Zusammenfassung:The question of the origin of cultural goods is becoming increasingly important. While discussions in Austria over the last few decades have focused on the restitution of Nazi-looted art, internationally a new debate has emerged regarding the relationship between Western states in particular and cultural goods that come from former colonies or were acquired in other colonial contexts. However, in many cases these morally or ethically justified requirements on the possession and ownership of cultural goods do not comply with legal systems. In a very simplified sense, legal systems are understood as a deliberate act of law making here, while ethics and morality are understood as the recognition of certain values. As a result of these debates, the legal systems must be developed further if they are to meet the respective claims of being morally or ethically justified.
