THE L O N G - S TA TsT E I N G TRADITION OF allowing defendants to make a statement on their o-wn behalf at sentencing has been understood as providing them with an opportunity to demonstrate remorse, which could have an effect on the sentence that is imposed. In w Sorry Jo r TVfrtzf / w JZ^onrJ JVI. Catherine Gruber examines 52 apologetic allocutions produced during federal sentencing hearings. In these allocutions, defendants raise tire topics of tire offense, mitigation, future behaviour, and tire sentence using varying communicative strategies. Though there
is no way to ascertain exactly how effective--or
ineffective--a given allocution is, Gruber assesses
tire pros and cons associated with these strategies. Sire uses case law, sociolinguistic and historical resources, and judges’ final remarks to develop her own theories on defendants’ communicative goals as well as what might constitute an ideal allocution from a judge’s point of view.
Unlike official transcripts, tire transcripts Gruber uses for this study include paralinguistic features such as hesitations, wavering voice, and crying-while-talking, allowing for a more nuanced understanding of tire messages that are convened. Gruber’s analysis of this unique corpus suggests that although a ritualized apology formula (e.g., “I’m sorry” or “I apologize”) would appear to he a
good choice for an allocution--and even appears
to he expected--these formulas carry implications
in this context that do not serve defendants7 communicative goals well. Her application of Austin’s (1 962) performative—cons tative continuum reveals that offense—related, constative utterances are generally more effective given the discursive
constraints on the speech event of allocution. The book offers new insights into the way in which context shapes apologies. Although the opportunity for defendants to speak out pre-sentencing has traditionally been viewed as an important protection, the various constraints imposed by the context of sentencing limit what defendants can say and how their speech is understood.
