SUMMARY
The performance of institution for execution penal sentences was
direct mirror of policy-governance system during different time periods
of our history. Since the beginning of the last hundred years, when
Albania become part of the world political map as an independent and
sovereign country, after five centuries of Ottoman occupation, institutions
of penal sentences has changed drastically. There were changes on human
rights concept, their organization and architecture, treatment of inmates,
alternative of sentence, classification of them, the goals and vision of
prisons. During XX century, Albania passed some policy systems, as
monarchy in 1914, constitution monarchy in 1920-1924, and republican
system 1925-1928, constitution monarchy in 1928-1939, under occupation
of fascist 1939-1944, and dictatorship of communist from 1945-1991.
During 1912 to 1944 we can see some attributes of penitentiary system
in Albania, that are connection with others elements of macro system.
First of all, during this period, due to the low level of economical
developmentthere were very weak prisons infrastructure, with an inadequate
architecture which do not guaranteed security, human treatment, hygienic
conditions and possibility for future return to society of prisoners. During
the Second World War were opened many deportation camps as, Porto
Romanno, Burrel, and many were deported abroad. In that time the first
clients of prisons and camps were antifascists. It was estimated about 2500
prisoners and more than 2000 deportee in Albanian prisoners and camps in
1943.(in that time Albania has 1 million inhabitants).The general situation
of prisons during tfie War was described by Army General, G.Pagrili on
1942: “Civil prisons in Albania are placed at provisory locations, which
normally lack any hygienic and moral conditions, they are not appropriate
even on security level.In prisons there are mixed those with long and
life sentences, with those with soft sentences and waiting for trial. The
damage coming from this mixture is very clear and the prison fails to

achieve its moral education of those convicted for severe crimes”.
Second: Up to enforcement of Zog regime for management and
organization of prison system, there were in force legal acts inherited from
Turkish regime. Penal law of April 28-th, 1910 in some parts organized
the prisons administration (acts 131-149).The establishment of Legal
framework started after 1920.
Third: We see human attitude toward dealing with prisoners. Through
series of documents, responsible structures were remarked on cases of
violations of prisoners rights and also for cases of maltreatments.
1. The period of executions and terror 1944-1952
This is the period of hardest terror and of the highest use of torture. The
first years of communist power were followed by an overall violence and
attack against all classes that were considered opposite to the communist
system, ’’exploiting classes”, traders, proprietary’s, intellectuals, workers
of previous administration, representatives of clergy. No one could escape
to this violence even most simple and power classes. The goal was total
submission of citizens and recruiting a labor force to work at most difficult
sectors, what could not be covered by free workers
Based in a report about criminality in Albania during 1945 — 1957
were proceeded and sentenced for ordinary and criminal crimes 109111
persons. This figure does not included crimes against the state, out of
which we do not have figures from 1944 — 1948,(it was the time when the
persons are executed without trial) while during 1948 — 1957 there were
about 4198 proceedings.
Crimes against the state from 1950 till 1957 , were processed 4918
persons,3578 were sent in the court,620 investigations were stopped.

Ordinary crimes
From 1948 till 1957 were processed 77.709 cases and 60.735 of them
were sent to court. 16.874 investigations were canceled. This number
doesn’t include the cases which were investigated by the court or sent to
the court by the police.
In the cases referring to the years 1948 till 1957 ,103.035 persons
have been assumed and 80.365 have been sent to court. Referring to the

2. Justice system during the period 1952-1966
Under the influence of the liberalization reforms after death of
Stalin and events of Hungary, in the so -called “socialist camp”, Albania
included, there has been a decrease of political condemnations and
internal exiles, and a reduction of the “War Classes, in general. However,
within this period there have been 93 executions. Measures were taken
for working camps were no more exterminating camps, but treatment of
detainees were out of international norms and standards: they slept on
cement floors, were beaten systematically as a disciplinary measure, the
food was insufficient.
3. Justice system under the pressure of Political party and ideology
1966-1976
During this period, trials and death penalties restarted declaring the
return to former methods of Stalinism. There have been 139 executions.
This period represents the total isolation of Albania also from Eastern
Europe and embracement of the Chinese model of totalitarianism.
According to this model, the most famous music and literature international
works, elements of the private ownerships, and especially the religion
rituals and faith were prohibited. On behalf of the so-called “New Man”,
a lot of interventions over the scholar education, the life style, the social
relationships, were done. Ministry of Justifce and Advocacy were closed.
In 1961 the prisoners are- accommodated in 6 work camps and 4 prisons.
This is the period where the amnesties for prisoners were reduced.
In November 1962, for the 50-years Anniversary of independence
there were given amnesty to 1211 ordinary prisoners and 144 political

prisoners. In 1966, in Kirova it was established the first working camp
for women. The disgraceful conditions are evidenced as one room
available for 60 women.
This is the period against liberalism. The war of classes became
more powerful over the so-called “ideological front” This is the period of
superstructure hard attacks: arts, economy and army. The artists writers
and composers were attacked. A typical example of these art attacks was
the denunciation of the 11-th Festival of Radio and Television. At the
same time, members of the army and economy got death penalties and
serious condemnations. In 1973 the number of detained increase 28%.In
this period it is noticed an increase of the administrative condemnations,
which in essence was a Chinese model. The number of executions during
this time is 74.
4. New constitution and the crisis in the judiciary, 1976-1990
A year after the Constitution was adopted the new Criminal Code,
which sanctioned the criminal policy of the communist state in the spirit
of the new constitution and new circumstances in which the country
stands. Given its content and according to many scholars of penalogve
the criminal code of 1977, marking a regression compared to the 1952
Criminal Code. This seems to share the general concerns and principles to
further enlargement of the figures of crime punished with death and long
imprisonment.
After death of Hoxha, Alia followed the politics of continuity while
the country was facing extraordinary economical problems. The number
of executions during this period is 88.As a result of the increasing
suppression from events of other countries of Eastern Europe and the
catastrophic economical situation, the regime was obliged to allow some
democratic processes. Many people are killed in borders, trying to release
and moving in democratic countries.
During 1991 the infamous Space camps were closed, Qafe Bari,
Bulqiza, Burrel prison and for a short time closed all labor camps being
inherited only two prisons, the prison of Tirana Burrel and in a poor
condition and painful history. Democratic state with the generous assistance
of international organizations initiated deep reforms in all directions to
improve the prison service and respect for human rights and freedoms.
The reforms consisted in changing laws and regulations by harmonized

European standards, the change of staff and training, the improvement of
conditions of treatment and social rehabilitation. From the beginning of
the democratic process until now we have an increase and improvement
of service unparalleled in the first prison in conception as a public service,
in respect of fundamental human rights, in connection with civil society,
expand capacity and improvement standards of treatment.
