Our day to day world is awash in man-
made chemicals, but we know surprisingly
little about most of them. We know so little
that understanding whether even the most
prevalent chemicals are toxic would take
decades of research. Meanwhile many people,
including children, have suffered serious
diseases and premature death from exposure
to those chemicals. How and why has this
state of affairs come to pass?
Carl F. Cranor argues that numerous factors
have contributed to this public health disaster,
but the most important causes are two-fold.
First are the laws that permit this exposure.
Second is the way that science has been used
or not used to identify and assess whether or
not chemicals and products are toxic. Both
are the outcome of deliberate legislative,
corporate, and judicial choices.
Cranor explains how the XJ.S. Congress created
laws that actually keep public health officials
and the wider population in the dark about
the toxicity of virtually all substances other
than prescription drugs and pesticides. Facing
considerable ignorance about toxic substances,
impartial scientists seeking to protect the
public health are constrained by the slow pace
of studies to reveal their toxic effects. Further,
corporate pressures on public health officials
and scientific obstruction substantially raise
the barriers to protecting the public. Lastly,
when seeking redress and justice, those who
have suffered serious and life-threatening
diseases have faced a judiciary that bars the
relevant science from being employed in
personal injury tort law.
Cranor argues in this deeply informed and
forceful book that this situation does not
need to persist, and that under both public
health law and the tort law, we can do better--
provided public leaders make different
and better choices about the myriad toxic
substances in our midst.
CARL F. CRANOR, Distinguished
Professor of Philosophy and Faculty Member
of the Environmental Toxicology Graduate
Program, University of California, Riverside,
conducts research on science and the law. He
was the Romanell-Phi Beta Kappa Professor of
Philosophy in 2014—2015, is a Fellow of the
American Association for the Advancement of
Science and the Collegium Ramazzini, and a
member of the Center for Progressive Reform,
a nonprofit think tank of legal scholars.
