Summary
Deformation of Democracy? Opposition Agreement and Czech
Politics in 1998-2002
The term Opposition Agreement is used in Czech public debate as something
repulsive, immoral, or as a threat to democracy. This agreement between two big
formations, Czech Social Democratic Party (CSSD) and Civic Democratic Party
(ODS), made after the 1998 elections represents the most controversial political
agreement in the history of the Czech Republic. The Opposition Agreement
enabled the CSSD to govern. The ODS received certain positions in the parliament
and elsewhere, and also a promise of big reforms of the political system, including
an electoral reform. A specific bond was formed between both parties, which was not
a government coalition. Small political parties, Christian and Democratic Union -
Czechoslovak Peoples Party (KDU-CSL) and the Freedom Union (US) which had
seceded from the ODS, found themselves in opposition (alongside the politically
isolated Communists). Despite the crisis at the end of 1999, the Opposition Agreement
survived the whole four-year term.
This book tries to present an unbiased view of the Opposition Agreement. Let us
sum up the most important political factors and moments that had contributed to
the agreement. First, there were important internal disputes in the previous coalition
government under Vaclav Klaus which, after a long agony, had led to its break-up at
the end of 1997 and to strong antagonism between the ODS and the KDU-CSL.
Second, the ill-conceived plan by two ODS politicians, Jan Ruml and Ivan Pilip,
who called on the party’s founder Vaclav Klaus to resign from his position of party
chairman while he was abroad, also played its role at that time. It contributed to
a conspiracy theory which gave Vaclav Klaus the opportunity to survive his political
death. In the emotional atmosphere, this plan played into Klaus’ hands, and the
anti-Klaus wing lost their battle for ODS leadership. Third, the following retreat of
the ODS to a mental £ bunker under siege” is also significant. This “bunker” was
formed in the conditions of a crisis of the ODS, and shaped by a sense of threat and at
the same time strong aversion to the KDU-CSL, Ruml’s Freedom Union, but also
to many journalists and influential intellectuals. This supported the willingness of
the ODS after the 1998 elections to come to an agreement with the CSSD. Fourth, it
turned out that the Freedom Union was not able to play the role of a new strong right-
wing force. It was unclear right from its foundation what it would actually represent
in political terms. Fifth, there was significant tension between the president Vaclav
Havel and the ODS. Klaus and the ODS, often clashing with the president in the
past, viewed Havels activities and attitudes around 1997 and 1998 very negatively.

In their eyes, the president was one of the initiators of the fall of Klaus’ government
and an ally of the Freedom Union and the KDU-CSL. There was also a tension
between Havel and the chairman of the CSSD, Milos Zeman. Among other things,
this contributed to the efforts to limit the president s constitutional powers at the time
of the Opposition Agreement. Last but not least, the results of parties in the 1998
elections were of course also important.
The mistakes made by politicians from the Freedom Union and the KDU-CSL in
negotiations after the 1998 elections also contributed to the Opposition Agreement.
The Freedom Union had no consistent strategy, and was quite disunited in political
terms. The KDU-CSL was too much focused on a single option assuming a government
alliance of the CSSD and the Freedom Union, and moreover they overestimated their
indispensability for the government. Some of the KDU-CSL and Freedom Union
politicians also relied too much on the presidents support.
The Opposition Agreement was not a good political solution, but at the time of
its origin after the 1998 elections it was a more rational solution than forming one
of two possible majority coalition governments (i.e. CSSD, KDU-CSL and Freedom
Union, or ODS, KDU-CSL and Freedom Union). These majority governments would
inevitably be considerably affected by strong ideological and personal aversions. Even
if a majority solution had formed despite mutual barriers between the parties, it would
have been unstable and of limited duration.
The strength of political barriers preventing a majority coalition government was
confirmed in the first year of the Opposition Agreement. At the same time, it also
turned out to be very difficult to govern without secured majority (the agreement
between the CSSD and the ODS did not involve parliamentary cooperation of
the parties). This resulted in extending the pact between the CSSD and the ODS in
a new agreement in January 2000. Until the new agreement, the political arrangement
of the Opposition Agreement could be characterised as a minority government
with protection against a vote of no confidence, while after the new agreement it
was expanded with external support for the government, with crucial help from
the ODS in approving state budgets. In return for their tolerance, or starting in 2000
for their cooperation in certain parliamentary votes, the ODS received certain positions
and policy concessions. However, the relatively big ideological difference between
the CSSD and the ODS caused that when pushing through parts of its agenda in
the parliament, Zemans government was looking for (and often found) support also
from other parties than the ODS.
The decision of both main “fathers” of the agreement, Zeman and Klaus, and
their parties was undoubtedly calculated and motivated by power. But this decision
is not inconsistent with the nature of democratic politics which is sometimes based
on such unholy alliances. The book shows in a comparative perspective how different

the agreements of minority governments with opposition can be: from Denmark
with mainly one-time agreements between the government and a supporting party or
parties, to New Zealand or Sweden with sometimes very elaborate agreements which
can include even certain participation of the supporting parties in the government.
The idea of extensive constitutional reforms advocated mainly by the ODS
was however not realized in 1998-2002. This was largely thanks to the successful
mobilisation of an alliance of smaller parties against the agreement which gradually
totally changed the distribution of power in the Upper Chamber of the Parliament
where changes to the Constitution also had to be approved. A considerable role was also
played by Vaclav Havel, presenting himself as a resolute opponent of the Opposition
Agreement, and also by the Constitutional Court which in its key decisions sided with
the president. Nevertheless, the debate about the need of a radical electoral reform or
limiting and clarifying the presidential powers is constantly returning in the Czech
Republic until today.
The big problem of the ODS was that it persistently continued to cling to
the agreement even after it lost much of its purpose, i.e. after the idea of political
reforms had failed. Moreover, the CSSD was willing to fulfil further promises of
economic and social policies only to a limited extent. An important reason why
the ODS clung to the agreement was that they had become accustomed to its benefits,
especially in the form of various posts held, not only in political but also in economic
sphere controlled by the state (positions in state agencies, state enterprises, etc,). Klaus’
party suffered the consequences of its position, which had been viewed by voters as
semi-governmental, by its poor election results in 2002.
