This book reviews the remarkable life of attorney Kamill
Resler, J.D. (1893-1961).
Kamill Resler was born to a family of tax collectors in
Pardubice, a city in eastern Bohemia, then part of Austri-
an-Hungarian Empire. The occupation of KamilTs father
required the family to move around among the cities of
eastern and central Bohemia. When Kamill was eleven,
the family finally settled in Prague. Their home there was
near Pankrac, a famous Prague prison, which later played
an important role in KamilTs life, because many of his cli-
ents were imprisoned there.
From his teenage years, Resler was interested in poli-
tics, especially socialist-anarchist ideologies. He contri-
buted to several magazines and participated in political
gatherings and discussions. At one of them, he even met
Franz Kafka. Resler was not solely interested in socialist-
-anarchist ideologies but also participated vigorously in
the Czech nationalistic organization Sokol (“falcon” in
Czech), whose activities were centered on physical trai-
ning with the popular slogan: “Healthy spirit in a healthy
body.”
In 1914, he was mobilized and he served in Austrian
army until 1918, serving in Russia and Serbia. He fell ill
in 1917 with malaria and spent the next seventeen mon-
ths in a hospital. Having nothing to do there apart from
learning German, he began studies in law at Charles Uni-
versity in Prague. In 1918, with Czechoslovakia becoming
independent, he entered the services of his new state and
fought in Slovakia against the Hungarians and returning
Germans until he was seriously injured. After spending
another five months in hospital, he started life as a civi-
lian in 1920. In the hospital, he had met his future wife,
who came to visit him as a distant cousin, but shortly after
they fell in love. Four years later, they married against the
will of their respective parents. In 1920, Resler finished

his legal studies, without spending even a year studying
full-time at the University. Since he studied as a remotely
based soldier, he was able to complete his studies more
rapidly than on-campus students.
During the democratic era of first Czechoslovakian re-
public (1918-1938), Resler enjoyed a quiet life. He collec-
ted old books, especially those related to the witch trials
of Central Europe. He had the most complete collection
of books about medieval witches in this region. During
this time, he practiced as an attorney and he represen-
ted many artists, whom he knew because of his interest in
art. He had a number of publicly interesting cases, one of
which was unusual, taking part in 1935-1936. He defended
a German banker named Kiesewetter who was charged
with treason against Czechoslovakia. In this case, Kie-
sewetter’s defense was viewed by many as treason again-
st Czechoslovakia as well. However, Resler persisted in
spite of many personal attacks (mainly from his friends
from Sokol organization). Resler’s defense of Kiesewetter
was effective. The Public Prosecutor retracted his alleg-
ations against Kiesewetter, even before the ruling of the
court, because Resler established that his client did not
have anything in common with his co-defendants. Du-
ring the trial, some members of Sokol attempted to expel
him from the organization, but after their unsuccessful
attempt, Resler himself resigned from Sokol.
Before and after the Munich agreement in autumn of
1938, Resler was active in two areas. As an artist, he pu-
blished a book of poems related to the events of 1938
which broke many Czech hearts. As an attorney, he ba-
ttled against the anti-Semitic movements that took place
during the second republic (1st October 1938 - 14th March
1939), even before the Nazi occupation. Resler was desig-
nated as one of the prosecutors for the bar association
and he used this position to prosecute attorneys that had
acted ruthlessly against their Jewish colleges or used hate
speech against Jews publicly. He continued in these acti-

vities even after the second Czechoslovakian republic was
occupied by Nazis on 15th March 1939.
From this moment until the end of the war, Resler par-
ticipated in several resistance organizations. His main
task was the legal representation of arrested resistance fi-
ghters and their families and providing financial support
for the organizations and families of arrested members.
However, he did not limit himself to these activities. He
amused himself by small rebellions against the system.
He refused to pay taxes (however, after the liberation he
paid 70,000 crowns promptly) and he refused to have bi-
lingual signage in his office, even though it was mandated.
Relative to the philosophical position of lawyers and
their behavior in war times, he revealed his philosophy in
post-war article. He wrote that, if a judge discovered that
he was sentencing by a criminal code that denied human
rights, he did not have the right to advance his own per-
sonal interest by engaging in criminal actions. He should
refuse to apply unfair and unjust laws and accept the po-
ssible consequences - even a concentration camp. It is im-
portant to note that if Resler was caught, he would not
end up there - he would have been executed.
In all, Resler represented more than sixty Czechs (and
their families) who were executed by the Nazi regime,
including his cousin and best friend. He kept in touch
with German attorneys and their families and transfe-
rred all documents, including many last letters of the exe-
cuted, from one to another and translated them to Czech
for their families. He did this free of charge. It was also to
his credit that a few clients escaped death.
After the end of the Second World War, retribution pro-
cesses were omnipresent - over 20 000 people were sen-
tenced by retributive justice. The question, whether it is
morally acceptable to defend Nazi representatives, arose
among Czechoslovakian lawyers. Even though it was then
possible to represent the client freely, often their attor-

neys have been chosen by the bar, ex officio. Kamill Resler
was chosen in this way to defend K. H. Frank.
Who was Karl Hermann Frank? One of the pre-war le-
aders of the German minority in Czechoslovakia, a high
commander of SS and, as of 1943, Reich’s minister for the
Protectorate of Bohemia and Moravia. Resler was cho-
sen by chance, against the practice and rules of the bar
association and against his will, to represent Frank. He
tried to free himself from the defense of Frank but, after
three days of vain effort, he accepted it. Before him was
a case of the uttermost importance that he handled with
dignity, honesty and a surprising human approach. Even
though Resler knew that the outcome of the process was
inevitable, and that Frank would be executed, no matter
what he could do.
In his defense, he contested every allegation and he
succeeded in getting Frank acquitted of some of them,
concerning, for example, genocide in Ležáky or embez-
zlement. However, he centered the defense on other pro-
positions. He avowed that Frank was mentally ill and thus
not responsible for his actions. Since Frank confessed to
many crimes, Resler suggested it might be helpful to fu-
ture generations to understand the Nazi mentality by im-
prisoning and interviewing Nazis such as Frank to better
understand their pathologies. Life sentences, he sugges-
ted, might be the best possible way to avoid such regimes
in the future.
Resler invested a lot into Frank’s defense. Not only did
he work the whole week (except for Sunday) from early
morning to late afternoon, but all of his work was done
free of charge, because this was the way ex officio repre-
sentations were handled after the war. He was almost
bankrupted during this process.
Relative to his human feelings, initially Resler was re-
served and did not even shake the hand offered to him
by Frank. However, during the trial he started to accept
Frank as a human being and was able to discuss past events

freely with him. Frank later wrote about the defense: “As
possibly to none before, I have opened to him my inner-
-self and my real thoughts, even though he often, in my
sad situation of a prisoner, lead me to grief and anger, he
even depressed me by his relentless hardship and critique
of German actions, errors and imperfections.”
Resler s effort was crowned by success. Frank, one of
a few Nazi leaders, changed his convictions and did not
praise Nazism upon his execution. This change of positi-
on, which meant denial of Nazism, was due only to Res-
ler s behavior towards his client.
Resler spent the last three hours of Frank s life with
him because he considered it his duty. He successfully
tried to distract Frank by different things than executi-
on, like writing and rewriting of his testimony or small
talk about other cases. Resler managed to even fulfill
Frank s last wish not having tied hands during hanging.
After the act he stayed the compulsory hour next to the
gallows, followed Frank s body to morgue, where he took
care of Frank s golden teeth practically and legally, as he
promised to Frank before execution.
The importance of Resler s defense was in the way he
led it. He, who had many reasons to be biased, was able to
separate himself from them and thus he was able to capa-
bly fulfill his role as an attorney. He later said: “A defense
attorney must forget his feelings and thoughts, give up
his personality, and even if it should be very bitter, fulfill
his duty by all possible means.” Thus, he set an example
worth following.
After this case, Resler defended, against retributive
justice, several other persons including last prime-mini-
ster of Protectorate Bohemia and Moravia, two ministers
from Protectorate, a collaborating general and other less
important individuals. One of them was a farmer whose
case was very important to him. Not to him personally,
but to his career. Two journalists from the communist
party paper Rude Právo wrote a defamatory article about

his behavior during this trial and Resler sued them. Even
though he later retracted the suit, one month after the co-
mmunist takeover in February 1948, Resler was disbarred
for a half year without any reason. He enjoyed this peri-
od, because it was a more peaceful period of his life. After
a half-year, he reentered into the bar, left it three months
later. The reason Resler gave was his bad health. It is likely
as well that he was aware that he could not practice under
the new laws coming to force in 1949. At that time, with
the reorganization of the Czech bar, Communist party
took over control of it.
In the following years, Kamill Resler worked as a libra-
rian, writer and archivist. He put much more energy into
his cultural activities than before but was short on finan-
ces, primarily due to the financial reform of 1953 which
robbed him and his wife of their savings.
Resler died in his sleep in a hospital on July nth 1961.
