UN CONVENTION ON THE RIGHTS OF THE CHILD TODAY

The contribution presents the development of the idea of protection of children’s
rights as a special group of human rights ֊ from the Declaration on this topic of the
League of Nations (1924), UN Declaration of 1959 until passing of the UN Con-
vention on the rights of the child in 1989. The article gives information on philo-
sophical and social background of this processus. While analyzing the contents of
the Convention the article emphasizes the new position of the child who is not only
an object of protection but in the first place a subject of his/her own rights. This new
attitude fundamentally changes child s legal position in international as well as in
national law. The article then deals with some dilemmas the authors of the Conven-
tion were confronted with: how to define a child without opening the question of
beginning of a child s life; the problem of the death sentence in view of the fact that
the Convention declares a child’s right to life and some others.
While assessing the Convention twenty-five years after its being accepted, the
author assesses it as a successful internal law document that has justified its role.
The position of children has certainly improved during this last period and the
Committee of children s rights, the body of the Convention has contributed a lot
to successful implementation of the Convention. However, there still exists many
a violation of children s rights, some of them being old as for example violations
of the girls right to education in some parts of the world. Since the beginning of
the financial and economic crisis the group of economic rights of children is prob-
ably the one that presents the most frequent and most severe violations of their
rights - in the developed part of the world and in Slovenia as well.
GENERAL VIEW ON CHILDREN’S RIGHTS IN SLOVENIA - 25 YEARS
AFTER THE UN CONVENTION ON THE RIGHTS OF THE CHILD

The present article addresses some of the general issues of normative regula-
tion of children’s rights in the Republic of Slovenia and exercising these rights. It

takes a position on the demands for establishment of a special Children’s Om-
budsman, as well as on the proposal of the UN Committee on the Rights of the
Child for a comprehensive legal regulation of children’s rights and the motion for
amendment of the constitution. The author believes that (over)regulation of basic
principles of international agreements proves to be unnecessary or even harmful.
The best interests of the child, as one of the basic principles of the Convention of
Children’s Rights, has to be established in consideration of all the circumstances
in a particular case. References to the principles of the Convention must not lead
to arbitrary decisions disregarding the positive law.
POVERTY IN CHILDREN - A CHALLENGE FOR PROTECTION OF THEIR
ECONOMIC RIGHTS

The main research question of the paper is how Slovenia respects article 27 of
the Convention of the rights of the child which says that states parties recognize the
right of every child to a standard of living adequate for the child’s physical, mental,
spiritual, moral and social development. States Parties, in accordance with national
conditions and within their means, shall take appropriate measures to assist parents
and others responsible for the child to implement this right and shall in case of need
provide material assistance and support programmes, particularly with regard to
nutrition, clothing and housing. This article of the Convention is binding states to
accept measures that will provide children with the level of living above the pov-
erty line and assure their well-being. It is a normative framework for state policies
towards children. The author explores the issue with looking at the statistical data
on child poverty, analysing reports and recommendations of international organisa-
tions in regard to child poverty in Slovenia and it concludes with an assessment of
current state of the affairs and impacts of policies on child poverty.
SOCIAL RIGHTS FOR THE BENEFIT OF A CHILD - THEIR ENHANCE-
MENT OR REDUCTION IN THE TIMES OF RECESSION?

Without children there is no future for any society. Therefore children should
enjoy special protection, also with equalisation of burden within the community
of socially insured persons or inhabitants. Children as young humans enjoy all
human rights. They are especially pronounced in the UN Convention on the rights
of a child, a 25 years old instrument with numerous ratifications.

Social rights of children (and their parents) for the benefit of children are being
limited during the time of recession. This is especially true in social insurances.
The right to a family pension is more limited than before, lowering of retirement
age due to childcare is enabled mainly for women, although there is a question,
whether it is truly for the benefit of children and women, suitable employment is
restricted (although care for a child is taken into account). Conversely, legal posi-
tion of children of contributions non-paying parents has improved in mandatory
health insurance. Special regulatory mechanism applies for parental care insur-
ance and family benefits schemes. Broader scope of rights is legally promised for
the time when the recession ends and there is a certain economic growth. Such
regulation is doubtful, since the rights might be modified even before the law
would become effective. In addition, rights of a child are regulated in distinctive
legal acts, reducing transparency and legal certainty.
Better legal protection is granted to families with the lowest income. But only
with such measures, full realisation of much broader right to social security could
not be achieved. It should be guaranteed to everyone as a member of a society,
hence also to every child (with distinctive needs) and every family (regardless of
its composition). Convention on the rights of a child promotes improving the liv-
ing conditions of every child.
CHILDREN S RIGHTS IN FAMILY LAW ֊ DEVELOPMENT IN SLOVENIA
SINCE ENTERING INTO FORCE OF THE UN CONVENTION OF THE
RIGHTS OF THE CHILD

Ratification of the UN Convention on the Rights of the Child had a strong impact
on the improvement of the position of the child in the Slovenian regulation of fam-
ily relationships and in the proceedings affecting children. Nevertheless, there are
still many opportunities for improvement: we should shorten the procedures con-
cerning the protection of the children and we should find a more efficient way to
enforce the right of the child to express his or her views. We should improve the
regulation of the measures for the protection of the child. In the cases when there is
no perspective to reintegrate the family, a stable alternative care to the child should
be provided. There should be a database of all procedures and implemented meas-
ures for the protection of the individual child to avoid conflicting decisions. Many
of these questions were resolved in the Family Code, which was adopted by the
National Assembly on 16th of June 2011, but wasn’t confirmed by voters in a legis-
lative referendum on 25th of March 2012. After one year it could be re-submitted to
the legislative process, but unfortunately this did not happen.

CHILDREN’S RIGHTS AND CRIMINAL PROCEDURE

The Slovenian model of treatment of juvenile offenders was established back
in 1959 and it is still dominated by elements of the protective approach; the pur-
pose of the treatment is support and education of juveniles. A special law on ju-
venile offenders (which means to exclude provisions for juveniles from the gen-
eral substantive and procedural law) should be introduced to prevent the change
of our model in a more punitive way. A more detailed analysis of the model shows
two critical points that we need to pay more attention to. First, the duration and
execution of pre-trial detention, and second, the alternative methods of treatment,
whereas their use in practice is declining dramatically. In Slovenia, child victims
received special attention since the end of the 90’s. New provisions in the Crimi-
nal Procedure Code are focused on reducing the negative effects of hearing (di-
rect questioning of children under the age of 15 is not permitted in the main hear-
ing), to assist the child in the exercise of their rights in the proceedings (the child
has a right to a lawyer paid by the state), and in understanding the process (the
child may be accompanied by a support person). These measures represent a ma-
jor step towards creating a child-friendly justice, but they should be further devel-
oped and more attention should be paid to problems in their implementation.
PARTICIPATIVE CHILDREN S RIGHTS: THE RIGHTS TO HIS/HER VIEW,
TO FREEDOM OF THOUGHT, RELIGION AND ASSOCIATION

The essential novelty brought by the Convention on the Rights of the Child is
that it also recognizes liberty rights for children, that is, a special kind of rights to
freedom of speech, religion, assembly, etc., which are called “participatory rights”
by some commentators of the Convention. However, although the aforemen-
tioned freedoms are ascribed to all children, only some children can exercise
them. For liberty rights are rights of choice, which presuppose the autonomy of
the subject of those rights. Therefore, only someone who is capable of making
rational judgments, choices and decisions can exercise them. But the problem is
that the Convention does not specify when children are able to freely take reason-
able decisions regarding exercise or non-exercise of the liberty rights that the
Convention recognizes for them. In addition, this article critically deals with
some other problems which are mainly related to the exercise of these rights - and
especially the right of the child to freedom of religion - in Slovenia.

HEALTH RIGHTS OF CHILDREN AND THEIR IMPLEMENTATION

The current article addresses children’s health rights in Slovenia and it deals
with realization. In the 24th Article of the Convention about children s rights it is
stated that countries, signed under the Convention, acknowledge children s health
rights to the highest health standards. Children in our country have many health
rights, which are regulated and specified by law: rights to preventive health care,
the right to choose a personal physician, the right to vaccination against infec-
tious diseases, the right to coexistence of parents in the hospital with a sick child,
rights to treatment in health resorts, the right to prescribed medication, the right
to medical devices, rights for children who need special care, rights for children
with special needs and children s right to protection against injuries. Despite the
economic crisis in our country in recent years the children s health rights are
mostly respected and acknowledged due to the general state care and especially
due to complete dedication of health professionals. There is a significant lack of
funding for the treatment of seriously ill children. Unfortunately, in recent years
children s health rights have been consciously violated also by parents.
IMPLEMENTATION OF CHILDREN’S RIGHT TO EDUCATION

The paper presents the realization of the right to education, as set out in the Con-
vention on the Rights of the Child, in the RS. At the outset, attention is drawn to the
special status of the right to education, which is not only the right of children, but
also adults. Moreover, the right to education is closely linked to the realization of
all other rights. The article presents a general overview of the implementation of
rights according to the definitions 28 and 29 of the Convention. Then it outlines the
problems with the implementation of the Convention in selected areas. The main
points are related to the education of Roma children, the quality of knowledge,
private education. The complexity of the problem of the realization of the rights of
Romani children to education has been repeatedly pointed out in international RS
reports on the implementation of the Convention. It is not so obvious, however, that
the quality of the knowledge received by students in the schools is also the aspect
that should be considered from the perspective of the Convention. The contribution
analyzes the regulation of private schools: this is the area of education in Slovenia
where the biggest normative and factual change has occurred in the period after the
adoption of the Convention on the Rights of the Child. The analysis shows that the
arrangement is such that satisfies the requirements set forth in the Convention.

THE RIGHT TO INCLUSIVE EDUCATION OF CHILDREN WITH SPECIAL
NEEDS: OBSTACLES AND IMPLEMENTATION POSSIBILITIES

All children within the framework of international and national documents are
guaranteed the right to inclusive education, which enables their participation, in-
volvement and success. Inclusion affects the quality of education of children as it
allows the optimal development potential of each individual and his involvement
in the broader environment and therefore cannot only be an addition to the exist-
ing education system. With inclusive education prejudices towards children with
special needs who are among the most excluded groups of children could be over-
come. Obstacles to the achievement of inclusion are often present in an environ-
ment in which children with special needs are living rather than in their own
deficits. In an inclusive school peers without special needs experience the value
and importance of diversity while children with special needs gain a barrier-free
environment for optimal development of their potential. Since inclusive educa-
tion is a highly sensitive area with many promoters and opponents changes intro-
duced should be systematic and systemic.
IMPLEMENTATION OF THE UN CONVENTION ON THE RIGHTS
OF THE CHILD - THE CASE OF THE ROMA ETHNIC MINORITY
IN SLOVENIA

The Convention on the Rights of the Child is a unique document on human
rights protection as it does not merely protect children’s civic and political rights,
but extends protection also to their economic, social, cultural, and humanitarian
rights. The Convention covers a broad spectrum of children’s rights, stipulating
that childhood is entitled to special care and assistance (fourth indent of the Pre-
amble) which the States and the competent authorities must ensure without dis-
crimination. The paper focuses on a single segment of the rights of the child - the
right to education.
The paper critically evaluates the methods used to implement the education of
Roma children. This has not been chosen by the Roma but has been imposed by
the State. The authors argue that deviations in the educational system occur also
because the State fails to take into account the specifics of the Roma.
Based on the results of a comprehensive project entitled The Increase in Social
and Cultural Capital in Areas with a Roma Population, the authors note that in the
light of building the social capital of Roma pupils, it is necessary to start already

at an early stage and work within the Roma settlements. The Roma settlement
must become an environment where a considerable number of activities regarded
as informal forms of education take place: educational support to Roma children,
free-time workshops for children and parents, sports, etc.
RIGHTS OF REFUGEE CHILDREN AND CHILDREN SEEKING
INTERNATIONAL PROTECTION: A BLURRED CONTEXT?

The author raises a question if the best interest of the child according to the UN
Convention on the Rights of the Child requires that states have to provide the
residence to a child seeking international protection. Categorical answer is not
viable; however, a child does not have an automatic right to reside just on the
ground of his/her vulnerability, even despite being unaccompanied. In line with
this, Article 22 of the Convention mostly prescribes states obligations of effort.
The author gives more emphasis on the treatment of unaccompanied minors
whose vulnerability is in principle more distinctive than in the cases of children
who left a country of origin with parents or other persons responsible for them.
The basic and undisputed goal of the Convention remains that the undesirable
situation of an unaccompanied and vulnerable child staying in the host state is
surmounted. The most important means to decommit or mitigate responsibility of
the state are the following: tracing parents and establishing contact with them;
guardianship; return of an unaccompanied minor to the safe country of origin or
a third country. The author concludes that a society outlines its moral and ethical
substrate and builds up the framework of (co)habitation values by aiding a child
in need that had to leave the home country with family or alone. Last but not least,
open societies enjoy long-term benefits, a fact proven by many cases of famous
refugee children.
