IN THE MEDIEVAL RAGUSAN COMMUNE
/
REPUBLIC
Summary
Land, or territory, is one of the important, integral elements of each state. With
no territory, there is no state. Therefore, it is perfectly understandable that each
state takes care of its territory, not only against threats that come from without,
by defending it from foreign takeovers and conquests, but also from within its
boundaries by giving full attention and care to its legislature and legal structure,
and legal actions in general. Hence the natural tendency of a state to first make a
register, i.e. make an inventory of its whole territory, and therefore, get to know
the breadth of its territory, its scope and size, natural and other characteristics, and
such (land cadastre); and later to determine, protect, and improve titles, ownership
and property
-
rights relations on that territory (land registry).
The medieval
Dubrovnik
Commune, and later Republic, no matter how ter¬
ritorially confined and insignificant it was, also had its indisputable communal state
territory. It also took care of it in both directions: towards outside influences, i.e.
towards other social and political communities, communes and states, and on the
inside, as well as within its boundaries. However, while it is possible to learn, from
the rich historiography of
Dubrovnik,
about activities and efforts, as well as from
the achieved results and successes of the
Dubrovnik
Commune
/
Republic and its
famous diplomacy about keeping and spreading its communal and state territory,
on the other hand, surprisingly, very little, almost nothing, and just in passing was
written about its inner legislation and legal regulations of the
Dubrovnik
area in

that disputed, mostly uncultivated border area, cultivating it and in that way claim¬
ing the land not for themselves, but also for their Commune, which was understand¬
ably, not only tolerated, but also supported by the Commune. When in the end the
Commune claimed the legal rights on the land, it held it solely and exclusively as
its own property, with no acknowledgment of previous usurpations, and therefore
dividing it according to its own will. This is all written in the
Libro
negro del
Astarea, so that book, in the same way as the one before, is formed regarding the
divisions of
Ston
and the
Pelješac
peninsula, as are later books which deal with
the acquisition of the new territories. It also legally established and legitimized,
and in written, official form fixed (established) the process of the so-called »initial
accumulation of
Dubrovnik
s
property over the newly acquired territory«.
Property borders were normally marked as a pellago (from the sea offing),
a pe del
monte
(from the foot of the hill),
a brego
(from the hill), a dollina over
valle
(from the valley or bay), apatago (from the stream, from water springs, from
churches), a maseriis (from the fences), a vigneis (from the vineyard), and they
were carved into bedrocks (usually some cliff) or stones, most often marked with
the sign of a cross
(+),
sometimes by small circle (O), or with a letter T, while the
Communal land was marked with the abbreviation »CO«
(=
Communis).
Documents, depending on the time they were written, but initially all of them,
were written in the old local Dalmatae-Roman language, i.e. the language spoken
by the natives
-
Romans, interspersed here and there with Latin which prevailed in
titles and conclusions
.
Later, when the first professional notaries came from neigh¬
boring Italy, that language gave its place to the Italian language, which took on a
special, local color, just under the influence of the local Dalmatae-Roman language
mixed with the language of the newcomers, the Slavs and Croats. The text is full
of Croatian expressions used especially for various technical, topographical, and
other names. This in itself eloquently speaks about the ethnic composition of the
already prevailing Slavic
-
Croatian element of
Dubrovnik
society of that time.
For instance, the Croatian word
granica
(border) constantly repeats itself in dif¬
ferent [language] cases (according to the demands of a context)
,
but what is very
interesting, in Latin declensions: granizae, granizarum; also dollina over
valle;
bregun (a hill); patagum (a stream), and similar.
From this extremely interesting text, we learned names for different localities
which are preserved up until now, particularly names of water springs, names of
some old, and today missing or abandoned small churches, and similar.
From other listed public land registries (land registers) from
Dubrovnik,
of
particular note is the one listed as number four, which in the State Archives in
Dubrovnik
carries the present signature (designation)
XII 2,
and the title:
Deseni
e
sentencie
de Stagno, Ponique, Cernagora,
Janina,
Dubrave, Terstenica,
from
the end of the 14th century
(1393).
That book, although fragmented and without
any covers, is still invaluable for this subject because of the plans (maps and
drawings) of
Ston
Mali and the land situated on its western side. These plans are

placed between the book s fourth and fifth page. Those plans (older than the book
to which they were added) from
1359
are the oldest preserved Croatian cadastral
maps ever.
Dubrovnik s land register reached the highest degree of development in the
final book named
Matica
(Matrix)
,
or
Libro
Rosso (named by the color red
/
rosso
of the covers of the official copy of the book)
,
which in the main excerpts contains
all the earlier land registers of
Dubrovnik.
It can be said in the conclusion that the old land registries (land registers),
although technically unperfected, still served their purpose well; moreover, some
of the basic principles of present, modern land registry law are manifested in them,
principles such as: the principle of constitutionality, the principle of officialty, and
the principle of the public (publicity). Those books, without any doubt, enjoyed
public faith (fides
publica).
They enjoyed no less public faith then the basic and
dominant mode and the legal remedy for the acquisition of a property of that time
(and even of today), i.e. notary document
(carta).
Old
Dubrovnik
natives, maybe even unconsciously, formed the institute of
the land registries, when after every
acquis
of new territories they formed special
books
.
They acted that way because it was much easier and simpler to register all
owners in one common book, instead of issuing special individual notary docu¬
ments (traditioper chartulam) to all owners, according to the common practice of
that time. That means that those books, as being more practical, simply changed
and replaced the notary document
(carta),
which was not, however, completely
excluded. Accordingly, there is no doubt, those books indeed had a constituent,
and not only declarative character, which created a certain duality in property
acquisition rights. This means, that those books had elements of a modern day
land registry (Croatian:
gruntovnica),
but since they missed all its components,
we simply call them land registers (Croatian:
zemljišnih).
Old
Dubrovnik
land registers show how, for
Dubrovnik
society, private
property relations were important at the end of the fourteenth, and especially in
the middle of the fifteenth century. They were relevant not only for commerce and
shipping, which is a fact that has been known for a long time, but they were also
significant for land and agricultural works. This is evident in increasingly frequent
usurpations of social, communal (municipal) land, which reached such proportions,
that the Commune itself had to intervene. The Commune did it in such a way, that
from time to time, it established special committees (commissions) that worked
in the field and reviewed the conditions of property relationships on the spot, thus
preventing, or maybe it is better to say stopping, usurpations of the communal
(municipal) land by bringing very strict and irrevocable decisions about the removal
of all illegally built houses or crops planted on a piece of land. It was all written
down in the form of a record in corresponding books, which are listed here, in this
study, and called land registers.

These land registers, accordingly, point to an extremely high role of the state
/
Republic of
Dubrovnik
as a regulator of legal ownerships and titles, and no
longer only through general laws, but also in the way presented here, i.e. through
specific land register law regulations written down in special public land registries.
Although during the period discussed in this study (the end of the fourteenth and
whole fifteenth century)
,
the basic way for acquiring a property in feudal European
society of the time was through the notary document
(cartă),
here in Croatia, i.e.
in
Dubrovnik,
which was a medieval trading city, private property order was so
highly developed, that in comparison to other countries, we had »land registry«
(land register) very early. Speaking of this, it is important to notice and point out
that although in Czech well known zemskim
des
кута
—
tabulae
ter
rae,
registra¬
tions indeed had a constitutive character, yet only the properties of the nobility
were listed in them. It was, accordingly, not a general land register (as it was in
Dubrovnik),
but a land register for nobility, a kind of cartulary.
We have a similar situation in Croatia, with the so called »Istrian divorce«
from the middle of the fifteenth century. However, while the Istrian divorce
represents the act about demarcation between feudal lords and serfs lands, it is
consequently also only a kind of land register for nobility
-
a cartulary. The pub¬
lic authority of the state
/
Republic of
Dubrovnik
appears as a community of the
medieval city, and as a factor which establishes legal ownership and title relations
in land registers from
Dubrovnik
discussed in this study. That fact, without any
doubt, gives these land registers special and exceptional importance.
However, medieval land registers from
Dubrovnik
are not general in the sense
of the present day gruntovnica (land registry, or land cadastre). Only communal
(municipal) pieces of land were listed in them, i.e. lands, the owner of which, as a
public-private, and juristic person, is the Commune
/
Republic, no matter whether
these lands were kept in its ownership, or some of their parts were transferred to the
ownership of private persons. We may say that it is the state general land register
in a narrow sense, because the present day institute of land registries and the one
of the land cadastre is no less state, since it encompasses both parts: the part that
lists state properties, and the part that lists private properties.
Based on those and similar preserved public books about the acquisition
and division of new territories, based therefore, on the medieval land register of
Dubrovnik,
the problem of the class nature (essence, essentiality) of social and
economic order in the
Dubrovnik
Republic raises again in all its severity.
The hinterland of
Dubrovnik
—
the village, is without any doubt a feudal do¬
main ruled by feudal social relations, although in somewhat modified form, while
the city of
Dubrovnik
itself, a medieval city
-
marketplace, is a capitalistic city.
As such, it influences its environment which is an inexhaustible and indispensable
source of a much needed source of labor for the already developed commerce and
craftsmanship.

On the newly acquired land, which was further divided among nobility and
a select part of citizens, the Republic tolerates and still actually keeps serf like,
or maybe it is better (more precise) to say relations similar to serfdom, which are
further modified according to the needs of the Republic. The Republic, based on the
designs of ancient Rome, which is by the way, often referenced by the government
of
Dubrovnik,
and very often a role model for their actions, forms some sort of
colonatus system in that area. The whole of the agricultural land is divided into
specific parcels, the so called
decena
(tenths) which were further divided into halves
and quarters, in the same way Rome divided the
ager
of the colony, or to be more
precise, its parts that could be cultivated, into centuriae
(50
hectares), and then
further into
sortes
—
parcels (one
centuria
equals
100
sortes)
which were given to
individual colonists. The obvious evidence that
Dubrovnik,
or medieval Ragusium,
just like
Zadar
on the Croatian coast, preserved, at least in the legal minds of those
who ruled, although not
defacto,
the continuity of its municipal life even after the
arrival of the Slavic peoples.
The truth is, admittedly, as Mate
Suić
have already noticed, that the
ager
of
Epidaurum, just like the
ager
of
Salona,
during the time of the arrival of the Slavic
peoples at the beginning of the seventh century, remained without its center, but
it was later obviously and successfully replaced by medieval Ragusium (later
Dubrovnik)
in a both political, and ecclesiastical sense. Namely, it is known that
the bishop of Epidaurum moved his centre from the badly damaged Epidaurum
(present day
Cavtat)
to Ragusium
(Dubrovnik).
Throughout its whole history, until
the loss of its state independence, Ragusium
/
Dubrovnik
was considered to be the
successor of the antique Epidaurum. In accordance with the above said, Ragusium
led and adjusted its foreign and interior affairs. That tradition, I dare say, is one
not so insignificant element of its long term independence, but of course, not the
only one.
The transformation of the antique
ager
of Epidaurum into the territory
—
district
of the medieval municipium Ragusium
/
Dubrovnik,
was long and hard. Surely,
the organization of the Roman
ager
and the system of the centuriae served their
purpose well with the network of limes (borders) and field communications during
the division of the acquired land.
On the original territory of
Dubrovnik,
the core of the latter Commune and
the Republic, consisting of Astarea (except for the upper
—
higher parts which were
later acquired and subsequently divided, which is noted in the
Libro
negro del
Astarea), the Elaphiti islands
(Kolócep, Lopud,
and
Sipan),
the islands of
Lastovo
and
Mljet,
there was never a serfdome, nor any relations similar to those, not even
the colonatus system (the same as there was never one in Rome, nor in the core of
the Roman state)
,
because the
Dubrovnik
Commune never divided the territory, on
the contrary, the natives dealt with it freely. Only what the Commune had acquired,
mostly through purchases (Rome, however, did that through military conquests!),
was ever divided, but the communal land which was there from the beginning,

was not. Therefore, the medieval municipium Ragusium was from that moment
considered a true sovereign over the whole territory acquired by purchases, both
the sovereign of the territory which was left to the Commune (i.e. to the public
domain), and equally of the territories that were previously owned by private in¬
dividuals, or territories that were then given to private individuals. The Commune
kept
dominium directum
(direct ownership) over the whole territory, while those
who used the land got only
dominům
utile
(the right to use something as indirect
owners). That diverse kaleidoscope of agricultural relations is mirrored in various
preserved office and notary documents in corresponding series, in
XXIV.

Old people of
Dubrovnik
kept their land registers together with other public
books in the state office and notary office, which were situated in the ground floor
of the Rector s palace. Some very old fashioned, but well preserved closets from
the time of the Republic are still there. They are in one rather large room which
is divided in half by the iron bar fence. Namely, in medieval
Dubrovnik,
people
could look into a cadastre
-
land register only from behind the bars. In that way, the
Government of the Republic very carefully watched its public books of acquisitions
and divisions of newly acquired territories, that is to say, land register.
