Summary The Higher Regional Court of Poznań in 1939-1945: scope of activities and selected documents The judiciary installed in Third-Reich-occupied Poland was assigned to guard the new political and racial imperial order. Deprived of any legal rights and capacities, Poles were expected to obey the new government and comply with its new laws. The rule of the occupying power was preserved by German courts, among other institutions. The key German common court in the Reichsgau Warthe land District (the Warta District) was the Higher Regional Court of Poznań (.Oberlandesgericht Posen, OLG Posen). Two other courts of this type were established in the Polish territories annexed by the Third Reich in October 1939: one located in Gdańsk, the other in Katowice. Modeled after the ju dicial system of the German Reich, the court passed judgements and exercised organizational and substantive supervision over the civil judiciary throughout the Warta District. Four operating stages can be distinguished in the several years in which the Higher Regional Court of Poznań remained in existence. The earliest, lasting from the outbreak of the war until the autumn of 1940, involved the establishment of the court and its judicial district. These organizational arrangements remained in place for over one year. The second stage, which continued until the early 1942 and which can be described as a transition period, saw the position of the court strengthened. During this time, the court took up the Peoples Courts (.Volksgerichtshof) cases against Poles accused of conspiring to commit high treason.
In the following months of 1942 (and especially from May to October), the courts activities came to a head. A record number of individual and collective political trials of Poles accused of conspiracy to commit high treason came before the criminal law senate, which was the courts key organizational unit. At stage four between late 1942 and the end of the war, the court’s activities waned. At that time, empowered to judge Poles in criminal matters, the police and the SS took over the majority of the cases that would previously be brought before the Higher Regional Court. In their place, the court took up cases of the Germans accused of compromising the defensive capacities of the German nation (defeatism). From the very start of the occupation, Oberlandesgericht Posen was an instrument of political terror. Under the guise of legal acts, it fought “enemies” of the German state whom it sentenced to execution by guillotine or committed to concentration camps. This effort, which amounted to a sys tematic extermination of people, culminated in 1942. The judges, who were Nazi officials, and who acted “on behalf of the German people” (“im Namen des Deutschen Volkes”), sentenced more than 470 people (of nearly 1,700 accused) to death in criminal trials. The majority of the convicts were Poles actively involved in the work of various underground organizations in the Wartheland.
514 Summary A lesser albeit equally significant role of the court was that of a civil law tribunal. OLG Posen contributed to the Germanization of the Warta Region by interfering in property ownership and legalizing the mass grab of Poles’ possessions. It also engaged in racial biology projects, and in par ticular in compulsory sterilization. The Higher Regional Court of Poznań was fully involved in the “reconstruction effort” {Aufbauwerk) in the Warta Region. It was one of the many institutions that consolidated the racial and political order in the occupied territories and put Nazi ideology into actual practice. The book consists of three parts. Part I outìines the activities of the Higher Regional Court. It begins with a description of the law in place in the Warta Region and the main institutions of the local justice system. The significance of OLG Posen is made clear against the backdrop of political relations and administrative structures. Next follows a discussion of the courts structure and a detailed presentation of the assumption of jurisdiction over Poles accused of political (conspiratorial) activity. Importantly, the authors addi tionally describe the Higher Regional Courts staff from court president to the judges that reported to him. In its main section, the book outlines the work of the criminal law senate. It describes the trials of members of the underground and the defeatists and examines the laws it invoked and the courses of the few trials for which witness accounts could be obtained. A number of minor issues related to the work of the criminal unit
are also noted, including that of the German nationality list {Deutsche Volksliste) and pardons. The coverage of the courts history ends with a description of civil law senates and, above all, OLG Posen’s contributions to the Germanization of the Warta Region. The documentary part of the volume contains nineteen sentences passed by OLG Posen’s crim inal law senate. These concern a wide range of cases heard by the judges. Most involve conspiracy to commit high treason and sentences against members of underground resistance. Other judgements described in this section were passed in cases of treason and defeatism. Two annexes are provided as a supplement of the substantive and source part of the publication. One of them is a list of hearings held before OLG Posen s criminal law senate. This chronologically arranged list specifies the dates and places of trials, a general identity and number of the defendants, case type, and the number of death sentences handed down. The other specifically names nearly 1,700 defendants by name and provides a detailed description of the charges, which usually included membership in an underground organization and the dissemination of defeatism. Summary The Higher Regional Court of Poznań in 1939-1945: scope of activities and selected documents The judiciary installed in Third-Reich-occupied Poland was assigned to guard the new political and racial imperial order. Deprived of any legal rights and capacities, Poles were expected to obey the new government and comply with its new laws. The rule of the occupying power was preserved by German courts, among other institutions. The key German common court in the Reichsgau Warthe land District (the Warta District) was the Higher Regional Court of Poznań (.Oberlandesgericht Posen, OLG Posen). Two other courts of this type were established in the Polish territories annexed by the Third Reich in October 1939: one located in Gdańsk, the other in Katowice. Modeled after the ju dicial system of the German Reich, the court passed judgements and exercised organizational and substantive supervision over the civil judiciary throughout the Warta District. Four operating stages can be distinguished in the several years in which the Higher Regional Court of Poznań remained in existence. The earliest, lasting from the outbreak of the war until the autumn of 1940, involved the establishment of the court and its judicial district. These organizational arrangements remained in place for over one year. The second stage, which continued until the early 1942 and which can be described as a transition period, saw the position of the court strengthened. During this time, the court took up the Peoples Courts (.Volksgerichtshof) cases against Poles accused of conspiring to commit high treason.
In the following months of 1942 (and especially from May to October), the courts activities came to a head. A record number of individual and collective political trials of Poles accused of conspiracy to commit high treason came before the criminal law senate, which was the courts key organizational unit. At stage four between late 1942 and the end of the war, the court’s activities waned. At that time, empowered to judge Poles in criminal matters, the police and the SS took over the majority of the cases that would previously be brought before the Higher Regional Court. In their place, the court took up cases of the Germans accused of compromising the defensive capacities of the German nation (defeatism). From the very start of the occupation, Oberlandesgericht Posen was an instrument of political terror. Under the guise of legal acts, it fought “enemies” of the German state whom it sentenced to execution by guillotine or committed to concentration camps. This effort, which amounted to a sys tematic extermination of people, culminated in 1942. The judges, who were Nazi officials, and who acted “on behalf of the German people” (“im Namen des Deutschen Volkes”), sentenced more than 470 people (of nearly 1,700 accused) to death in criminal trials. The majority of the convicts were Poles actively involved in the work of various underground organizations in the Wartheland.
514 Summary A lesser albeit equally significant role of the court was that of a civil law tribunal. OLG Posen contributed to the Germanization of the Warta Region by interfering in property ownership and legalizing the mass grab of Poles’ possessions. It also engaged in racial biology projects, and in par ticular in compulsory sterilization. The Higher Regional Court of Poznań was fully involved in the “reconstruction effort” {Aufbauwerk) in the Warta Region. It was one of the many institutions that consolidated the racial and political order in the occupied territories and put Nazi ideology into actual practice. The book consists of three parts. Part I outìines the activities of the Higher Regional Court. It begins with a description of the law in place in the Warta Region and the main institutions of the local justice system. The significance of OLG Posen is made clear against the backdrop of political relations and administrative structures. Next follows a discussion of the courts structure and a detailed presentation of the assumption of jurisdiction over Poles accused of political (conspiratorial) activity. Importantly, the authors addi tionally describe the Higher Regional Courts staff from court president to the judges that reported to him. In its main section, the book outlines the work of the criminal law senate. It describes the trials of members of the underground and the defeatists and examines the laws it invoked and the courses of the few trials for which witness accounts could be obtained. A number of minor issues related to the work of the criminal unit
are also noted, including that of the German nationality list {Deutsche Volksliste) and pardons. The coverage of the courts history ends with a description of civil law senates and, above all, OLG Posen’s contributions to the Germanization of the Warta Region. The documentary part of the volume contains nineteen sentences passed by OLG Posen’s crim inal law senate. These concern a wide range of cases heard by the judges. Most involve conspiracy to commit high treason and sentences against members of underground resistance. Other judgements described in this section were passed in cases of treason and defeatism. Two annexes are provided as a supplement of the substantive and source part of the publication. One of them is a list of hearings held before OLG Posen's criminal law senate. This chronologically arranged list specifies the dates and places of trials, a general identity and number of the defendants, case type, and the number of death sentences handed down. The other specifically names nearly 1,700 defendants by name and provides a detailed description of the charges, which usually included membership in an underground organization and the dissemination of defeatism.
