Summary BODY AS EVIDENCE: MEDICAL EXPERTISE IN THE PROCEEDINGS OF THE CRIMINAL COURT IN EIGHTEENTH-CENTURY DUBROVNIK Given their high number and rich content, medical expertise in the proceedings of the Dubrovnik Criminal Court in the eighteenth century has facilitated various analyses that add to the picture of the judicial system of the Dubrovnik Republic, and also shed a welcome light on the development of medical expertise in Europe of that time. Research samples from the beginning, middle and close of the eighteenth century (1711-20, 1751-60, 1791-1800, a total of 9,346 proceedings) have been selected, bearing in mind that in the mid-eighteenth century Dubrovnik began to witness an economic and social recovery. Moreover, the spirit of rationalism and development of natural sciences gave rise to an increasing general trust in empirical experiments and medical knowledge, along with an assumed decrease of physical violence in this period. Reports of injury and suspicious deaths, as well as medical expertise in the court proceedings were part of the terms agreed with the physicians in the service of Dubrovnik commune since the Middle Ages. Medical expertise in Dubrovnik in the fourteenth and fifteenth centuries, though sparse and recorded in plain language on the basis of which the scope of medical knowledge can hardly be evaluated, shows that in their verdicts the judges relied on the prognosis of these experts concerning the survival chances and opinion on disability in order to pronounce a fair compensation for the lost daily wages. Medical expertise was carried out in
the proceedings launched ex officio for more serious crimes, in which the court generally took a more active role. However, there is 215
no evidence on the interaction during hearing between the judges and medical experts. Most commonly, the summoned experts were surgeons, less frequently physicians, and, at times, it was difficult to determine their specialisation, as they were designated by a neutral term medicus. Professional opinion on head injuries prevailed, while among the most frequent weapons that caused them were sharp and metal objects. Injuries accompanied by bleeding were apparently considered more serious and with an uncertain outcome, under the influence of humoral medicine. A comparison between medical expertise in the eighteenth century and the early days of medico-judicial practice reveals significant changes. Unlike the late Middle Ages, when medical expertise in Dubrovnik was carried out only in the proceedings launched by the court, in the eighteenth century in the majority of cases it was conducted in the criminal actions initiated by individuals, and this portion tended to grow towards the end of the century. Apart from a generally increasing number of procedures initiated by the injured parties, also visible is a trend in which the plaintiffs often tried to include expert opinion in their lawsuit, and thus corroborate their charges and increase the chances of a more favourable outcome. In the Criminal Court records of the eighteenth century {Lamenta Criminalid), medical expertise was always recorded in the Italian language. With regard to the form and content, medical witness reports in the proceedings launched by the court do not differ from those initiated by individuals. Most
commonly encountered is a concise medical report that contains the essentials only: name and profession of expert, name of injured party, type and location of injury, along with the prognosis. A rise in the number of examinations in hospitals already from the middle of the century points to a shift in the perception of hospital as a place that provides quality medical care, but also to an inclination of individual plaintiffs to secure more solid proof of physical injury. Medical reports do not contain much information on the medical procedures. The text of the report usually contains a remark about the physician having examined” or attended to” the mentioned injuries. Eventual treatment included the use of wound dressings, painkillers and purgatives. Towards the end of the century, in particular, there was an increasing number of treatments that included bloodletting. The mentioning of this procedure, which, moreover, 216
in several cases was carried out upon patient’s request even when there was no visible injury, was to convince the judges of the existence and serious circumstances of a criminal offence, that is, the reasons behind it were of procedural rather than medical nature. As expected, in all three periods under analysis the bulk of medical expertise was related to wounds and other injuries caused as a result of physical assault (89%). Most commonly examined were the bleeding wounds, notably those of the head. The prognoses of these injuries do not follow a standard formulation, but display a variety of expressions, often quite imprecise as those from the early years of the century, perhaps aimed at protecting the expert witness from erroneous judgement, or they may even be ascribed to his modest medical knowledge. The prognosis is not always elaborated, which speaks of the judges’ trust in the medical expertise. Examination of the weapon was conducted in the cases involving sharp objects, as such injuries implied more serious sentence. If required, medical experts estimated the degree of physical disability and the duration of work disability, upon which the court decided on the monetary compensation for the injured party. Although the procedures involving suspicion of poisoning were rare, medico-judicial practice in these cases can be clearly established. The court always summoned a medical expert (barber, physician or surgeon) to examine the poisoned persons, in that, for practical reasons, the barber was sent to more remote places, while the surgeon and physician performed
examinations in the city. Medical experts gathered the proofs of poisoning on the basis of visual examination of the body (skin, nails and oral cavity), foaming at the mouth, fever and vomitting, and the general improvement of the victim’s condition after the administration of antidote, whereas the most important proof was that of the hair test. Proof of poisoning on the basis of autopsy was carried out only once in a case of suicidal poisoning. If there were any indications of food or drink poisoning, the suspected specimen had to be brought to court. Identification of the toxic substance by visual examination was always performed by the city physicians, with no particular tests, yet accompanied by evident insecurity on their behalf and poor knowledge of the poisonous substances. Apart from the food remainders, also examined was the vomit. Proof of poison was carried 217
out by experiments on animals, usually dogs or roosters, in the yard of the Rector’s Palace. There was no exchange of information between the experts who examined the victim in search of poisoning symptoms (barbers mainly), and those who were to establish the type of poison used (physicians and surgeons). Distribution of medical expertise by specialisation of the medical witnesses in the eighteenth century clearly shows that the medico-judicial practice was strongly impacted by the advancement of economic and social conditions, along with an increasing influence of rationalism and development of natural sciences. At the dawn of the century, only one communal surgeon was employed, while in one third of the proceedings in this period medical expertise was carried out by barbers, who also acted as wound surgeons, performing minor medical operations. Barbers were also sent to more remote parts of the Republic to examine the injured or poisoned persons, where they perfomed autopsies in search of death cause, but if the crime took place in the city, the role of barber was reduced to that of a dissector. In the first half of the century, physicans and midwives also appear as medical experts in criminal proceedings. The physicians were summoned to identify poisons, attend to and submit their opinion during autopsies and torture, or were required to determine the cause of unclear death. Midwives testified in the proof procedures relating to the crimes of infanticide and rape, which included determination of age and death cause of the newborn, along with an enquiry into the pregnancy
and lactation period of the suspected woman, as well as examination of the rape victims in search of the evidence of violence and virginity loss. The end of the century saw a lesser need for the expert opinion of barbers and midwives, as the economic recovery facilitated bursaries for young Ragusans to study medicine and surgery abroad, along with the employment of several foreign surgeons who were competent in providing medical expertise for all kinds of criminal deeds. As a result, in the middle of the century three communal surgeons performed the bulk of medical examination regardless of the type of crime, and this practice prevailed until the end of the century, when Dubrovnik had as many as six surgeons in its service. Barbers as expert witnesses tended to be entirely marginalised: only a few barbers’ reports were submitted 218
before the court by plaintiffs as proof of the existence of criminal act, and in the majority of cases the barbers did not give their opinion on the injuries but rather described the medical treatment they applied. By the end of the century, medical expertise almost entirely fell within the domain of the trained physicians. Medical expertise of wounds and other injuries also represents a valuable source for the study of the history of violence. In addition to the already known indicators, a smaller number of the physicians’ reports and a drop in the number of medical witness opinions in the cases involving physical assault from 26% at the start of the century to 13% in the mid-century (while the number of criminal offences increased by 80% in the course of the century) testifies to a decrease of serious violence, which was in tune with the prevailing European trend in that period. Viewed generally, the information obtained from the expert testimonies confirms that the blows inflicted on the head were not really intended to cause serious injury, they tended to become less severe, and in most cases caused but minor injuries. The results of qualitative and quantitative analysis have confirmed the theory by which the mid-eighteenth century witnessed historical changes in terms of the intensity of physical violence, and that this trend continued till the close of the century. 219

Summary BODY AS EVIDENCE: MEDICAL EXPERTISE IN THE PROCEEDINGS OF THE CRIMINAL COURT IN EIGHTEENTH-CENTURY DUBROVNIK Given their high number and rich content, medical expertise in the proceedings of the Dubrovnik Criminal Court in the eighteenth century has facilitated various analyses that add to the picture of the judicial system of the Dubrovnik Republic, and also shed a welcome light on the development of medical expertise in Europe of that time. Research samples from the beginning, middle and close of the eighteenth century (1711-20, 1751-60, 1791-1800, a total of 9,346 proceedings) have been selected, bearing in mind that in the mid-eighteenth century Dubrovnik began to witness an economic and social recovery. Moreover, the spirit of rationalism and development of natural sciences gave rise to an increasing general trust in empirical experiments and medical knowledge, along with an assumed decrease of physical violence in this period. Reports of injury and suspicious deaths, as well as medical expertise in the court proceedings were part of the terms agreed with the physicians in the service of Dubrovnik commune since the Middle Ages. Medical expertise in Dubrovnik in the fourteenth and fifteenth centuries, though sparse and recorded in plain language on the basis of which the scope of medical knowledge can hardly be evaluated, shows that in their verdicts the judges relied on the prognosis of these experts concerning the survival chances and opinion on disability in order to pronounce a fair compensation for the lost daily wages. Medical expertise was carried out in
the proceedings launched ex officio for more serious crimes, in which the court generally took a more active role. However, there is 215
no evidence on the interaction during hearing between the judges and medical experts. Most commonly, the summoned experts were surgeons, less frequently physicians, and, at times, it was difficult to determine their specialisation, as they were designated by a neutral term medicus. Professional opinion on head injuries prevailed, while among the most frequent weapons that caused them were sharp and metal objects. Injuries accompanied by bleeding were apparently considered more serious and with an uncertain outcome, under the influence of humoral medicine. A comparison between medical expertise in the eighteenth century and the early days of medico-judicial practice reveals significant changes. Unlike the late Middle Ages, when medical expertise in Dubrovnik was carried out only in the proceedings launched by the court, in the eighteenth century in the majority of cases it was conducted in the criminal actions initiated by individuals, and this portion tended to grow towards the end of the century. Apart from a generally increasing number of procedures initiated by the injured parties, also visible is a trend in which the plaintiffs often tried to include expert opinion in their lawsuit, and thus corroborate their charges and increase the chances of a more favourable outcome. In the Criminal Court records of the eighteenth century {Lamenta Criminalid), medical expertise was always recorded in the Italian language. With regard to the form and content, medical witness reports in the proceedings launched by the court do not differ from those initiated by individuals. Most
commonly encountered is a concise medical report that contains the essentials only: name and profession of expert, name of injured party, type and location of injury, along with the prognosis. A rise in the number of examinations in hospitals already from the middle of the century points to a shift in the perception of hospital as a place that provides quality medical care, but also to an inclination of individual plaintiffs to secure more solid proof of physical injury. Medical reports do not contain much information on the medical procedures. The text of the report usually contains a remark about the physician having "examined” or "attended to” the mentioned injuries. Eventual treatment included the use of wound dressings, painkillers and purgatives. Towards the end of the century, in particular, there was an increasing number of treatments that included bloodletting. The mentioning of this procedure, which, moreover, 216
in several cases was carried out upon patient’s request even when there was no visible injury, was to convince the judges of the existence and serious circumstances of a criminal offence, that is, the reasons behind it were of procedural rather than medical nature. As expected, in all three periods under analysis the bulk of medical expertise was related to wounds and other injuries caused as a result of physical assault (89%). Most commonly examined were the bleeding wounds, notably those of the head. The prognoses of these injuries do not follow a standard formulation, but display a variety of expressions, often quite imprecise as those from the early years of the century, perhaps aimed at protecting the expert witness from erroneous judgement, or they may even be ascribed to his modest medical knowledge. The prognosis is not always elaborated, which speaks of the judges’ trust in the medical expertise. Examination of the weapon was conducted in the cases involving sharp objects, as such injuries implied more serious sentence. If required, medical experts estimated the degree of physical disability and the duration of work disability, upon which the court decided on the monetary compensation for the injured party. Although the procedures involving suspicion of poisoning were rare, medico-judicial practice in these cases can be clearly established. The court always summoned a medical expert (barber, physician or surgeon) to examine the poisoned persons, in that, for practical reasons, the barber was sent to more remote places, while the surgeon and physician performed
examinations in the city. Medical experts gathered the proofs of poisoning on the basis of visual examination of the body (skin, nails and oral cavity), foaming at the mouth, fever and vomitting, and the general improvement of the victim’s condition after the administration of antidote, whereas the most important proof was that of the hair test. Proof of poisoning on the basis of autopsy was carried out only once in a case of suicidal poisoning. If there were any indications of food or drink poisoning, the suspected specimen had to be brought to court. Identification of the toxic substance by visual examination was always performed by the city physicians, with no particular tests, yet accompanied by evident insecurity on their behalf and poor knowledge of the poisonous substances. Apart from the food remainders, also examined was the vomit. Proof of poison was carried 217
out by experiments on animals, usually dogs or roosters, in the yard of the Rector’s Palace. There was no exchange of information between the experts who examined the victim in search of poisoning symptoms (barbers mainly), and those who were to establish the type of poison used (physicians and surgeons). Distribution of medical expertise by specialisation of the medical witnesses in the eighteenth century clearly shows that the medico-judicial practice was strongly impacted by the advancement of economic and social conditions, along with an increasing influence of rationalism and development of natural sciences. At the dawn of the century, only one communal surgeon was employed, while in one third of the proceedings in this period medical expertise was carried out by barbers, who also acted as wound surgeons, performing minor medical operations. Barbers were also sent to more remote parts of the Republic to examine the injured or poisoned persons, where they perfomed autopsies in search of death cause, but if the crime took place in the city, the role of barber was reduced to that of a dissector. In the first half of the century, physicans and midwives also appear as medical experts in criminal proceedings. The physicians were summoned to identify poisons, attend to and submit their opinion during autopsies and torture, or were required to determine the cause of unclear death. Midwives testified in the proof procedures relating to the crimes of infanticide and rape, which included determination of age and death cause of the newborn, along with an enquiry into the pregnancy
and lactation period of the suspected woman, as well as examination of the rape victims in search of the evidence of violence and virginity loss. The end of the century saw a lesser need for the expert opinion of barbers and midwives, as the economic recovery facilitated bursaries for young Ragusans to study medicine and surgery abroad, along with the employment of several foreign surgeons who were competent in providing medical expertise for all kinds of criminal deeds. As a result, in the middle of the century three communal surgeons performed the bulk of medical examination regardless of the type of crime, and this practice prevailed until the end of the century, when Dubrovnik had as many as six surgeons in its service. Barbers as expert witnesses tended to be entirely marginalised: only a few barbers’ reports were submitted 218
before the court by plaintiffs as proof of the existence of criminal act, and in the majority of cases the barbers did not give their opinion on the injuries but rather described the medical treatment they applied. By the end of the century, medical expertise almost entirely fell within the domain of the trained physicians. Medical expertise of wounds and other injuries also represents a valuable source for the study of the history of violence. In addition to the already known indicators, a smaller number of the physicians’ reports and a drop in the number of medical witness opinions in the cases involving physical assault from 26% at the start of the century to 13% in the mid-century (while the number of criminal offences increased by 80% in the course of the century) testifies to a decrease of serious violence, which was in tune with the prevailing European trend in that period. Viewed generally, the information obtained from the expert testimonies confirms that the blows inflicted on the head were not really intended to cause serious injury, they tended to become less severe, and in most cases caused but minor injuries. The results of qualitative and quantitative analysis have confirmed the theory by which the mid-eighteenth century witnessed historical changes in terms of the intensity of physical violence, and that this trend continued till the close of the century. 219 |
