The main thesis of the reserach is that the re-interpretation of the concept
of sovereignty in an age of changed legal and political circumstances in order to
build a contemporary theory of sovereignty as a central issue of the public law
and the theory of state and law requires de-construction of the classical notion
of the sovereignty on its structural elements, discussion of their substance in the
contemporary world, re-conceptualization of the structuring elements (territoriality,
independence, highest and ultimate authority) and introduction of new elements (state
responsibility for protection of the basic human rights) in the theory of sovereignty in
the context of the emergence of new doctrines of military interventions motivated by
humanitarian purposes (humanitarian interventions), the development of the doctrine
of “Responsibility to Protect” and the developing system of international criminal
justice. By re-interpreting and elaborating the concept of sovereignty in an age of
changed legal and political circumstances the dissertation fulfills the main goal of
the dissertation and it is to give substantial input in the renewal of the concept of
sovereignty and its importance also for the contemporary theory of state and law.
The issue of sovereignty has increased significance in the contemporary legal
science and practice. The existence and the importance of the sovereign nation states
and their legal orders shouldn’t be underestimated neither in the internal affairs nor
in the international sphere. The sovereign nation states continue to be important, if
not most important legal community also in the contemporary world.
However, the doctrine of military interventions motivated by humanitarian
purposes (humanitarian interventions), the introduction in the international legal
order and the development of the R2P doctrine as well as the developing system
of international criminal justice seem to be, beside other factors like the economic
globalization and the environmental changes, one of the most important challenges
to the present system of sovereign nation states and sovereign legal orders.
The concepts of the humanitarian interventions and international criminal
justice attack the very foundations of the old and preferred concept of the nation

states and their rulers, namely the sovereignty. The humanitarian intervention as a
military operation by one or group of countries against another country (or against
the government of another country as a foreign political sovereign representative
of the country) attacks the basic ingredient of the concept of sovereignty and that
is the territoriality and as a consequence has an attack on the territorial integrity
and independence of the attacked country. Another logical consequence is the
interference in the internal (domestic) affairs of one state by another state/states or
international organizations against the will of the government of the attacked state.
The system of the international criminal justice is disturbing or is interfering
in the classical sovereign right of the nation states to sentence (or to initiate and
conduct a criminal investigation and to issue a verdict and if guilty to sentence)
their citizens on the one side, and on the other side to protect its own citizens from
such action against them initiated by another sovereign state including the principle
of not transferring own citizens for purposes of criminal investigations to other
sovereign states).
The doctrine of “Responsibility to protect” is aiming to reconcile the existing
system of international legal order of sovereign nation states with the legitimate
concern over the protection of basic human rights through creation of obligation or
responsibility for the nation states as primary agents of sovereignty to protect their
populations from severe breaches of human rights. The doctrine can also serve as
ground for developing a legal framework for active involvement of the international
community in form of a military intervention motivated by human purposes. By
this, the doctrine affects the classical notion of sovereignty also by transferring
the sovereign rights from their primary agents to international organizations
which distributes the sovereignty to more than one agent and sets the international
community in a position of decision maker on “state of exception”.
The analysis of the interaction of above mentioned concepts leads to a
conclusion that the system of human rights is widely accepted legitimate legal and
social value and accompanied by the sovereign responsibility of the nation state for
protection of the human rights is emerging as a necessary element of the doctrine
(theory) of the sovereignty.
