The Genre of Early Modern English Statutes: Complexity in Historical Legal Language
The study assesses the diachronic development of complexity in Early Modern English par֊
liamentary acts and proclamations between 1491 and 1707. The work defines complexity as
the number, variety and organisation of linguistic elements and incorporates new linguistic
features for the investigation. How do complexity features function in historical legal writing?
How do the features develop diachronically and how systematic are the genres on their lingu-
istic elements? The analysis is carried out in a self-compiled corpus, the Corpus of Early Mo-
dern English Statutes (1491-1707). The survey relies on corpus linguistics, genre analysis and
historical pragmatics, emphasising the communicative context and socio-historical setting.
The study forms a framework for analysing complexity in legal language that extends to the
textual, syntactic and lexical level. The examined elements on the textual level are text struc-
ture, layout and text types. On the syntactic level, the study surveys sentence length and punc-
tuation, coordination, binomials and multinomials and subordination. Finally, on the phrasal
level lexical bundles are scrutinised in order to form a corpus-driven view of repeated pat-
terns. The legal documents are packed with complexity features, but at the same time they
employ textual, syntactic and lexical repetition that make the texts more predictable. Further,
many diachronic changes in the acts occur at the turn of the sixteenth century along with
extralinguistic developments.
