English summary
Introduction
The introductory chapter deals with the definition of the politi-
cal trials in Czechoslovakia, which are frequently referred to as show
trials in English speaking countries. It gives also the overview of the
literature concerning the theme and concludes that the political trials
should be treated in its historical context, using analyses of their legal,
political but also propaganda aspects. The whole book was prepared
to show especially in case of criminal law of the socialist period the
need to analyse not only the law in books but also law in action and
to deal also with the question of punishment, rehabilitation and other
forms of remedies.
Chapter I
The chapter deals with the personality and particularly with the
criminal trial of Czechoslovak journalist and politician Jiff Stribrny.
The first part is focused on a brief description of his life, both perso-
nal and public. The next parts deal with the prosecution and crimi-
nal offences, Stribrny was accused of. In the subsequent sub-chapters
authors analyses the particular part of accusations and of the acquittal
part judgment. The key problem was Jin Stribrny s attitude to the
fascism, to the Jewish question and to his impact on the education of
youth. The Jifi Stribrny s attitude to Edvard Benes is also mentioned.
The verdict is thus confronted with actual facts and are given into the
historical context. Then the circumstances connected with pronoun-
cement of the judgment are mentioned and the last part is focused
on the final consideration of a whole issue from the point of view of
political reasons for Stribrny s sentence.
Chapter II
Every political regime has a tendency to create its own rules to suite
new political or economic conditions, philosophy and situation wi-
thin the society. It was not different with the emerging socialist system
in the Soviet block. The third chapter therefore deals with legal bac-
kground for the political trials in Czechoslovakia in 1950th. On 6th
October 1948 a new Act on the Protection of the People s Democratic
Republic was enacted to fortify the new regime through the poten-
tial of criminal law. Although most of the crimes contained in the

Act were already punishable under the laws from the interwar period,
a more severe punishment was introduced for political, military and
economic crimes, in particular for high treason, terrorism, conspira-
cy, spying, incitement against the Republic, or sabotage, and certain
other crimes, like propagation of Nazi ideology and misuse of reli-
gious functions. Crimes were defined broadly and loosely to enable
courts to take arbitrary decisions in the first instance of political trials.
The Act on the Protection of the People s Democratic Republic was
accompanied by the Act on the State Court. The State Court toge-
ther with state prosecutors and state security formed the major insti-
tutional bases for political trials, described in more details in other
chapters.
The new Criminal Code and the Code on Criminal Procedure were
enacted in 1950 as part of the two-year legal plan. Criminal law ena-
bled harsh punishment of real or potential opponents of the com-
munist regime and, sometimes, simply people of different religious
beliefs or political views, and also those coming from a “wrong” class
or being of a “wrong” social origin. The aim was not only punish
individuals but also to deter and discipline the rest of the society. The
chapter III analyses mainly those paragraphs which were used most
during political trials and touches also upon the role of new judiciary.
Chapter III
This chapter deals with the origin and follow-up development of
prosecution as key authority of criminal proceedings in relation to po-
litical trials in Czechoslovakia in 1950th. Origin of prosecution begun
already in the late 1940th, when 1949 minister of justice Dr. Alexej
Cepicka pushed through that the prosecutor had the same powers as
the “procurators” in the Soviet system. The guilt and punishment for
perpetuators of crimes against the state and new regime were actually
decided in most cases before the hearings took place and so called
state procurators took an active in this process. Essential influence
on the decision making of courts was exercised by Minister of justi-
ce, control of judicial authorities was removed from the investigators
and institute of prosecution gained even more power to oversee the
observance of all stages during the criminal proceedings. The above
mentioned process caused intentional violation of basic human rights
and freedoms and also violation of basic rules of criminal proceedings,
primarily rule of investigation of objective truth and presumption of

innocence. Position of prosecution was then strengthened by new
constitutional law No. 64/1952 Sb. and law No. 65/1952. Sb. They
finally rebuilt the prosecution in accordance with the Soviet model
with general prosecutor in its head. The prosecution became mono-
cratic authority which interfered to every key areas of state adminis-
tration and both criminal and civic proceedings. Prosecutor entered
criminal proceedings as representative of the state and “guardian of
law and order”. His main task was to “ensure, enforce and strengthen
socialistic legality, social order and political system against its oppo-
nents”. The chapter also deals with some aspects of prosecutor s role
in criminal proceedings. The chapter also shows the prosecutor as in-
strument of communist party to enforce its interests in poli tical trials.
Chapter IV
The chapter deals with the example of the above mentioned law in
action concerning the prosecution of those people, who took active
part in protest against the monetary reform in Pilsen 1953. The mo-
netary reform was regarded by the majority of society in communist
Czechoslovakia as the anti-social and repressive step taken secretly and
to certain degree surprisingly by the Communist régime. The reform
had very adversary effects on the economic situation of ordinary peo-
ple and in some places people openly protested against the reform and
against the regime. The most important protests took part in Pilsen
and also workers form Skoda works took part. The protests turn to be
an open demonstration not only against the reform, but also against
the Communist regime. It was so dangerous to the Communist party,
that it immediately ordered not only police to stop the protests but
also investigations into the preparations of the protests. The chapter
deals with the individual cases (Necas and others or Melka and others)
and deals also with their fate after the sentence. At the end the chapter
also shows that the regime used not only the instrument of political
trials but also extra-judicial persecutions.
Chapter V and VI
Both chapters deal with the forms of persecution of the so called ku-
laks (expression used to identify class enemies in the countryside) or
big and medium-sized landowners in four distinctive areas of Czech
and Moravian countryside. First the Bohemian regions of Chrudim
a Hlinsko are addressed, than Melnik and Olomouc. At first the who-

le process of political trials with kulak s is addressed from the point
of view of the so called forced collectivization. In the autumn of 1948
the Communist Party leadership re-thought its original concept of
agricultural policy and launched a strategy of socialization of villages
to be built upon people s cooperative farms and large scale agricultural
production based on the Soviet model. Beginning in 1949 Uniform
Agricultural Cooperatives, as a new legal entity, were promoted in
conjunction with the state owned farms and special tractor and farm
machinery stations (abolished in i960), following again the Soviet
example. The legal basis for cooperatives was enacted in February
1949. Usually those farmers who opposed the joining of cooperative
were subject of first round of political trials. In February 1951 an even
harder line was introduced, and those who refused to join cooperati-
ves were subject to larger obligatory quotas of production to be delive-
red to the state; in most cases administrative and penal punishments
and persecution of various kinds were imposed. Deportations, fines
and criminal prosecution were applied if contractual duties to deliver
higher and higher quotas of agricultural products were not fulfilled.
Repeated failure was often followed by political trials, as the kulaks
were sometimes accused of sabotage or even high treason. They were
usually sentenced to a long term in prison, including confiscation of
their property and a prohibition from staying (together with all their
family) in the region where their farms were located.
This “action K” (Action Kulak), based on the instructions issued
by the Ministry of the Interior, Ministry of National Security and
the Ministry of Justice, was directed against wealthy farmers as class
enemies, deprived them of various human and civic rights, subjected
their property to confiscation, forced them to leave their regions, and
their children were not allowed to study at secondary schools and
universities. This policy is shown on individual examples.
Next chapter deals with the same policy in the area of Melnik and
Olomouc. It concentrates on a comparison of mechanisms targeted
liquidation of the kulaks in the area of Melnik and Olomouc and
proves that the same policy was for several political but also economic
reasons pursued differently.
Chapter VII
The chapter deals with the historical and legal research into the
activities of the district public prosecutor of the District Public Pro-

secutor s office in Humpoiec at the time of its existence from 1949 to
i960. The town of Humpoiec, with a population of approximately
eleven thousand, lies in the Bohemian-Moravian Highlands. Under
the present administrative division it is included in the District of Pel-
hrimov. At the examined time it was an independent district lying in
the Region of Jihlava. After touching on the historical development of
the profession of prosecutor, the chapter focuses, by means of archival
research, on finding the practical application of the valid law of the
selected area by the public prosecutor representing the state.
The chapter generally deals with the rather negative activities of the
public prosecutor towards the accused in criminal proceedings in the
historical context of the examined period of 1950th. The character of
prosecuted crimes was closely related to the geographical location of
the former country district. The transformation of agricultural farms
into cooperatives, promoted and enforced by the state and Commu-
nist Party of Czechoslovakia (KSC), appeared most markedly in the
public prosecutor s work. The consistent enforcement of delivery
duty of reach farmers and corresponding elements of crimes of that
time in case of failure to perform the duty became the core occupati-
on of the Humpoiec public prosecutor. His approach to sanctioning
people connected with the previous industrial business and prosecu-
tion of any disagreement with the communist regime was not conci-
liatory, either.
Chapter VIII
The chapter is concerned with the trial that was held in 1950th,
which according to its character it can be described as the show (or
political) trial. It deals with the case ofMUDr. Jan Hlach and his wife
JUDr. Olga Hlach. Jan and Olga Hlachs participated in the escape of
the former Member of Czechoslovak Parliament Dr. Frantisek Uh-
lir, who was taken into custody in Pisek after his first unsuccessful
attempt to escape the country. Because of poor health Frantisek Uhlif
was sent from the custody into the hospital where Jan Hlach worked
as a doctor. Olga Hlach met Uhlif there a few times as investigating
judge. After Uhlif s second successful attempt to leave the country
Mr. and Mrs. Hlach as well as the other participants of the esca-
pe were arrested, interrogated and consequently sentenced to strict
punishments.

The trial with these people which helped Uhlif to cross the borders
reflects some principles of judiciary system of that era. In this trial one
can notice class attitude to law and the defendants are judged not only
according to their acts but also with regard to their origins.
The main point of this chapter is to give a comprehensive descrip-
tion of the trial and put it in the historical context.
Chapter IX
The process with “Milada Horakova and others” is the most famous
show trial of the 1950th in Czechoslovakia regarding the non-commu-
nist victims of the trials. The chapter deals with the fate of another
woman politician, who was sentenced in in this trial - Frantiska Ze-
minova. She was one of three female on the show trial, who was actu-
ally sentenced by the court. How she lived, should we know her and
if so, then why? What about the process, what were the sentence and
the punishment? These are the questions which the chapter is trying
to answer. The chapter deals at first with the life story of Frantiska
Zeminova to give the whole picture of destiny of the longest sitting
female member of the Czechoslovak Parliament. She was a supporter
of feminist ideas and member of national socialist party. The chapter
uses archival materials including private documents and interviews
as well as the files of secret police with unique testimony sheets. The
second part of the chapter deals with the trial itself. It shows, that
Frantiska Zeminova was self-sacrificing, fighting and decisive woman.
She took her destiny as it came, with life wisdom of her own. As de-
termined fighter, she tried to fight against the totalitarian regime until
the last moment.
Chapter X
The chapter deals with the case of Karel Pecka, well known Czech
writer. As a student he became one of the first victims of political
persecution of communist regime after February 1948 coup d etat.
Pecka took an active part in the activities of opposition group named
Za pravdu — For the Truth, according to underground bulletin they
published. The activities were followed by secret police and the mem-
bers of the group arrested. The study deals in detail with the stages
of the trial (ended with sentences of 11 and 12 years of imprisonment)
including the description of serving sentence in prison as well as long
and problematic procedure of rehabilitation from 1960th to 1990th.

Chapter XI
This chapter deals with another regional example of specific show
trial connected with already mentioned personality of Dagmar Sim-
kova. Dagmar Simkova, a young girl from Pisek in South Bohemia,
was tried by the communist justice also in connection with the case
of young men, who deserted the Czechoslovak army. Czechoslovak
army was at the beginning of 1950th known for harsch treatment of
recruits and political brainwashing and therefor was high proportion
of dezertions usually leading to escapes from the country. Those, who
were captured were sentenced for strict punishments including the
people who helped them. The political trial was officially called the
trial „with Jaroslav Sip and others“ and took place in 1952-1954. Ho-
wever, it is important to analyse it within the context of the investi-
gation of the so called „Deserters“ case held by State s security from
September 1952. There were several political trials, one independent
to others, organised within this investigation. The link between these
trials were two deserters - Ladislav Fiala and Jaroslav Danhel — who
deserted from the pre-trial detention of military prosecutor in Ostra-
va in summer 1952. The Chapter deals mainly with Dagmar Simkova
and her role in the case and shows all stages of the trial from investi-
gations, arrest and preparations of the trial through its hearings until
the sentence in 1954. The Chapter also deals with her imprisonment
and afterwards with her amnesty in 1965 and finally the rehabilitation
in 1990 and 1993.
Chapter XII
The chapter deals with the several legal and political aspects of
amnesty (or general pardon) in relation to the political trials in Cze-
choslovakia. At first the historical roots of the law concerning amnesty
is analysed including its development after 1948 both in Constitution
of May 9, 1948 and Criminal procedure law of 1950 as amended in
1956. In the second half of the chapter the cases of amnesties of 1953,
1955 and 1957 are addressed. From these amnesties most of the victims
of political trials (as well as those sentenced during the retribution
trials after WWII.) were excluded but some parts of the amnesties
reduced the sentences or abolished part of them. The i960 amnesty
connected with the enactment of Socialist Constitution and to cele-
brate the anniversary of end of WWII. was different, as it was intenti-
onally used to solve some injustices connected with the political trials

or may be better to say to serve as a corrective to the Criminal law.
The amnesty according to the Czechoslovak law is connected with
the prerogatives of the President of the Republic (but in fact prepared
in details by the Ministry of Justice) and deals with certain types of
punishments in general. There were also different consequences of
individual parts of the amnesty decision of the President. Most im-
portant are cancellation of punishment and abolition of the sentence.
The chapter shows that the 1960 amnesty was closely connected with
the gradual changes in the political system of communist Czecho-
slovakia and although the amnesty did not fulfd all the expectations
of the victims of political trials it was accepted by the general public
favourably.
Chapter XIII
In this chapter entitled “redress of grievances caused by the political
processes in the 50th years — judicial restitution“ we tried to, as it
implies from the name of the paper, focused on judicial restitution
of illegally convicted persons in the political process during the 50th
years. The first part of this chapter is devoted to the concept of resti-
tution in general and the development of various kinds of restitution
in Czech law. Subsequently, the attention of author is focused on ju-
dicial restitution after the World War II and the restitution committe-
es. The main part of this chapter is devoted to the period 1967-1969
when came into existence and has been working so-called Piller s co-
mmittee and was adopted and applied in the practice judicial restitu-
tions act, which is analysed in detail, and then devoted to the period
immediately after the year 1989, when was adopted the other judicial
restitution act, which is analysed in details too. After that there is an
explanation dedicated to the comparison of these two acts, including
their criticisms, application in practise and results. This paper is logi-
cally ended by conclusion, in which we tried to find the answers on
the questions posed in the introduction, i.e. if the judicial restitutions
followed the interest of illegally convicted persons and whether they
have achieved their purpose, as was outlined in these two acts.
