Abstract
The History of Iasi Lawyer Bar
This book takes a historical approach of the subject of the
Iasi Lawyer Bar, therefore we stress to focus on the background, the
social and legal environment as well as the initial legislative steps
taken in order to implement this institution. The lawyers existed
prior to the establishment of this institution, but it was for the first
time that their activities were referred to a professional body.
The Institution was established in 1864, as part of the
extensive reform program adopted during the reign of Al. I. Cuza.
It was inspired from the French model of organisation of the
Lawyer Corps, as was most of the legislation drafted at the time.
As passing a law is one thing and making that law work
is a completely different matter, in the first chapter we deal with
the general legal framework that regulated the activity of the
Romanian Lawyer Corps during 1864-1918. Our research was
guided by several questions as: who made the law, what was their
declared intention, who was benefitting from the law, who op-
posed it, what effects did the law produce and why was the law
amended.
The second chapter is dedicated to the actual establishment
of the Lawyer Bar in Iasi County, to its organisation and activity.
Based on the French model, every Romanian Lawyer Bar, the

one in Iasi included, was made of all the lawyers based in a
county. The Bar was run by a Dean seconded by a Discipline
Council (three to five members). The Dean was able to summon
the General Assembly of the Lawyers in order to hold elections,
to vote the budget and to decide on various other matters
pertaining to the activity of the Bar. As far as we could
acquiesce, in the beginning, the general assemblies were
plagued by absenteeism, which gave even more power to the
Dean and to the Council of Discipline.
In order to provide a form of permanent professional
training it was decided that periodical conferences were to be
held. The purpose of these conferences was to allow the interns
and novice lawyers a better grasp of the legal practice under the
supervision and guidance of the more experienced members of
the Bar. A library was also assembled for the same purpose.
In 1911 the Iasi Lawyer Bar came with the initiative of
creating the National Federation of Romanian Lawyers, whose
first Congress was held same year at Iasi June 5 .
In the third chapter we tried to present, using various
sources of information, the human dimension of this institution:
who were the lawyers of the Iasi Bar, what was their degree of
legal studies and professional behaviour, what was their place in
society. As a fact, at the end of the 19th century an important
part of the Romanian political elite was made up of lawyers.
As much as one third of the members of the prestigious
Jockey Club were lawyers, a good part of the members of the
conservative and liberal political clubs were also lawyers, and
glimpses of the tense situation within the Lawyer Bar can be
perceived. At the Iasi University, the professors at the Faculty
of Law were also distinguished lawyers and generations of

students benefited from the theoretical teachings and legal
practice of the great Matei B. Cantacuzino.
It can be said that after half century of existence the Iasi
Lawyer Bar proved /to be a useful/its usefulness as an institution,
fulfilling its purpose and its role of safekeeping the social
mission of the lawyers.
Annexed to the book are four papers dedicated to
various aspects related to the activity of the Iasi Lawyer Bar:
- The list of the first members, drafted in 1868, four years after
the law was passed;
- The Repertoire of the Lawyers of the Iasi Bar during 1864-
1918;
- The Deans and the members of the Discipline Council of the
Lawyers Bar during 1869-1918;
- The interns admitted to the Iasi Lawyer Bar during 1869-
1879.

L’Histoire du Barreau de Iasi
L’histoire de cette institution en Roumanie commence
en 1864 pendant le règne réformateur d’A. I. Cuza. Largement
inspirée du modèle français, T institution avait le rôle de
réglementer l’activité du Corps des avocats roumains.
Dans ce livre nous essayons de présenter l’histoire l établis-
sement du Barreau de Iasi. Notre démarche vise non seulement
le cadre législatif, mais aussi les hommes et les débats autour des
lois et des règlements concernant l’activité des avocats roumains
vers la fin du XIXème siècle et le début du XXème siècle.
L’année 1864 est habituellement considérée comme la
première année de l’institution, mais, à Iasi comme ailleurs, il a
fallu plusieurs années pour mettre la loi en pratique. Donc, dans
le premier chapitre nous présentons le cadre législatif général :
les lois concernant la formation, la structure d’organisation et
l’activité du Barreau.
Le deuxième chapitre est un essai de reconstituer
l’activité des avocats au sein du Barreau de Iasi utilisant les
documents des fonds d’archives. Etant donné l état des archives
qui ont survécu jusqu’à présent, il y a parfois des lacunes dans
les documents historiques. Comme pour le barreau français, le
Barreau de Iasi à la fin du XIXeme siècle était composé de tous

les avocats d’Iasi. A leur tête était un Doyen, assisté d’un
Conseil de discipline, élus parmi une Assemblée générale. Dans
ce chapitre nous présentons également le sujet des conférences
du Barreau, comme outils de formation continue pour les avocats,
et les démarches pour la création d’une bibliothèque. Le Barreau
de Iasi a été l’élément central de la fondation de la Fédération des
avocats roumains en 1911, dont le premier Congrès s’est ténu â
Iasi, le 5 juillet de la même année. Donc, de quoi discutaient-ils
les avocats réunis dans l’Assemblée générale, qu’est ce qu’ils
décidaient/quelles décisions prennaient-ils le Doyen et les
conseillers, quls étaient les sujets de leur conférences?
Le troisième chapitre présente les avocats des Iasi chez
eux. La partie finale du livre vise à mieux comprendre la place
et le rôle des avocats du Barreau de Iasi dans leur ville de 1864
â 1918. Aujourd’hui on arpente des rues qui portent leur nom,
on voit leurs statues et leur anciennes maisons, on enseigne le
droit dans des avocats au sein du Barreau de Iasi utilisant les
