Zusammenfassung: | Customary laws and traditional institutions in Africa constitute comprehensive legal systems that regulate the entire spectrum of activities from birth to death. Once the sole source of law, customary rules now exist in the context of pluralist legal systems with competing bodies of domestic constitutional law, statutory law, common law and international human rights treaties. This book promotes discussion and understanding of customary law and explores its continued relevance in sub-Saharan Africa. The volume considers the characteristics of customary law and efforts to ascertain and codify customary law, and how this body of law differs in content, form and status from legislation and common law. It also addresses a number of substantive areas of customary law including the role and power of traditional authorities; customary criminal law; customary land tenure, property rights and intestate succession; and the relationship between customary law, human rights and gender equality |

Higgins and Jeanmarie Fenrich -- Ben Kiromba Twinomugisha -- Johanna E. Bond -- Fatou K. Camara Customary laws and traditional institutions in Africa constitute comprehensive legal systems that regulate the entire spectrum of activities from birth to death. It also addresses a number of substantive areas of customary law including the role and power of traditional authorities; customary criminal law; customary land tenure, property rights and intestate succession; and the relationship between customary law, human rights and gender equality Customary law / Africa Gewohnheitsrecht (DE-588)4157303-1 gnd rswk-swf Afrika Subsaharisches Afrika (DE-588)4053770-5 gnd rswk-swf 1\p (DE-588)4143413-4 Aufsatzsammlung gnd-content Subsaharisches Afrika (DE-588)4053770-5 g Gewohnheitsrecht (DE-588)4157303-1 s 2\p DE-604 Fenrich, Jeanmarie edt Galizzi, Paolo edt Higgins, Tracy E. edt Erscheint auch als Druckausgabe 978-0-521-11853-8 Erscheint auch als Druckausgabe 978-1-107-62504-4 https://doi.org/10.1017/CBO9780511844294 Verlag URL des Erstveröffentlichers Volltext 1\p cgwrk 20201028 DE-101 https://d-nb.info/provenance/plan#cgwrk 2\p cgwrk 20201028 DE-101 https://d-nb.info/provenance/plan#cgwrk |
