SUMMARY
The Willküren (by-laws) for towns situated within the territory of the
Teutonic State in Prussia were drawn up already in the 13th century. The
oldest one is the Königsberg Anti-Theft Ordinance of 12 March 1286.
A reference to the by-laws was also made in the foundation privilege for
Pasłęk (Preussisch Holland) of 29 September 1297. The following docu-
ments are among the oldest IVillküren: the by-laws for Nowe Miasto Toruń
(ca. 1300), Stare and Nowe Miasto Elbląg, Chełmno (ca. 1400) and Gdańsk
(i38y-i4yy).
Until the mid-i^11 century, everyday life of Warmian towns was
strictly linked to the new legislation for the entire Teutonic State. The
vast majority of Warmian towns were located under Culm law (e.g. Lidz-
bark, Orneta, Reszel, Olsztyn, Pieniężno, Jeziorany, Dobre Miasto,
Barczewo or Biskupiec, Bisztynek) and only two ֊ Braniewo and From-
bork ֊ under Lübeck law. Apart from general rules introduced in the arti-
cles of the foundation privilege, towns were gradually implementing their
own, internal regulations which, in the flow of time, were usually writ-
ten down as Willküren. The word Willkür comes from German, origi-
nally meaning “willful choice” / “free choice” {der Will = will; die Kur =
choice), which refers to the set of laws approved by community members
in accordance with their will.
In Warmia, the Willküren were proclaimed either by the Bishop (if
the town was located in the area under the Bishop’s jurisdiction) or Cathe-
dral Chapter (if the town was situated within the territory controlled by
the Chapter). In the case of Reszel, Jeziorany and Bisztynek, the by-laws
required additional approval of the hereditary village mayor. The founda-
tion privilege for Olsztyn of 31 October 135*3 forbade the town council to set
out any rules without the knowledge and consent of the supreme authority,
it is the Cathedral Chapter. However, the foundation privileges for other
four Warmian towns: Stare Miasto Braniewo, Lidzbark, Dobre Miasto and
Pieniężno, did not state the necessity to obtain such an approval, which, still,
did not exclude such a requirement.

All the known Warmian IVillküren were drawn up after 1466, when
Warmia, as a result of the Thirteen Years’ War (1454-1466), was incorpo-
rated into the Crown of the Kingdom of Poland (Latin: Corona Regni Polo-
niae). The by-laws for Lidzbark (1534), Olsztyn (1568), Reszel (1607),
Orneta (1607, 1677), Biskupiec (1609), Jeziorany (1610), Frombork
(1631/1636), Pieniężno (165*3), Nowe Miasto Braniewo (1674) and Bisz-
tynek (1715) are among the ones preserved until today.
The IVillkur for Bisztynek, with its 154 articles, was the most detailed
document of that type, whereas the by-laws for Olsztyn were formulated
in the most brief manner. The latter consisted of 48 chapters which were,
however, further developed and subdivided into additional articles.
The IVillkur for Olsztyn was approved on 19 August 1568, at the meet-
ing of the Cathedral Chapter of Frombork, in the presence of Samson von
Worein (1515-1586) - the Chapter’s administrator of the Olsztyn district.
During the session, the possibility of introducing additions to the IVillkur vtvs
claimed. Moreover, the need to remind the inhabitants to abide by the by-
law was emphasized. Besides, members of the town council were obliged to
enforce the IVillkur penalties under threat of being removed from the office.
It soon became necessary to make some additions, which resulted in an
n-article long supplement of 13 April 1597. Around that time, the undated
IVilkierz Budnicki must have been drawn up. It consisted of 32 points writ-
ten in Polish and was intended for the urban lower class. Other relevant
issues were regulated in a combined, 19-article IVillkur of 7 January 1696.
Every year, customarily on 23 February, it is on a day following the
municipal elections, the IVillkur was read out to the community members
from the window of the town hall,
The Olsztyn tVillküren included detailed regulations concerning every-
day life of the community, which complemented the provisions of the foun-
dation privilege. The articles addressed the following issues: observance of
religious holidays, respect for the supreme and municipal authorities, pre-
vention of competition in commerce and craft occupations, order and safety
provisions, weights and measures supervision, fulfillment of public duties,
boundary marking, fence maintenance, building and fire regulations, enter-
tainment, gambling, weekly markets and fairs, cleanliness and hygiene,
crafts, brewing, clearing the costs of damages among neighbors, cattle rear-
ing, rent payment, etc.

The inhabitants of towns were not allowed to carry weapons such as
swords or knives. If anyone was injured or murdered in someone else’s
house, the witnesses were obliged to raise the alarm, so that neighbors could
hear them and help to catch the offender. People returning from a beer
feast were supposed to head directly for home. The ones making noise in
the street or initiating a fight were severely punished. It was prohibited to
host any new-comers without the knowledge of the town mayor. On Sun-
day and holidays, before the mass was ended, it was forbidden to sell wine,
beer, mead or vodka. A feast held at the host’s house should not last longer
that until 9 pm in summer and 8 pm in winter.
While emphasizing valuable contributions of German scholars (Hugo
Bonk and Anton Funk), thanks to whom the content of the Willküren for
Olsztyn was preserved until these days, it needs to be stressed that the author
of the present edition provided complete translations of the German by-laws
for Olsztyn into Polish, which facilitates better understanding of everyday
life of the inhabitants of our town in early modern period. The Willkür for
Olsztyn of 1696, being the only copy preserved in the Archive of the Arch-
diocese of Warmia in Olsztyn, was transcribed and translated anew.
