SUMMARY
According to the article 135 of the Polish Constitution of 1997, the head of
state has an advisory body for the internal and external security matters -
the National Security Council. Its organizational, technical and financial
support is provided by the National Security Bureau. The National Security
Council analyzes and evaluates security policies, foreign policy and
strategic issues of national security and the drafting of strategy, defence
doctrines, directions of armed forces development, as well as non-military
issues. All of the above are to create an integrated, comprehensive system
of national security. The NSC, however, is an advisory body and is not
entitled to issue binding decisions, for instance those in relation to the
Council of Ministers. Nevertheless, due to the fact that it works alongside
the President of Poland, who is head of the Polish Armed Forces, and it is
composed of representatives from many quarters, it fulfills an important
role in the preparation of the Polish state for the occurrence of a political-
military threat.
Conducted research proves explicitly that there is a need to generate
an integrated national security system, in which the Head of State has
a leading position. An advisory body to the President of the Republic
of Poland a need to determine of the proper shape of, using historical
experiences and solutions existing in other countries.
Thus, it seems appropriate to build an optimal model of organization
and functioning of the advisory body of the head of the Polish state,
assuming the constitutional requirement for cooperation between the
executive bodies in matters of national security, of course respecting
the constitutional prerogatives of the President. The starting point is to
determine the legal and constitutional position of Head of State in the
system of national security and to define the rules of its cooperation with
the Council of Ministers. At the same time it mustn t be forgotten that
the issue of organization and functioning of the advisory body cannot be
seen as a problem of an autonomous nature, not associated with national
security management system. It must be considered in the context of the

effectiveness of chief national security management subsystem, which
should be adapted to meeting the challenges and tasks in all functioning
conditions of the state, either during peace time, crisis or war.
In crisis situations, the chief national security management subsystem
must be able to exploit the potential of the whole national security
system of the Republic of Poland, naturally in compliance with all rules of
functioning of the state in accordance to the laws of its usual condition.
Also the executive authorities are obliged to act in the same manner, so we
can assume that the modification of the national security system caused
in this situation by its management subsystem, will happen mainly on the
executive level. In the operational domain therefore, this should lead to
greater integration of national defence and protection subsystems, that
will form the operational part of the state emergency response system that
goes far beyond merely the dimension of natural disasters and technological
catastrophes (failures).Thus, the need for decision-making bodies that are
in constant readiness is evident, and it seems that the answer here are
staff elements responsible for strategic coordination of the operational
part of the crisis response system and, in certain situations the emergency
response system in the socio-economic domain.
The set of activities that are the most difficult to plan and organize,
much of which are subject to coordination by bodies forming part of the
chief national security management subsystem, is the state functioning
under martial law. It is the more problematic that at the moment, a proper
analytical center responsible for planning and coordination at the state
level, involved in monitoring challenges and threats affecting the security
and defence situation, does not exist. During the martial law, the chief
national security subsystem should not be merely a counterpart to the
state defence management system, which consists of the President
and the Council of Ministers. Its primary responsibility should be the
management of state defence, and at the same time it must not neglect
its other responsibilities connected with securing the functioning of state
and society. Martial law and the resulting specificity of state defence
management, necessitates the adoption of individual management and
incurring one-man responsibility. Without amending the Constitution,
those intricacies are impossible to solve, although a reasonably acting
legislator may adopt a law on the management of national security, along
with novelized martial law regulations, since the Constitution does not
specify who should be in charge, leaving it to the proper acts.

Summary
Advisory bodies to the Polish Head of State, have a rich history dating
back to the beginning of the Second Republic. Some basics of institutional
. support for the head of state in that dimension were created by the State
Defence Council, acting on the basis of the Act of 1 st July 1920. However,
the institution could to interact with the head of state in the area of widely
understood defence preparations. The two-instance War Council was
established in January 1921. Then, in 1926 a new body has been formed
- the State Defence Committee. The Bureau of the SDC was also called
up for its substantive, organizational and technical service. This solution
has launched a phase of institutional dimension of the advisory body of
the head of the Polish state. Since 1936, the Defence Committee of the
Republic took place of the State Defence Committee, and in exile those
functions were performed by the external State Defence Committee.
Referred institutionsoperatedinavarietyofconditionsandconstitutional
arrangements: under a President with limited powers - according to the
March Constitution of 1921, and the extensive powers of the head of state -
in April Constitution of 1935, as well as in exile. They generally did not work
systematically, remaining bodies without a significant impact on political
and strategic issues. The reasons for this phenomenon should be primarily
sought in the practice of working out decisions on defence matters by the
highest executive bodies of the Second Republic. It is also worth to note
the considerable involvement of the Secretariat of the Defence Committee
of the Republic, which became in fact the main link of Polish organizations
in defence preparations. The role of the military and military institutions in
decision-making, with regard to the military and economic potential of the
interwar period, was decisive.
During the Polish People s Republic, high activity of the National Defence
Committee was demonstrated. Its work did not end with the processes of
socio-political transformation after 1989. The NDC continued functioning
as a body subordinated to the President, formally until 2003, giving place
to the National Security Council. Based on organizational and functional
analysis of the Committee of National Defence, it should be noted that
in fact it was a planning and coordination body which also held direct
leadership over the process of defence preparations for the whole state. The
disadvantage of this structure was its partiality and concentration of power
that enabled taking decisions instead of authorities. Another problematic
feature was also the collegial decision-making that actually diffused
responsibility and was in contradiction with the fundamental principle of

one-man responsibility in managing the security of the state. It is worth
emphasizing, however, that during the time of functioning of the People s
Republic of Poland, no system of training state administration managerial
personnel was established, thus it lacked professionally qualified personnel
that would be able to solve and implement defence tasks. Hence, the main
burden of the current organizational work, just like before the war, rested
on professional soldiers who formed the core of substantive staff in the
state administration, ministries and in particularly important to the security
of the state, areas of national economy. Significant qualitative changes in
this area were forced by the political transformation after 1989.
Efficient management of national security is conditioned by the
existence of the proper application-specific organizational structure
connecting the decision-making, advisory and staff bodies, both inside the
chief management subsystem, and among the overriding national security
management system and the whole sphere of executive subsystems, as
well as with the political, social, economic, cultural and other domains of
the overall national security system. It is thus crucial to build a model of an
advisory body to the head of state, with the assumption of constitutional
requirement for cooperation between the executive branch in matters of
national security, while respecting the constitutional prerogatives of the
President. The presence of two bodies of executive power, in this case
the President of Poland and the Council of Ministers demands the system
to take into account two governing bodies. By the Council of Ministers
it seems necessary to establish the Ministers Committee for National
Security Affairs or the Government National Security Committee. Advisory
institutions functioning under the President of the Republic of Poland
and the Council of Ministers, together with the administrative bodies,
will create a new organizational and functional value, serving as the chief
committee for national security management subsystem, distinguished
by its organizational ability to manage complex processes of national and
international security.
The co-existence of two collective bodies dealing with challenges
to security that constitute the structure, makes it necessary for them to
cooperate closely. This cooperation will be effective only if these bodies,
regardless of their political representation, will be oriented towards the
achievement of the security of the state as the supreme goal that results
from the national interest. Basing on the functional analysis of an advisory
body to the head the state, the National Security Council should comprise

individuals responsible for defining the Polish raison d etat and designating
standards in the field of national security, such as the representatives
of the highest state authorities, leaders of political parties having their
representatives in parliament, as well as representatives of major NGOs.
This body should focus primarily on the problems of political consensus on
the essential issues of national security, and identify priorities of the state
in this regard.
In general, attempts to create an advisory body functioning under the
President of the Republic of Poland, in the character of an expert group are
rather prone to failure because of its the consultative dimension, and thus
ineffective. Atthe present constitutional arrangements in Poland, this option
does not make such an institution a counting a partner in development
of an integrated security architecture. As for the ongoing implementation
of the projects undertaken by the President in the security domain, it is
performed by the staff body in the form of National Security Bureau.
It should be emphasized that after numerous organizational changes,
the structure performs its role effectively, demonstrating a significant
operability. Both the historical experience and analysis of contemporary
security considerations, also of those pertaining to the solutions applied in
other countries, provide interesting insights that may be useful to define
and ultimately determine the shape of the staff and advisory body to the
President, and thus contribute to generating an integrated, comprehensive
national security system for the Republic of Poland.
