PRIVATE COLLECTING OF CULTURAL PROPERTIES
- LEGAL ASPECTS
INTRODUCTION
This book is a part of the mega-project concerning the Macedonian heritage
legislation and its development, in the frames of which ten publications by the author have
been published so far, devoted to various themes in the domain of cultural heritage
protection. In a sublimated form it elaborates the legal aspects of private collections of
cultural properties as distinct thematic matter. The publication enables anyone who shares
interest in this specific and complex legal theme to acquire an overall picture of its basics
and to consider closely some peculiar aspects of the circumstances and relations within this
sphere. Conceived in this way the book is the first and only publication devoted entirely to
this matter. It has been created as an attempt for filling in the obvious gap in the scholarly
literature regarding the heritage legislation domain. Its contents have been systematized in
two Sections and elaborated in a manner and scope that correspond to the projected aims.
SECTION ONE: PRELIMINARY ISSUES RELATED WITH PRIVATE
COLLECTING OF CULTURAL PROPERTIES
In this section three different themes have been systematized and elaborated,
including: Chapter I - General Considerations of Private Collecting of Cultural Properties;
Chapter II - Identification of the Subject of Private Collecting and Chapter III - Normative
Framework of Private Collecting of Cultural Properties;
I. GENERAL CONSIDERATIONS OF PRIVATE COLLECTING
OF CULTURAL PROPERTIES
The chapter systematizes and elaborates five issues of general nature, including: 1.
Basic terms; 2. Right of private collecting of cultural properties; 3. Entities engaged in
private collecting; 4. Goals and principles of private collecting and 5. Social importance of
private collecting of cultural properties.
1. Four basic terms have herewith been singled out for elaboration. They include
“collection” (1.1), “private collection” (1.2), “compiling collection” (1.3) and “private
collecting” (1.4). Each of these terms has been dealt with from the aspect of whether its
legal meaning has been adequately defined in the applicable Macedonian legislation or not.
These considerations have been coupled with an insight into the genesis of legislative term
itself.
As regards the term “collection” it has been emphasized that the first Macedonian
juridical definition of it dates from 2004, having been included in the Law on Protection of
Cultural Heritage. It was formulated in a standard manner and comprises three crucial
elements given cumulatively as prerequisites that have to be fulfilled. They refer to the

physical characteristics, value and protection elements that a group of movable objects
should bear for it to be considered a collection in the aspect of the heritage legislation.
In regard to the other basic terms it has been noted that the regulations have not
provided adequate legal definitions. This is the reason why certain misunderstandings,
misinterpretations, even confrontations have emerged in practice.
In the Macedonian legal system the phrase “compiling collection” has never been
adopted as official term. In practice, on the contrary, it is often being used denoting the
activity of individual collectors. In the heritage literature there are works in which the
phrase “compiling collection” has been identified with the terms “collecting” or “private
collecting” which is completely incorrect. The phrase “compiling collection” does not
include the public collecting neither it refers to any and all forms of private collecting. It
pertains merely to the way of private collecting manifested as non-institutional activity
practiced by individuals - collectors.
In the heritage legislation the expression “private collecting” denotes a kind of
collecting different form the public collecting and as generic term it embraces not only the
activity of collectors, but also the institutional collecting performed by private legal entities
in the form of registered activity.
2. The right of collecting cultural properties is a specific right of collecting material
properties conceived as individual and collective right closely related with the right of
ownership and its exercising. The difference between them regards the scope of the right
itself having in mind that collecting of cultural properties involves greater extent of
restrictions than the right of collecting material properties of any other kind. The very right
of collecting of cultural properties embraces not only the right of public collecting but also
the right of private collecting of such properties. These two primary forms of the right have
certain characteristics that show their different legal nature. Their crucial feature is that
they are mutually exclusive: the right of public collecting does not involve compiling of
private collections and vice versa, the right of private collecting does not imply forming of
public collections. Beside that, there are much more restrictions regarding the right of
private collecting of cultural properties than is the case with the right of public collecting
and they pertain to the collecting entities and the subject of collecting alike. Apart from
that these two forms of the right of collecting of cultural properties bear another, wider
legal dimension which is not based on the right to ownership, but still has essential
influence on it. It concerns the right to culture and in its frames the right to cultural
heritage conceived as one of the components of the right to culture. Considered in this
context the very right of private collecting of cultural properties is one of the basic cultural
rights within the frames of the right to cultural heritage. This right is consequently
manifested as right to a non-institutional and alternative form of protection of cultural
properties and therewith as right to participation in the cultural life of the community,
including participation in the societal protection of the cultural heritage.
3. The issue of the entities engaged in private collecting of cultural properties as a
thematic unit has been considered through the five categories of collecting entities,
including: collectors (3.1), private museums, libraries and cinematiques (3.2), religious
communities (3.3), other legal entities (3.4) and owners of collections (3.5). The former
four categories are standard categories of entities, whereas the category “owners of

collections” also refers to entities that own collections or take care of them, although they
are not engaged in collecting activity.
Collectors compose an important category of entities in private collecting of
cultural properties. They are individuals who are engaged in gathering of cultural
properties on a non-professional basis and for their personal needs, thus forming one or
more conceptual wholes with the status of collection. Regarding this category of entities
Macedonian legislation does not include special legal norms that would refer to their
recognition and acquiring of the status of collector, neither it regulates the proving of such
status, with the exception of provisions concerning collectors of collection weapons. This
is an open issue which deserves attention in the point of view de lege ferenda.
Private museums, libraries and cinematiques have a statutory recognized position
of entities of private collecting of cultural properties. These private institutions in the
domain of culture can be established as non-profit legal entities by domestic or foreign
legal entities or individuals for the purpose of performing activities related with museums,
libraries and cinematiques, as well as for protection of audiovisual properties. In the
existing social circumstances this group of entities is a kind system projection rather than a
legal reality. In other words there are not private libraries or cinematiques in the Republic
of Macedonia and the number of private museums is really insignificant.
Religious communities and their organizations in the Republic of Macedonia form
a respectable category of entities engaged in private collecting of cultural properties. They
include the Macedonian Orthodox Church — Ohirid Archbishopric, the Islamic
Confessional Community, the Catholic Church, the Evangelist — Methodist Church, the
Hebrew Community and other confessional communities and religious groups.
The category of “other legal entities” herewith signifies a heterogeneous group of
organizations with the status of legal entities, which are yet different from the above-
mentioned ones and belong to the private legal sector, particularly: art colonias, galleries,
companies, associations, etc. having been registered for performing activities that involve
private collecting of cultural properties.
4. The primary goal of private collecting of cultural properties is achieving
individual or group private interests. Besides that, its additional aims could be obtaining
the right of participation in the cultural life of the community; the need of emphasizing the
cultural identification, that is, the cultural identity of the persons compiling private
collections; preventing illicit export of properties that are not part of collections, etc.
Anyway, the goal of private collecting could in no case be derogation or substitution of
public collecting neither should it become the reason for emerging of competitive relations
between them.
Private collecting of cultural properties is based on the seven standard principles,
including: principle of voluntarism, principle of legality, principle of subordination,
principle of diligence, principle of keeping records, principle of taking care and
appreciation, as well as the principle of proper use.
5. The social importance of private collecting is manifold. An argument in favour
of this notion is the fact that this very activity contributed to enhancing or completing
many of the present day widely known public collections. It is also noteworthy that some
of the public museums in the Republic of Macedonia were established as a result of the

private collecting having been carried out by individuals or private institutions in the past
times. Distinctive examples of this are the collections of the Museum of Macedonia, the
Museum of Natural History of Macedonia, the Dr. Nikola Nezlobinski Museum in Struga
and lately also the Museum of the National Bank of the Republic of Macedonia. Beside
that, the importance of private collecting of cultural properties to the society is recognized
in the fact that it has become an important segment in the system of societal protection,
whereas collectors and other private collecting entities, today more than ever, play a
noteworthy part of active entities in heritage protection. Namely, collecting of cultural
properties is neither a privilege, nor a right or obligation reserved merely for the state and
her collecting institutions. Consequently, the legal system is not limited merely to public
collecting, nether does it provide protection of the state owned cultural heritage only. On
the contrary, the legal system recognizes the right of private collecting considering it as a
socially beneficial activity. Taking this into consideration and having in mind the
importance of cultural properties in the public interest the legal system ensures proper
protection of private collections of cultural properties, as well.
II. IDENTIFICATION OF THE SUBJECT OF PRIVATE COLLECTING
This chapter elaborates two aspects of the theme, including: 1. Terminological
Identification and 2. Legal Identification
1. Terminological identification of movable properties of cultural, historic, artistic,
scientific and other importance considered as subjects of collecting involves use of
numerous theme-specific phrases, whether at the level of generic terms associated with
heritage or in the form of simple names that imply their individualization. In other words,
the official heritage terminology used in applicable regulations comprises over 4040 names
for identification of movable cultural properties although it is disputable whether and to
what extent some of them can become subject of private collecting. Additionally, there are
a large number of local and nonstandard terms, as well as scholarly vocabulary used in
respective scientific disciplines and fields. In these circumstances the issue of
terminological identification of the subject of private collecting is becoming an immanent
challenge. In many cases the heritage terminology lacks the necessary exactness, which
leads to unwanted misconceptions. Problems of terminological nature also emerge in
instances when the national legislation uses foreign words and expressions, not only when
it is justified, but also in cases when there are adequate words in the national terminology,
which creates apparent differences regarding their meaning. Occasionally there is the issue
inadequate translating of some standard international phrases, as well as proof-readers’
interventions creating unacceptable alterations of the official legal terminology.
Movable cultural materials that are subject to private collecting can be identified at
more general level by their attribution to some of the standard general expressions, such as:
“cultural properties”, “cultural objects”, “cultural heritage”, “cultural monuments”, etc.
The general expression used in this publication is ’’cultural properties”, having in mind that
it appears to be most acceptable as compared with the other above-mentioned phrases.
2. The issue of legal identification of the subject of private collecting comprises
elaboration of numerous terms of interest, which are grouped in four units, including: key

generic terms (2.1), supplementary generic or deduced terms (2.2), generic terms used for
different kinds of cultural heritage (2.3) and other specific generic terms (2.4). The group
of key generic terms includes the phrases: “cultural properties”, “cultural objects”,
“cultural heritage”, whereas the group of supplementary generic terms comprises the
expressions: “objects of collections”, “antiquities”, “separated properties” and “national
treasure”. The third group embraces terms denoting the kinds of movable cultural heritage:
“archaeological objects”, “history objects”, “ethnographic objects”, “objects of art”,
“technical objects”, “archive documents”, “archive material”, “library properties”,
“audiovisual properties” and “phonograms”. The fourth group includes the terms:
“museum materials”, “museum objects”, “numismatic objects”, “old arms”, “collection
arms“, “old timers” and “natural rarities”.
In addition to applicable legal definitions provided in the Macedonian regulations,
actual international definitions have been given of all the above-mentioned generic terms
as stated in conventions and other relevant international acts in the domains of cultural and
natural heritage protection. For the purpose of elucidation the genesis of the steps taken
regarding the heritage legislation in the past times normative definitions outlined in
previous regulations have also been included for some of the terms in both domains. The
elaboration also includes the legal meanings of some generic terms as stated in the customs
legislation and/or in the international trade regulations, which are not always the same as
the ones provided in the regulations governing the domain of heritage. There are also
previous and/or actual legal definitions of some specific terms contained in the
considerations of most generic terms, as well as definitions of associated terms, which
contribute to better understanding of the legal meaning of the respective generic terms.
Formal and/or essential differences between the international and national legislations in
defining the legal meaning have been emphasized regarding all considered terms. In
addition a comment has been given on the consistency or discrepancy of national laws and
regulations.
Analyses of international definitions regarding legal identification of the subject of
protection, as well as the subject of private collecting in those frames, have shown certain
differences between acts of the world organizations (UNESCO, UNIDROIT, ICOMOS) on
one hand and the acts of the Council of Europe and the European Union on the other.
There are also certain discrepancies, not only between the national and international
regulations, but also on national level between the regulations governing the sphere of
heritage and associated domains. Discrepancies can also be noticed within the national
legislation regarding protection of cultural and natural heritage. Generally speaking, the
nature of existing differences raises the issue of proper legal identification of the subject of
private collecting of cultural properties. The consequences of these discrepancies affect
directly entities engaged in private collecting, collectors in particular.
The issue of legal identification of the subject of private collecting is apparent
regarding the archaeological properties, archaeological finds and chance discoveries. This
refers particularly to so-called surface finds, which are in most cases treated as
archaeological heritage, though they do not always fulfill the corresponding criteria for
that. This issue is most obvious when it comes to numismatic objects, which are a priori

being treated as archaeological heritage, although in many cases there is no legal ground
for that.
In the viewpoint of private collecting of cultural properties there are notable
discrepancies in the legal identification of collections in the customs and international
trade regulations, on one hand, and the legal status of those collections in the heritage
legislation on the other.
In general terms the issue of legal identification of the subject of private collecting
is still burdened with elements of legal sensitivity and vulnerability.
III. NORMATIVE FRAMEWORKS OF PRIVATE COLLECTING
OF CULTURAL PROPERTIES
This chapter deals with the following two themes: 1. National Regulations and 2.
International Regulations.
1. The theme of national regulations elaborates the issues of the constitutional
framework, the laws governing the sphere of heritage and the regulations of associate
domains. In that context each of the issued has been considered in the aspect of the actual
and previous legislation, which shows the line of development of national regulations
pertaining to heritage.
The historic account of the constitutional framework basically presents statutory
outlines of the former federal constitution and the Macedonian constitution that were in
force until the disintegration of the former Yugoslav federation in 1991 and declaring the
independence of the Republic of Macedonia. The analysis of statutory provisions of 1991
that are still in force and the 2001 Amendments to the Constitution brings to the fore the
open issues regarding the statutory treatment of the right to private property, on one hand,
and the right to culture, more precisely, to cultural heritage as part of it, on the other. These
two issues deserve further attention in the aspect de legeferenda.
In regard to regulations in the basic domain - cultural heritage corresponding
provisions pertaining to private collecting of cultural properties have been considered as
outlined in: the basic law — Law on Protection of Cultural Heritage of 2004; special laws:
Law on Museums of 2004, Law on Libraries of 2004, Law on Audiovisual Properties of
2008, Law on Archive Materials of 2012 and other bylaw acts (decrees, books of
regulations, edicts, orders, instructions, etc.) which have been enacted on the grounds of
the basic law and the special laws. This unit also considers corresponding previous
regulations of varied kinds, which allows following of the continuity of the normative
treatment of this matter.
The considered laws related with the issue of private collecting regulate the domain
of proprietary relations (Law on Ownership and Other Real Rights, Law on Inheritance,
Law on Obligations, Law on Denationalization, etc.); the domain of culture (the basic law
— Law on Culture, Law on Copyrights and Related Rights, as well as books of regulations
for practicing the Law on Culture); conservation of nature (the basic law - Law on the
Conservation of Nature, special laws for pronouncing protected areas and bylaws);
customs regulations, international trade and tax legislation (laws, decrees, books of

regulations) as well as legislation governing other associate domains (arms, motor
vehicles, criminal law, etc.)
2. The unit dealing with international regulations gives consideration of provisions
from corresponding international acts including international agreements (conventions,
protocols, covenants, amendments, etc.), other international acts (recommendations,
declarations, codes) and acts of the European Union (regulations and directives).
In regard to conventions respective provisions have been considered from the
Convention of Hague of 1954, the UNESCO Convention of 1970, the London Convention
of 1969, the Valetta Convention of 1992, the UNIDROIT Convention of 1995, the Faro
Convention of 2005 and the conventions concerning nature conservation including the
Ramsar Convention of 1971, the Washington Convention of 1973, the Bonn Convention of
1979, the Bern Convention of 1979 and the convention concluded in Rio de Janeiro in
1992.
Provisions from other relevant international agreements have also been considered,
including: the First Protocol of the Hague Convention of 1954; the Second Protocol of the
Hague Convention of 1999; the International Covenant on Social, Economic and Cultural
Rights of 1966; the Agreement on the Conservation of Populations of European Bats of
1991 and its Amendment of 2000, as well as the Agreement of the Conservation of
African-Eurasian Migratory Waterbirds of 1995.
Among other international acts corresponding provisions have been considered
from: the UNESCO Recommendations of 1960, 1964, 1976, 1978 and 1980; the Universal
Declaration of Human Rights of UN of 1948, the UNESCO Universal Declaration on
Cultural Diversity of 2001, ICOM Code of Ethics for Museums of 1986 and 2001 and the
International Code of Ethics for Dealers in Cultural Property of 1999.
The considered acts of the European Union include the Regulation 3911/92/EEC,
Regulation 752/93/EEC, Regulation 116/2009/EC, Regulation 1081/2012 /EU, Directive
93/7/EEC, Directive 96/100/EC, Directive 2001/38/EC, Directive 2014/60/EU, etc.
SECTION TWO: LEGAL REGIME OF PRIVATE COLLECTING OF
CULTURAL PROPERTIES
This section of the publication systematizes and elaborates three different subject
matters, including: Chapter I - Compiling of private collections of cultural properties;
Chapter II - Protection of private collections of cultural properties and Chapter III - Rights
and obligations of owners of private collections and restrictions by the regime of
protection.
I - COMPILING OF PRIVATE COLLECTIONS OF CULTURAL PROPERTIES
This chapter comprises three thematic units, including: 1. General features; 2.
Legitimate compiling of private collections of cultural properties and 3. Forbidden actions
and restrictions in compiling of private collections of cultural properties.
1. Compiling of private collections of cultural properties is a flexible and complex
process carried out in accordance with the legislative norms in force. The Macedonian

legal system does not outline any specific provisions concerning the moment when some
entity can begin to exercise the right of private collecting of cultural properties, the number
of collections one is allowed to compile and the number of items they shall include, about
the structure of collections, the time when collections shall be compiled and for how long
the compiling shall last. Likewise, there are no special regulations regarding the
geographic scope of private collecting, more precisely, about the areas from which cultural
properties to be collected can originate. Special legal norms have been prescribed
regarding certain kinds of properties, mostly in form of restrictions or restrictions
pertaining to their collecting. In addition, in compiling private collections of cultural
properties the right of obtaining ownership has been determined by the primary principle in
the trade of properties, the principle of good will and diligence.
2. The thematic unit of legitimate compiling of private collections prescribes four
legal grounds for acquiring ownership. They have herewith been elaborated as separate
points, including: acquiring ownership on the grounds of the law lex lege (2.1), ownership
based on a legal matter / legal did (2.2), ownership obtained by inheriting (2.3) and
acquiring ownership by decision of a governmental body (2.4).
Obtaining the right of ownership on the grounds of the law (ex lege) as regards
private collecting of cultural properties prescribes five relevant standard ways of acquiring
ownership, including: creating a new thing; acquiring by maintenance (Lat. usucapio);
acquisition by preemption (Lat. occupatio); acquisition by discovery of hidden treasure
and cultural properties, as well as obtaining the right from a non-owner.
Acquisition based on a legal matter (legal did) exemplifies five kinds of
agreements, including purchase agreement (Lat. venditio, venditionis) commonly known as
sell-and-buy agreement (Lat. emptio venditio); exchange agreement (Lat. permutation,
permutationis); donation agreement (Lat. donation, donationis); agreement for transfer of
ownership during lifetime and agreement for lifetime financial support. Based on these
agreements as legal grounds the ownership of properties is being established by their
handing over, which can be factual (physical), symbolic and fictive.
Acquiring ownership by inheriting refers to inheriting based on last will and to the
legal inheriting (inheriting by legal kinship line: first, second and third lines of
descendants).
Acquiring ownership by means of a decision of a governing body refers to a court
decision or a decision issued by other authorized governing body.
3. The unit regarding forbidden actions and restrictions in compiling private
collections of cultural properties elaborates the following three issues: restricted actions
and exceptions from the restrictions (3.1); accreditation of individuals as legal entities for
compiling private collections through registered activity (3.2) and authorization of private
collecting of certain kinds of cultural properties (3.3).
As regards private collecting of cultural properties the Macedonian applicable law
outlines several restrictions referring mostly to certain categories of movable properties
and partly to certain categories of collecting entities. Some of the restrictions are of
absolute nature, without any exceptions, whereas others are relative, taking into
consideration that they allow certain exceptions. The legislation outlines six actual, strict
restrictions and exceptions to two of them, including: restriction to private collecting of

archaeological objects and exceptions from the restriction (3.1.1); restriction to private
collecting of immovable properties by destination (3.1.2); restriction to private collecting
of protected properties included in public collections and exceptions form the restriction
(3.1.3); restriction to private collecting of public archive materials (3.1.4); restriction to
private collecting of public archives and documentary material by employees of the State
Archives of the Republic of Macedonia and of the owner of materials (3.1.5) and
restriction to private collecting of protected properties of domestic and foreign origin
acquired in contravention with the regulations (3.1.6). In the legislation that was in force
before the enacting of the presently applicable laws there was also a strict ban for private
collecting of cultural properties by employees of the public institutions for protection of
cultural properties (3.1.7).
Accreditation for collecting cultural properties through carrying out registered
activity imposes a form of constraints related with certain categories of entities dealing
with private collecting. It refers to accreditation of private museums and museums
operating within other entities, private libraries and libraries operating in the frames of
other institutions, as well as private cinematheques and cinematheques within other
entities. To be able to begin their activity these entities have to fulfill certain conditions
and to go through the process of accreditation, in order to be issued by the Minister for
Culture a decision for having met the specific prerequisites for commencing their activity.
The obtained accreditation is subject to reassessment in a period of five years. If there are
some deviations from the standards, that is, from the specific conditions, the act of
accreditation can be revoked, more precisely its validity can be terminated by issuing a
special decision. The legal effect in those instances is the ceasing of the activity of the
accredited legal entity.
Specific form of restriction in composing private collections of cultural properties
is the authorization of certain activities regarding all or some types and categories of
movable heritage. This refers to authorization of exchange and loan of protected heritage
objects (3.3.1); authorization of acquisition of collection arms (3.3.2) and authorization of
collecting specimens from the nature (3.3.3). These actions fall under the regime of
permission, which requires a corresponding procedure and issuing of an act of
authorization by the governing body, if all the prescribed conditions have been fulfilled.
The listed restrictions and constraints influence to a considerable extent the right of
collecting movable heritage and its exercising in practice.
II - PROTECTION OF PRIVATE COLLECTIONS OF CULTRAL PROPERTIES
This chapter presents nine thematic units referring to protected and unprotected
private collections of cultural properties, which are considered as relevant segments in the
legal regime regulating them. It includes the following issues: 1. Legal status of
unprotected private collections of cultural property and the effect of the legislation
regarding on. 2. Public records of private collections of cultural properties; 3.
Classification of private collections of cultural properties; 4: Evaluation and categorization
of private collections; 5. Establishing protection of private collections of cultural
properties; 6. Réévaluation and re-categorization of protected private collections of cultural

properties; 7. Alteration and termination of the protection of private collections of cultural
properties; 8. Registration of private collections of cultural properties and 9. Direct
protection of private collections of cultural properties.
1. Unprotected private collections can have a status of potential cultural heritage
and potential natural heritage, depending on the nature of the property they include,
regardless of the fact whether they have been documented as such in the official records of
some competent body or public institution. According to the applicable Macedonian
regulations unprotected paleontological, geological/mineralogical, zoological and botanic
private collections belong to the category of potential natural heritage, whereas all other
types of unprotected private collections are considered potential cultural heritage.
Unprotected private collections of cultural properties from the category of potential
cultural heritage are governed by the respective laws and special regulations in the domain
of protection of cultural heritage, whereas the category of potential natural heritage is
governed by respective laws and special regulations in the domain of protection of nature.
The issue of public records of protected and unprotected private collections of cultural
properties has been regulated differently in the domains of protection of cultural heritage
and conservation of nature. Namely, in the domain of cultural heritage protection there is a
coherent system of public protection records of varied kinds, part of which refers to
protected and unprotected properties and the other part is concerned merely with protected
properties, including private collections of corresponding status. In that, the registration of
protected properties and, in those frames, registration of private collections is outside the
system of protection records. Unlike this the domain of the protection of nature embraces a
simpler model of public records referring merely to protected properties, including also the
very registration of those properties. In both domains under discussion, however, public
records are merely of declarative nature when it comes to private collections, rather than
bearing statutory effect.
In the domain of cultural heritage protection there are three kinds of protection
records referring to all protected and unprotected properties, including private collections
of cultural properties. They include core, basic and central records all of them requiring
keeping of corresponding kinds of inventories. In that sense core records kept by public
collecting institutions regarding protected and unprotected collections of cultural property
include: general inventories of archaeological, ethnological, historical, artistic and
technical objects (which are being kept by the competent public museums, depending on
the kind of properties and the municipality they belong to); General Inventory of Library
Properties; General Inventory of Phonographic Properties and General Inventory of
Archive Materials. Regarding the basic documentation of private collections there are basic
inventories of archaeological, ethnological, historical, artistic and technical objects; the
Basic Inventory of Library Properties; the Basic Inventory of Audiovisual Properties which
are being kept by the responsible public collecting institutions. On central level the
responsible governmental body — the Cultural Heritage Protection Office, which operates
as part of the Ministry of Culture, keeps the Central Inventory of Movable Properties of
Cultural and Historic Significance.
As regards protected private collections of cultural properties in the domain of
cultural heritage protection there are several special inventories, as well as an additional

one. The special inventories include: the List of National Cultural Heritage Restricted for
Export; National Inventory of Protected Properties under the Regime of Permission for
Export; National Inventory of Protected Properties in the Event of Armed Conflict and the
National List of Collectors and Protected Collections. These kinds of special records are
under the competence of the Cultural Heritage Protection Office. The relevant additional
inventory is the Card-File of Requests and Offers for Exchange and Loaning of Movable
Heritage, keeping of which is the responsibility of the basic institutions for protection.
Two kinds of public records are being kept in the domain of the protection of
nature, including Cadastre of Preserved Areas (which does not refer to collections) and
Register of Natural Heritage (which is relevant to protected private collections). Keeping
of these public records falls under the competence of the Ministry of Environment and
Spatial Planning as governmental body responsible for matters regarding the protection of
nature.
3. Private collections of cultural properties in the domain of cultural heritage
protection, as well as all other properties in that field, have been classified according to the
National Classification of Cultural Heritage of 2006. Their classification is in the
competence of the Cultural Heritage Protection Office. The analysis of the National
Classification points out that it has not been carried out consistently, precisely regarding
the collections and there are grounds for challenging it. As regards the classification, on the
other hand, there are many open issues that now appear to become discretion right of the
competent governmental body. Therefore, the issue of classification in this domain
requires corresponding reconsideration.
In the domain of the conservation of nature there is no official classification that
could also refer to private collections of natural properties.
4. The evaluation and categorization of properties in the domain of cultural heritage
as normative matter have been regulated in accordance with applicable laws in that sphere.
In that sense the evaluation and categorization of private collections in that domain abide
by the same principles, criteria, procedures and manners provided in the regulations.
Contrary to that in the sphere of the conservation of nature regulations apply merely to
evaluation of immovable properties, whereas evaluation of movable properties including
private collections has been left an open issue.
In the sphere of protection of cultural heritage unprotected private collections have
to undergo the procedure of evaluation, which is carried out by the governing public
institutions for protection. The procedure requires working out of respective kind of
elaborate in accordance with the prescribed contents, which is subject to revision by the
Cultural Heritage Protection Office. Based on the worked out elaborate and after the
completed revision an official proposition is being prepared for the purpose of issuing an
act for respective kind of protection.
Private collections in the domain of cultural heritage protection can be categorized
as important cultural heritage (lower category) and as cultural heritage of special
importance (higher category). The later includes two subcategories: cultural heritage of
exceptional importance (higher subcategory) and cultural heritage of high importance
(lower subcategory). Categorization is being carried out alongside with the evaluation of
unprotected collections that are to acquire the status of cultural heritage. Subject to

categorization are also protected collections that have not yet been attributed to the
corresponding category to identify their importance and they are also subject to
réévaluation in that respect. Private collections that are about to acquire some other status
of protection are not subject to categorization.
In the domain of the protection of nature there is corresponding categorization
merely in respect to protected areas and wild animal species. In that, the wild species
bearing the status of natural heritage are being categorized as strictly protected wild specie
or protected wild specie. Unlike them, distinctive minerals and fossils are not subject to
categorization. The treatment is the same regarding natural rarities: they are not being
categorized according to their significance. In that sense, some private collection can be
granted the status of natural rarity, and thereby the status of natural heritage, but it does not
necessarily include its categorization according to its importance, as is the case with the
cultural heritage.
5. The Macedonian legal system outlines a combined model of establishing
protection, which includes elements of the so-called abstract protection, known also as
protection ex lege, and elements of the model of the so-called actual protection. In the
domain of cultural heritage protection, as regard private collections, the model of
combined protection embraces the following modes, i.e., legal techniques of establishing
protection: protection ex lege, temporary protection, pronouncing of cultural heritage and
declaring of national treasure. In the domain of the protection of nature the combined
model involves the modalities that are in force for other categories of natural heritage,
whereas in regard to protection of private collections it indicates merely pronouncing of
natural rarities.
It is noteworthy that there are two forms of ex lege protection, including the so-
called lasting protection and temporary protection. In neither form does this way of
establishing protection require issuing of a special act for protection of any kind, because
protection has been established by the law itself (ex lege).
Protection ex lege in the form of lasting protection regularly pertains to public
collections, in cases when they have been recognized the status of cultural heritage ex lege,
that is, the status of natural heritage ex lege. This form of protection does not refer to
private collections in the domain of the protection of nature and in the sphere of cultural
heritage protection it refers merely to collections of private archive material, which has
been recognized the status of important cultural heritage ex lege.
Protection ex lege in the form of temporary protection does not refer to the domain
of the protection of nature, which means that private collections in that sphere can not
acquire the status of temporary protected properties ex lege. Unlike them private
collections in the sphere of cultural heritage protection are considered to have obtained a
recognized status of properties under temporary protection ex lege if a procedure has been
commenced for establishing of their protection by issuing a special act for protection. The
status of temporary protection is in force during the entire procedure until the act for
protection has been issued.
The temporary protection ex lege in the afore-mentioned instances can be combined
with actual temporary protection, if the initiated procedure refers to acquiring the status of
cultural property under temporary protection to be enacted by issuing a decision for

temporary protection. In those instances the legal effect of the decision for temporary
protection is not longer than six months. The procedure for temporary actual protection is
commenced by submitting a proposition for issuing an act for temporary protection, which
is being forwarded to the Cultural Heritage Protection Office by the authorized public
institution following the revision of the evaluation elaborate. In the domain of the
protection of nature actual temporary protection as way of establishing protection applies
merely to wild animal species and to areas of the nature for which a procedure has
commenced for their pronouncing as natural heritage, but it does not refer to natural
rarities and therewith it does not apply to private collections of that domain either.
Pronouncing private collections as cultural heritage in the respective category and
pronouncing of natural rarity are standard procedures for providing lasting protection of
those collections. In the domain of cultural heritage protection acquiring the status of
cultural heritage by means of its recognition by the responsible governmental body is
predetermined by the very categorization of private collections and requires adherence to
certain modalities associated with the procedure of proclamation itself. In that sense, the
proclamation of private collections as important cultural heritage is the responsibility of the
Cultural Heritage Protection Office and is being done by issuing a proclamation decision.
Proclamation of cultural heritage of exceptional importance is under the competence of the
Government of the Republic of Macedonia, which issues a proclamation decision. On the
other hand, proclamation of national rarities in the domain of the nature conservation is the
responsibility of the Ministry of Environment and Spatial Planning. In the applicable
legislation governing this domain, however, the issue of proclamation of natural rarities
has been dealt with partially and inconsequently, so that the recognition of private
collections has been completely disregarded and left to provisional interpretation.
Unprotected private collections in the sphere of cultural heritage protection can be
placed under protection through a brief and express procedure in cases when the
collections or parts of them are subject to already commenced procedures for export or
restitution, i.e., returning to the country of origin. This is being officiated by declaring
them as national treasure, if the prescribed conditions have been fulfilled. The procedure is
being conducted ex officio by the Cultural Heritage Protection Office or on the grounds of
a proposition by the responsible public institution for heritage protection. In these instances
the decision for declaring national treasure has the legal effect of an act of proclamation of
important cultural heritage. This modality of establishing protection is not applicable
regarding private collections in the domain of the conservation of the nature.
6. Réévaluation of protected private collections in the sphere of cultural heritage
protection is closely associated with the alteration and termination of the protection, being
a professional activity that precedes these two procedures. In this domain there are two
types of réévaluation: obligatory and regular. The obligatory réévaluation is related with
the transitional regime of the Law on Protection of Cultural Heritage. It refers to the
protected private collections with the status of monuments of culture obtained by
application of regulations that are no longer in force, in case they remain under protection
and should be pronounced cultural heritage of the respective category. The Regular
réévaluation is relevant to protected collections that bear a different protection status, the
ones that are about to obtain the status of cultural heritage and the collections having a

status of categorized cultural heritage and should be re-categorized or should undergo
some other relevant alteration that requires proper concordance of the protection status.
The responsible bodies and the procedure are the same as the ones regarding evaluation.
As to the réévaluation of private collections in the sphere of nature conservation it is still a
standing issue in the legislation in force in the same way as the issue of their evaluation.
Re-categorization of protected collections as legal option has been prescribed
merely for the sphere of cultural heritage and not for the nature conservation. It regulates
the possibility of changing the subcategory or the category itself, which has been
recognized or obtained in accordance with the basic law regulating the domain of cultural
heritage protection. In cases when it is possible re-categorization is being carried out
within the procedure of réévaluation.
7. After the establishing of protection of private collections in both domains
changes can occur regarding the protection, which are manifested as alterations relevant to
the contents of the acts for protection. In those cases after conducted réévaluation a
procedure is commenced for the alteration of the protection. This procedure is the same as
the procedure for establishing protection and is being carried out by the body that issued
the act for protection. The very act of alteration is of the same rank as the act of protection.
In the domain of the cultural heritage protection, unlike the sphere of the nature
conservation, there is another kind of change manifested as alteration of the legal ground
of protection. It pertains to cases when certain legal ground has been substituted for
another one. This refers to the following legal instances: (a) when private collections have
been protected in accordance with regulations that are no longer in effect (on the grounds
of obligatory réévaluation from the transitional regime); (b) when established abstract
temporary protection (temporary protection ex lege) is being transformed into actual
temporary protection; (c) when actual temporary protection is being transformed into
actual lasting protection (by pronouncement) and (d) when abstract lasting protection of
private archive material {ex lege) is being transformed into actual lasting protection of
higher rank (higher category).
Private collections within both considered domains can lose the acquired status of
protection by means of an act for termination of protection, which is being issued by the
same body having issued the act for placing the collection under protection. In that sense,
protected collection in the domain of cultural heritage can lose the acquired status of
protected heritage in cases when it is subject to permitted export, if it has been destroyed
irreversibly or if the importance due to which it has been placed under protection has
perished. Likewise, in the domain of nature conservation a private collection can lose the
acquired status of protection if the features which were the reason for its pronouncing as
natural rarity have perished. Aside from this, regarding the cultural heritage protection in
instances of abstract temporary protection the acquired status of a private collection is
terminated automatically {ex lege) after the expiration of the preclusive term, unless the
proposed act for placing under protection has been issued in the meantime.
8. Registration of protected private collections in both domains of interest is a
professional-administrative activity and an instrument for identification, which has never
borne any statutory effect. In the Macedonian legislation it has never been adopted, not
even as a way of establishing protection, as is the case other national systems of protection.

In the domain of cultural heritage protection protected private collection are being
registered in the National Register of Cultural Heritage, depending on their status.
Consequently, private collections bearing the status of cultural heritage in any of the
categories are being registered in the Main Book of the Register, more precisely, in Part
Two — Movable Cultural Heritage, whereas collections bearing the status of cultural
heritage of exceptional importance are additionally being registered in Part Four of the
Register. Unlike them, private collections with the status of temporary protection are
registered merely in the Supplementary Register of Properties under Temporary Protection.
There are no special provisions regulating the registration of protected private
collections in the domain of nature conservation. This normative matter is still an open
issue.
9. Regarding physical protection, i.e., actual conservation of protected private
collections in the domain of cultural heritage protection it is basically regulated by the
same provisions proscribed in the basic heritage law and the books of regulations arising
from it. It concerns conservation researches, working out conservation projects,
professional control of conservation projects, authorization of the activities to be applied,
carrying out conservation-restoration activities and other actions of physical protection,
conservation supervision and final professional control of conducted works (so-called
technical approval of the carried out activities). These are standard conservation
procedures that include prescribed standards and norms, requiring prior obtaining of an
approval for conservation research (in cases where it is prescribed by the law), and an
obligatory conservation approval (in all instances of actual conservation), as well as taking
over legal measures in cases when activities of physical protection are being carried out
without conservation approval or in contradiction with it.
In the sphere of conservation of the nature the term “physical protection“ has
different meaning: it refers to activities of guarding services in the protected areas
(rangers’ service). Works on preparation, conservation and related professional activities
have not been regulated in the legislation pertaining to that sphere.
Ill - RIGHTS AND OBLIGATIONS OF THE OWNERS OF PRIVATE COLLECTIONS
OF CULTURAL PROPERTIES AND RESTRICTIONS BY
THE REGIME OF PROTECTION
This chapter deals with three themes: 1. Rights of owners of private collections of
cultural properties; 2. Obligations of owners of private collections of cultural properties
and 3. Restrictions imposed by the regime of protection of private collections of cultural
properties.
1. Collectors and other owners of protected private collections of cultural properties
in the sphere of cultural heritage protection have certain rights prescribed by the law,
which have herewith been systematized as primary rights (1.1) and special rights (1.2).
The group of primary rights includes: the right to professional assistance (1.1.1);
right to compensation for unexpected expenses (1.1.2); right to rightful compensation for
various constraints due to restrictions by the regime of protection (1.1.3) and the right to
warranty in the event of damage (1.1.4).

The group of special rights comprises: the right to public presentation of the private
collection (1.2.1); right to depositing (1.2.2) and the right to privileges (1.2.3).
In the sphere of the conservation of the nature the issue of the rights of the owners
of private collections has not been specifically dealt with in the applicable regulations.
2. Obligations of the owners of private collections of cultural properties in the
sphere of cultural heritage protection prescribed by the law have here been systematized in
two groups: primary obligations (2.1) and special obligations (2.2).
The group of primary obligations includes: reporting of private collections -
possession of unprotected collections, as well as of legal and factual changes concerning
the protected collections (2.1.1); introduction and keeping of inventories and other records
and documentation of properties included in private collections (2.1.2); keeping,
maintaining and appreciating protected private collections (2.1.3); conducting the
prescribed measures for protection of private collections (2.1.4); returning of the public
funds invested in private collections - in cases when the ownership of the collection has
been transferred (2.1.5); providing access to unprotected private collections for official
needs (2.1.6); providing access to protected private collections for official and other public
requirements (2.1.7); loaning protected private collections or parts of them for cultural
manifestations (2.1.8); reporting to the new owner about the status and regime of the
protected private collection (2.1.9); providing access to the kept inventories of the
protected private collections (2.1.10) and revision of protected collections in private
museums, libraries and cinematiques (2.1.11).
The group of special obligations includes: ground check of the origin and reporting
of any dubious purchase offer (2.2.1.); taking measures for the security of protected private
collections and cooperation with police departments (2.2.2) and taking measures for
protection of the protected private collections in the event of armed conflict and natural
disasters (2.2.3).
The matter of obligations of owners of private collections in the domain of
conservation of nature has not been precisely regulated in the applicable legislation.
3. Restrictions imposed by the regime of protection of private collections of
cultural properties in the domain of cultural heritage have been systematized in three
groups, including: restrictions that are related with the use and utilization of protected
private collections (3.1), restrictions in handling of protected and unprotected private
collections — trade restrictions (3.2) and other restrictions arising from the regime of
protection (3.3).
The first group of restrictions includes appointing of a custodian of the protected
private collection (3.1.1); handing over of the protected collection for temporary keeping
and use, or its relocation for ensuring protection (3.1.2); designating the manner and goals
of the utilization of the protected private collection (3.1.3) and returning it to the previous
condition (3.1.4).
The second group of restriction comprises: the right to priority in purchasing
(3.2.1) ; taking abroad of protected and unprotected private collections or parts of them
(3.2.2) ; export of protected and unprotected private collections or parts of them (3.2.3);
restrictions for transfer of ownership of private archive material to foreign individuals and
legal entities (3.2.4) and trade with specimens of the nature (3.2.5).

The third group of restrictions refers to: permitted import of cultural properties
(3.3.1); restitution of protected properties originating from foreign counties (3.3.2);
replicas and reproductions of protected cultural properties (3.3.3) and inspection over
protected private collections (3.3.4).
All of the above restrictions have been treated in the aspect of their contents, legal
consequences, competence, procedures, acts of authorization and related aspects.
4. The entire matter of the rights and obligations of the owners of private
collections and the restrictions imposed by the regime of protection has been dealt with by
consideration of the historical background, including short review of formerly applied
legislation. Besides, this matter has been treated by consideration of corresponding aspects
associated with violations and criminal offences as have all other issues elaborated in
Section Two of the publication.
