Abstrakt
Prona dhe trashëgimia në Shqipëri në periudhën 1912-1939 është një
çështje historiko-juridike, në pasqyrë të së cilës certifikohen
ndryshimet që ndodhën në më pak se dy dekada në sistemin politik
të vendit. Përmes kësaj çështjeje dëshmohen përpjekjet
shtetformuese të institucioneve ligjvënëse e ligjzbatuese në
periudhën parlamentare (1910-1924), republikáne (1925-1928) dhe
mbretërore. Miratimi i kodeve themelorë të shtetit të ri laik dhe
shekullar sipas dy modeleve të shteteve perëndimore (latin dhe
anglo-gjerman) ishte një përballje e vështirë me veprimin ruajtës të
së drejtës tradicionale etnojuridike (në radhë të pare kanunet në të
gjitha motërzimet e tyre); me kundërveprimin e së drejtës kanonike
kishtare dhe veprimin për inerci të së drejtës perandorake otomane
shprehur përmes ligjit të Sherijatit. Sido që rregullimi juridik i
statusit të pronësisë dhe trashëgimisë, gjegjësisht i pronës dhe
familjes, përmes Kodit Civil të vitit 1929, ishte më shumë një tentim
se një realitet, ai, duke përfillur standarde të këtyre traditave,
shenjoi një ndryshim themelor me periudhat e mëhershme, njësoi
veprimin e tij në gjithë vendin pa dallim krahinor, kulturor, fetar e
zhvillimor; formálizoi ndarjen nga e kaluara parashtetërore; orientoi
kuituren shtetërore-juridike direjt Perëndimit; kodifikoi në frymë
europiane legjislacionin e kësaj fushe; hodhi bazat për një shtet të së
drejtës dhe paracaktoi fatin e së drejtës pronësore edhe për të
ardhmen. Në këtë periudhë ana juridike e çështjeve pronësore u
interferua konceptualisht dhe administrativisht edhe prej aspektesh
të tjera të qeverisjes shtetërore, sidomos nga reforma agrare e
premtuar prej Fan Nolit dhe revolucionarëve të vitit 1924, reforma
agrare e periudhës mbretërore, ndorimi i pronave publike në emër
të shtetit, vendosja e një numri refugjatësh shqiptarë nga Kosova
dhe projektet për pranimin e migrantëve hebrenj, politika liberale e
dhënies së koncesioneve kapitalit të huaj. Me gjithë karakterin
reformues të legjislacionit të kësaj kohe, sistemi i pronave të fituara
për shpërblim për merita lufte e shërbimi ndaj ish-perandorisë
osmane (bashkë me to dhe feudalizmi e çifligarët ish-timarlinj) nuk u

çrrënjos dhe kodet gojorë të së drejtës mbi pronën (Kanuni i Lekë
Dukagjinit dhe kanune të tjerë) nuk u shuan. Por kjo periudhë nuk
pati reforma shtetëzuese dhe politika konfiskuese të pronave të
trashëguara. Studimi i historisë së pronës dhe trashëgimisë gjatë
periudhës së Pavarësisë, për arsye juridike më shumë se
historiografike, mbështetet në vështrime prapavajtëse në tradita të
mëhershme, si statutet dhe rreguiloret e qyteteve-komuna në fundin
e Mesjetës humaniste, kanunet dhe institucionet interpretuese të
tyre (si Xhibali, Djibal), aktet e regjistruara në librat e kadinjve për
dhënien e së drejtës në këtë fushë sipas ligjit të Sherijatit, rregullator
themelor në supershtetin osman, dhe në tradita të tjera.

Abstract
Property and heritage in 1920-1939 are historical and judicial issues,
in which we can see the development of the political system in less
than two decades in Albania. Through these civil institutions we
witness the effort to create a solid legal framework in the
parliamentary period (1920-1924), the republican one (1925-1928)
and the royal one (1928-1939). The entry in force of the most
important codes of the new laic state in accordance with the latin
and anglo-saxon law was a very difficult challenge, because the
legislative had to take into consideration the framework of the past
such as: the entojudicial tradition of the canons, the canonical right
of the churches and the ottoman law imposed by Sherijat. The
judicial status of property and heritage consacrated by the Civil Code
of 1929, was more an attempt to improve the legal definition of
them, rather than pretending to be a new and european legal
framework, to be compared to other judicial regimes. Even though, it
was a very important step which unified the use of the same law by
everybody, without cultural, religious and territorial differences.
The new code separated definitively the past regime; oriented a new
western judicial culture; laid the groundwork of a state law, and
precised the future of the right to property and inheritance. In this
period, property issues were also resolved by administrative
provisions, such as the agrarian reform promissed by Fan Noli and
his révolutionnaires of 1924; the agrarian reform during the
Monarchy; the housing and accomodation of a very important
number of Kosovars refugees; the project of admission of jewish
immigrants; the liberal politics on concessions to foreign companies.
Even if the legal framework was constantly under reform, the
property system in which the land was divided in accordance to war
merits, as during the Otoman Empire (the feudalism and big land
owners) worked, did not have an end; so was the property system
according the Canons (Lekë Dukagjini Canon and other canons). The
study of history of property and heritage during the period of
indipendency, in more a judicial way than a historical one, needs to
be made with a retrospective analysis, by researching and studying

other traditions like the case of Statutes and Regulations of cities-
comunes of the end of Middle Ages, the Canons and other
institutions such as Djibal, acts providing the right to property as
Sherijat and the Otoman Super State ruled.
