumentation contexts; and d) his simultaneous use of two methods: the central method of rational contractualism and the control method of political anthropology. In the second part of the paper the author analyses Locke’s contractualistic narration ֊ which figures as a phi losophy of history, with the aim of morally reinterpreting all social and political ties - through three liberally sepa rated spheres of human existence. The precontractual, i.e. natural and social, state systematically corresponds to the private and social spheres of existence, in which individu als realise their moral subjectivity with an owner’s claim. The purpose of the prohibitive determinants of natural law, which ought to formally prohibit unlimited claims, is in fact to procure the intersubjective recognition of unlim ited claims with the help of tacit consent. The ambivalenc es of the natural state and the need to protect ownership, which Locke defines and employs in the broader and nar rower sense as needed, lead to the reason for the contrac tual creation of a political community. The legitimacy of po litical rule rests on a threefold check: a) the legitimacy of its origin via informed and rational individual consent; b) the legitimacy of functioning based on constitutional order liness; and c) the legitimacy of purpose, which in fact per tains to the preservation of ownership. The political subjec tivity of individuals manifests itself in the contractual cre ation of political communities based on expressly individual consents and on a
distinct type of normative relations - a trust with which political communities as a whole and on the basis of majority decision entrust power to the bearers of political authority. The deconstructionist political subjec tivity of individuals manifests itself in the normative situ ation of the dissolution of government. This is a situation in which rulers breached this trust and placed themselves in the natural state opposite the political community; con sequently, individuals joined in a political community have the moral right to resistance. The third part tackles the genesis, significance and reach of Locke’s idea of religious tolerance. Special attention is given to Locke’s strategies of justifying religious tolerance. In the fourth and closing part of the paper the author considers two points: a) the significance, reach and limita tions of Locke’s theory to the shaping of the liberal para digm; and b) Locke’s influence on the versions of the classic and contemporary liberal philosophy of politics. 273 |
