PARATHENIE
Paraqitja e burgjeve tè para si vende per izolimin e personave tè
caktuar, tè kryerèsve tè veprave penale dhe tè sjelljeve tè tjera devijante
daton qè nga kohèrat mè tè vjetra, pra shumè me herèt sesa lajmèrìmi i
dènimit me heqje tè lirisè ose me burgim, si lloj i i dènimit.
Burimet historike dèftojnè se burgun e kanè njohur shtetet mè tè vjetra si:
Egjipti i vjetèr,Mesopotamia, Asiria, Babilonia, Izraeli i vjetèr, Roma,
Greqia e vjetèr dhe disa shtete mesjetare. МЫ ekzistimin e burgjeve qè
nga kohèrat e vjetra flasin edhe termat e posagèm tè cilèt ishin tè prani-
shèm nè tè drejtèn e popujve tè caktuar, tè cilèt emèrtonin burgjet si
vende per privimin e lirisè.1 2 Mirèpo, burgjet e kèsaj periudhe kohore
kishin karakter krejtèsisht tjetèr nè krahasim me burgjet e shoqèrisè sè
sotme. A to shèrbenin si masèpreventive ndaj disa kategorive tè kryerèsve
tè veprave penale dhe tè sjelljeve delikuente, per sigurimin e pranisè sè
tyre derisa t’u shqiptoheshin dhe ekzek dènimet kryesore, e qè,
siqdihet, si dènime mè tè shpeshta ishin dènimet me vdekje dhe dènimet
trupore. Edhe gjatè periudhès sè mesjetès пик ka ekzistuar dènimi me
heqje tè lirisè si lloj i dènimit. Burgu, si forme e heqjes sè lirisè, edhe
gjatè kèsaj periudhe kohore, kishte mè tepèr karakter tè njè masepreven-
tive.
Dènimi me heqje tè lirisè, si lloj i posagèm i sanksionit penai,
paraqitet nè fund tè shekullit XVIII. Sipas konstatimeve nè literaturè, ky
dènim per herè tè pare èshtè paraqitur nè kodin penai francez tè vitit
1791.
Nè Republikèn e Serbisè dhe nè dy KSA (tè Kosovès dhe tè
Vojvodinès) ekzekutimi i dènimit me heqje tè lirisè ose me burgim deri nè
fillim tè vitit 1998, èshtè rregulluar me Ligjin mbi ekzekutimin e
sanksioneve penale tè vitit 1977, tè cilin e ka nxjerrè ìsh Republika e
Serbisè sè bashku me ish KSA tè Kosovès dhe tè Vojvodinès.1 Ndèrkaq
organizimi dhe llojet e institucioneve (burgjeve) per ekzekutimin e
sanksioneve penale ishte rregulluar me akte tè KSA tè Kosovès. Duke и

bazuar ne Aktin e atēhershēm organizativ nē sistemin jnridik te
KSA teKosoves, funksiononin keto institucione per ruajtjen e
neve penale:
- Burgu i Qarkut nē Mitrovicē,
- Burgu i Qarkut nē Prishtinē,
- Burgu i Qarkut nē Pejē
- Burgu i Qarkut nē Prizren dhe
- Burgu i Qarkut nē Gjilan,
Nē ndērkohē u themeluanedhe Shtēpitē Korrektuese
nē Smrekonicē dhe Shtēpia Edukuese Korrektuese (per tē mitur) nē
Lipjan,nē kuadēr tē sē cilēs u themelua edhe burgu i grave, si lloj i
veg ante i institucionitndēshkimor korrektues, si dhe Shtēpia Ndēshkuese
Korrektuese (burgu) i Dubravēs nē lstog, me e burgut nē
Gjurakoc.
Me rēndēsi ēshtē tē theksohel se me disa le vogla, kjo
strukturē organizative e sistemit penitrecial burgjeve) ēshtē edhe sot
nē sistemin penal juridik tē Republikēs sē Kosoves.
Nē Mitrovicē, burgu per izolimin epersonave tē caktuar sig dihet,
ka ekzistuar qe nga fillimi i organizimit tējetés dhe iformimit tē organeve
tē pushtetit.Sipas Jjalēve tē disa pleqve tē kētij qyteti, thuhet se nē
Mitrovicē,3 deri nē kohēn e komunizmitnuk kishte ekzistuar ndonjē
objekt iposagēm i ndērtuarper nevojat e izolimitpērkatēsisht sē
dēnimeve. Per kēto nevoja janē shfrytezuar objekte tē cilāt
janē llogaritur sekanē njē siguriper mos ikjen e tē burgosurve, ēshtē
e ashtuquajtura “Kulla e Tupellēs”.
Dihet se objekti i parē, per nevoja tē burgut, ēshtē ndērtuar nē
vitin 1965/1966. Objektin e kishte ndērtuar Sekretariāti i Punēve tē
Brendshme i Mitrovicēs, nē krye tē tē cilit qendronte njeriu mēfamekeq i
asaj kohe, Jovo Bajat.4
Ndērtesa e burgut gjendet nē vēri tē qytetit dhe e ka formēn e njē
harku. Ajo ēshtē dykateshe, pa i llogaritur dhomat tē cilāt po
ashtu janē pērdorur per mbajtjen, pērkatēsisht pēr ruajtjen e tē burgo-
surve.
Nē tē gjitha kohērat, burgjetpothuajse kanē qenē dhe ishin drejl-
pērsēdrejti tē sunduara dhe tē kontrolluara nga organet e ruajtjes sē
rendit - xhandarmerise ose policisē sē pushtetit.
Nē kohēn e komunizmit, tē gjitha pērfshirē
kētu edhe ato tē Kosovēs, kanē qenē tē udhehequra nga Sekretariāti i

Burgu і Mitrovicès, per qèndrimin e tě burgosurve per nj è kohe tě
gjatě, nuk i plotěsonte as kushtet minimale się ishin kushtet higjieno-
teknike. E njej ta gjè ishte edhe me ndèrtimin e objektit tè ri. Ně dhomat qè
is hin tě dedikuara per dy, eventualisht per katěr persona, aty kaně
qěndruar edhe deri ně dhjetě tě burgosur. Ishin tě pajisura me dritare
shumě tě vogla dhe tě m by Hura me rijeta tè dendura tè njè teli tě tras he qè
nuk mund tè depèrtonte as lapsi, keshtu qè pengohej edhe hyrja e dritès
per ajrosjen e dhomave. Dhomat ishin tě errèta, ndrięimi i tyre běhej
pennes poçave elektrike dhe tè rrymès prej 24 voltèsh.
Burgjet e Kosověs, nga Sekretariati i Puněve tě Brendshme, per-
katěsisht nga Shěrbimi i Sigurimit Shteteror (UDB-a), u pavarěsnan ně
vitin 19761 Asokohe uformua Sekretariati Krahinor i Judikatur es, ku
běnin pjese institucionet e gjyqeve dhe institucionet e tjera per vuajtjen e
děnimeve.
Burgj et dhe gjyqet, kaně punuar sipas Ligjit mbi Ekzekutimin e
Sanksioneve Penale tě Republikěs Socialiste tě Serbisě, shpallur ně
“Gazeten zyrtare tè RSS” nr. 26, dt. 30 qershor 1977. Ně mběshtetje tě
nénit 301, tě Kushtetutes se RSS-sě l y ligj ěshtě aplikuar ně menyre
5 OZN-a - UDB-a ֊ SHSSH. Detyra e kétyre organeve ka qeně ta mbrojě dhe ta
maje shtetin, qeverině, partine dhe udhěheqesit e tyre nga armiqte e brendshěm dhe
té jashtěm. OZN-a ka filluar tě funksionoje nga 13 maji 1944. UDB-a Drejtorati
per Sigurimin Shteteror, ka filluar tě funksionoje nga viti 1946 kur ka filluar tě
veprojě edhe KOS (Shěrbimi i sigurmit ushtarak), kurse nga viti 1966 ka
funksionuar Shěrbimi i Sigurimit Shteteror.

1918-1956” tě autore ve F. Buçinca dhe Ferid В. Dibrani, faqe 142 etj.

unike, në territorin e Republikës Socialiste të Serbisë dhe në territorin e
KSA të Vojvodinës e KSA të Kosovës. Mirëpo, me nenin të po atij
Ligji, sekretari republikan ijudikaturës, krahinori
judikaturës i Krahinës Autonome të Kosovës, ishte i autorizuar të nxirrte
dispozita më të hollësishme:
1. Për Shërbimin e Sigurimit ֊ mbi mënyrën e kryerjes së shërbi-
mit mbi armatimin dhe pajisjen, përgatitjën dhe provimin profesional,
pastaj letërnjoftimin zyrtar etj.
2. Për llojet e evidences dhe mënyrën e mbajtjes së evidences së
personave të dënuar dhe të paraburgosur.
3. Për uniformen dhe shenjat e punëtorëve të Shërbimit të Sigu-
rimit.
4. Për ruajtjen e sekretit zyrtar dhe atij shtetëror.
5. Për mënyrën e vuajtjes së dënimit me burg.
6. Për tabelen e ushqimit për personal e dënuar dhe atyre të
mitur.
7. Për llojin e ndërresave, veshmbathjes që bartin personat e
burgosur gjatë vuajtjes së dënimit.
8. Për mënyrën dhe kushtet e ekzekutimit të dënimeve disiplinore,
të qëndrimit në vetrni deri në 30 ditë.
9. Për mënyrën e ekzekutimit të masës së izolimit në institucion.
10. Për mënyrën dhe kushtet e përdorimit të mjeteve të shtrëngi-
mit dhe
11. Për procedurën e ekzekutimit të dënimit me vdekje.
Po ashtu, ishte autorizuar edhe organi më i lartë i shëndetësisë e
i arsimit në Republikën e Serbisë, por edhe ai i krahinave autonome që të
nxjerrin aktet e veta për gështjet shëndetësore, respektivisht të arsimimit
dhe të riedukimit të të dënuarve dhe të atyre të mitur.
Në prill të vitit 1980, drejtor i Burgut të Qarkut të u
emërua Fahri Buginca, drejtor ishte Shefkija (Shefko) Adiloviq, ndërsa
para tij ka qenë Sherafedin (Shero) Ajeti. Nga 1 janari 1981, për afro dy
vite punoi edhe Sokol Dauti. Në Prishtinë, detyrën e drejtorit e kryente
Raif Gashi, kurse nga prilli 1982 erdhi Ismajl Ariji. Në Gjilan - Zharko
Andriq, në Prizen Mefail Ajazaj dhe në Pejë - Fuad Kryeziu dhe më vonë
Shyqri Syka dhe Adem Gorani.
Në kuadër të burgut të Qarkut të Prishtinës, ndodhej edhe një
paralele e karakterit të mbyllur në Ferizaj, ashtu e kishte edhe Burgu i
Qarkut të Pejës, paralelen e ndarë në Gjurakoc. Burgu i Qarkut i Mitro-
vicës, e kishte paralelen gjysmë të hapur në Smrekonicë, e cila ishte

formuar me Vendimin e Kuvendit té Krahinés Socialiste Autonómé te
Kosovés, nr. 3/78.
Kjo paralele e ndaré,füloité punonte aty kah mesi i verés se vitit
1978, mirépo Sekretariati Krahinor i Judikaturés, pérmes Kuvendit té
KSA té Kosovés,8 mé 27 tetor 1980, k
e mévetésoi né institúción tépavarur pér vuajtjen e dénimeve té shkurtra
me burgim né Smrekonicé. Drejtor i kétij institucionit té ri, pérséri u
emérua Fahri Buqinca.
Né kété Institúción, sipas pikés IV té vendimit pér formim, ishte
paraparé qé té vuanin dénimet per sonat e dénuar (meshkujt), té dlet i
dérgonte organi kompetent nga territori i KSA té Kosovés, te té cilét
kohézgjatja osepjesa e mbetur e dénimit té tyre, sillej nga 2 muaj deri né
njé vit, si dhe personat qé ishin té dénuar me burgim pa marré parasysh
gjatésiné e dénimit, ndaj té ciléve nuk kishte nevojé té aplikohen masa té
veqanta. Ky institúción ka filluar punén me 1 janar té vitit 1981.
Né pérbérje té kétij institúcióm, bénte pjesé edhe njésia ekono-
mike “Zveqan ”, e cila ishte formuar pér risocializimin dhe riedukimin e
personave té dénuar. Sekretariati i Judikaturés, pérmes vendimit té
Kuvendit téKSA té Kosovés, kété institúción néprill té vitit 1982, e ngriti
duke e transformuar né Shtépi Ndéshkuese Korrektuese. Me kété vendim,
dénimin e vuanin personat e dénuar me nga 6 muaj deri né njé vit.
Transformimi i kétij institúcióm, né aspektin e vuajtjes se dénimeve,
éshté béré edhe né vitin 1987. Né bazé té nénit 6 té kétij vendimi, pérveg
té dénuarve té tjeré, dénimin e vuanin edhe té gjithé personat e dénuar
pér kundérvajtje.
Pa marré parasysh vendimet e Kuvendit té KSA té Kosovés,
lirisht mund té thuhet se pér shkaqeté trazirave politike qé shpérthyen né
Kosove, nga viti 1981 e deri né vitin 1989, respektivisht deri mé 1 korrik
té vitit 1990, kur autori i kétij libri u pensionua. Né Smrekonicé, dénimet i
kané vuajtur personat e té gjitha kategorive, duke filluar nga
vajtésit, té dénuarit me dénime té shkurtra, ata me dénime té gjata deri né
20 vjet si dhe té burgosurit pér qéshtje politike.
Pérmes kétyre kujtimeve, té cilat kané mbéshtetje né 15 fietoret
(1980-1990), éshté béré pérpjekje qé té pasqyrohet gjendja faktike e
situatés politike té asaj kohe - qéndrimi i personave té dénuar, puna,
angazhimi dhe sjellja e punetoréve té shérbimeve té sigurimit, atij té
riedukimit, por edhe té shérbimeve té tjera qé ekzistonin né Smrekonicé.
Me kété rast, déshiroj ta falénderoj sekretarin e Sekretariatu
Krahinor té Judikaturés, Nazmi Juniku, si nismétar, kryetarin e LKK

INSTEAD OF PREFACE
In every society there are various indicators that show the degree
of its development and democratization. Economic, political and social
indicators of a country are very important, but not less important are indi-
cators relating to the care level a society shows toward the specific groups
of people, its weakest groups. Here are included persons who, for one or
another reason, enter into relations with authorities of the criminal justice
system, as victims, witnesses or perpetrators of criminal acts. Clarifica-
tion of any circumstances of their lives, even while serving their sen-
tence, contributes to the affluence of their experiences and the work of the
society in carrying out the tasks at execution institutions of penal sanc-
tions. One of the segments of Kosovo society, under the conditions and
circumstances of Serbia and Yugoslav Federation, were the prisons of
that period. Prisons have existed and exist nowadays throughout the
world, but they differ from country to country, as they have their own par-
ticulars with respect to management and other areas. I administered
Smrekovnica Prison under extremely complex political conditions and,
by browsing the data collected from many books and my own notes; I de-
cided to put down my impressions and memories as director of the Prison.
This book is the first of its kind in Kosovo. So far, I have not had a
chance to read that any director of a prison has written about his/her ad-
ministration and experience as administrator of a prison.
This book covers the ten year period (1980-1990) that was one of
the worst and gravest periods for Albanian people Kosovo. At this time
many political events took place, which destabilized the social order, not
only in Kosovo but in all republics of Yugoslavia.
Some of these events will suffice to illustrate these events:
- Demonstrations of students and of Albanian citizens in 1981;
- The violence and murders committed against Albanian soldiers
in the Yugoslav Army. At this time over 50 Albanian soldiers were killed
(only from Vuçitëm area six of them were killed).
- Segregation of relevant Serbian political authorities, at both mu-
nicipal and central level of Kosovo, against Albanian students (the case
of Primary School in Priluzje, Municipality of Vucitëm, the case of
“Dardania” Primary School in Prishtina, and in other schools of Kosovo).

- Colonization of Kosovo with colonists from Croatia and other
areas of Yugoslavia and construction of homes for them;
- Forcible incursion of the Special Unit of the United Yugoslav
Police in Kosovo, and the violence committed against Albanian citizens;
- Miners’ protest at “Trepça” Floatation in Stari Tërg;
- Daily plunders committed by paramilitaries and the Serbian po-
lice against Albanian population;
- Appearance on the political scene of Slobodan Milosevic and or-
ganization of various daily political rallies by him;
- Isolation of 250 intellectuals in the prisons of the Republic of
Serbia;
- Forceful change of 1974 Kosovo Constitution and abolition of
the Autonomous Province of Kosovo by the Republic of Serbia;
- Miners’ strike at “Trepça” Floatation in Stari Tërg and other
mines of Kosovo;
- Drenica was often found under curfew;
- In most cases activities and the movement of Albanians were
banned until the time when the wore broke in 1999.
- Albanian people fell into a deep economic crisis, but together
with it fell the whole Yugoslav economy, which after 1990 the whole Yu-
goslav economy was hit with an economic crisis, which was one of the
worst ones in its history, etc.
All of these events affected directly or indirectly employees and
prisoners of Smrekovnica PCF (Punitive Correctional Facility).
These events increased for several times the number of persons
convicted for political reasons. There were many cases when the prison-
ers, who were brought at Smrekovnica PCF, were relatives of employees
of this institution.
The book has 30 chapters with approximately 100 titles and subti-
tles, which here and there overlap tightly with one another, but in most
cases, they constitute separate units, which reflect the work of these penal
execution institutions, where I have worked and acted.
In this monographic book I have tried to present my position on
particular circumstances toward prisoners, institution employees, and in
general on the daily politics of that time.
This book has been written based on the existing documentation
and on personal records kept in 15 notebooks for the Mitrovica Prison
and Smrekovnica PCF.
I have made efforts to present some crucial moments dealing with
my job as director and manager, initially at the District Court Prison in
Mitrovica and at Smrekovnica PCF.
Initially I have explained how I was appointed Director of the
District Prison in Mitrovica, and immediately afterwards, namely two

days after the notification of my appointment, social and political author-
ities of Vuçitcrn Municipality demanded my discharge.
I continued writing the story about the state and the problems I en-
countered at Mitrovica Prison and at Smrekovnica PCF.
It was not hard to intervene in all problems that required organiza-
tion of labour and financial supplies. Naturally, I had huge problems re-
garding the attitudes and the mentality of certain individuals and the
antagonisms that existed among employee services, in particular among
Security Service guards. With respect to prisoners, the question was
whether the club (the rubber baton) was more advantageous than a kind
word (behaviour)?
I have always had an aversion when I heard the word “prison”.
For years these prisons were known to be bad, especially at the time of
Former Yugoslavia, and during the communist era. The prison had been
and was imagined as a temple that was untouchable and unchangeable. I
was grown up with these beliefs and attitudes, and with a behaviour and
mentality which I had learned from the sufferings of my family members
and relatives.
My goal was clear: I wanted to humanize this Institution as much
as possible. A lot of work was required here. It was necessary to make
changes, first to changes my own belief and then the beliefs of other em-
ployees, in particular of some security guards, who were accustomed
from the past that “God is the rubber baton” in the prison. Consequently,
the reader will find out whether I had managed to rehabilitate this institu-
tion or not.
In this book the reader will become acquainted with vicissitudes
which I, as director of the PCF at Smrekovnica, had with the superiors of
the Special Unit of the United Yugoslav Police.
The Provincial Jurisprudence Service and its institutions had
nothing in common with the Internal Affairs Secretariat of Kosovo, espe-
cially with the State Security Service (previously known with the name
UDB). The reader will also learn in this book about the disagreements
and contradictions which existed between these two services, namely
these secretariats;
The reader will also read about the disorders of Smrekovnica in-
stitution capacity, the approval of parole conditions and the remission of
a sentence, as well as the removal of prisoners from this institution.
In the book I have indirectly given an overview about the aggra-
vated political situation at Vuçitëm Municipality between Serbs and Al-
banians. These tensions were caused by Serbs themselves. Deterioration
of relations between the nationalities within Smrekovnica institution has
also been discussed. The general demonstrations of the Albanian popula-
tion have also been mentioned, as well as the miners’ protest - strikes of

Trep^a, and about the fact that under these extraordinary political conditi-
ons the prisoners donated blood.
Also, in this book I have tried to reflect what jobs were performed
by convicts at the business unit, which existed within Smrekovnica insti-
tution, as well as outside the institution, and how the earned funds were
use to improve the living conditions of prisoners in this institution.
A special role in the socialization of inmates has played the cor-
rectional service in Smrekovnica institution. This service had professors,
psychologists, sociologists, teachers, etc.; who were focused on applying
advanced methods of work, for the purpose of education and rehabilitati-
on of convicts.
Rehabilitation of prisoners at Smrekovnica was also done through
their involvement in socially useful work, either in the existing work-
shops of Smrekovnica institution, or at the “Vicianum” motel of Vu^i-
tern, in the restaurant, and other construction work.
The reader in this book will also find information about the com-
mitments of convicts in leisure activities, whether in sports, in the library,
or in the Cultural-Artistic Association “Qendresa” (Resistance).
Further on in the book, the reader will be able to infer whether the
Director of Smrekovnica PCF in Smrekovnica had or had not a correct
and honest attitude toward the employees, the prisoners and their family
relatives, because the phenomena, such as: bribery, revenge and other
negatives acts were unknown to the Director.
The reader will also find out who demanded my discharge from
the position of director, because of the participation of my daughter,
Xheraldina, in 1981 demonstrations. Who demanded differentiation from
my spouse, because at the Vuyitern Municipality she defended student
demonstrations, or who demanded that the Kosovo Judicial Secretariat
authorities differentiate from me, even after my retirement; who hired me
illegally to work on behalf of Albanian workers and prisoners that were
serving their sentences in Kosovo prisons?
In the end the reader, besides the other materials, will leam how
28 out of 30 Albanian employees of the Provincial Judicial Secretariat of
Kosovo were fired from their work.
The reader can also find statistical data on the Smrekovnica PCF
and of other execution institutions in Kosovo.
The book has been illustrated with about 80 black and white pho-
tographs, and with more than 150 colour photographs attached at the end
of the book.
