Summary
This book on political crimes before the Slovak Supreme Court from
1939
to
1944
focuses on the changes in the Slovak judiciary of that period, i. e. the process of this
institution adaptation to the requirements of a new non-democratic ruling elite
-
the
Ľudaks.
The main data source for this analysis were the published
1939 - 44
judgments of the Slovak Supreme Court in crimes that were classified as political
under the law in force for the duration of the Slovak state and became an inherent
part of the proceedings before the criminal courts. At the same time, however, the
government created a system whereby uncomfortable people were placed as an¬
ti-state elements even without any police investigation and trial in the so-called
arrest (concentration) camp in an older prison facility at the town of
Hava.
The peri¬
od of internment was not determined, in fact, it varied from a few days to two years,
and many people were also repeatedly arrested. According to the still incomplete
data available,
3,595
persons were held for political offenses in regional court pris¬
ons and at least
3,100
people in the Ilava detention camp in the period concerned.
The text also explores the history of criminal law-making of that time which
allows demonstrating the legislative process and its application in practice. The
development of this standard-setting was influenced by the domestic and fore¬
ign political context as well as the military situation and it reflected the transfor¬
mation of regime dynamics throughout its entire duration. In view of the foreign
policy context, the book also includes an analysis of the impact of relevant Ger¬
man-Slovak treaties and agreements on the legal status of Slovak citizens.
The drafting stage of new criminal provisions from March
1939
to March
1940
was the most important period for the assessment of the nature of new criminal laws
which played an essential role in the prosecution of political crimes. Then, the foun¬
dations of totalitarian law following the Nazi Germany model were laid down and
later, the legal provisions were only refined, particularly in terms of the new merits of
criminal offenses. Until then unthmkable elements destroying citizen s legal certainty
and new procedural principles reflecting the new criminal standards were introduced
in the legal order. Lack of judges caused by political and racial cleansing was resolved
by lowering their qualification requirements. The privilege of the liberal lawyer pro¬
fession was also abolished. Retroactivity to the detriment of the accused was phased
in and appeal was precluded in some cases. Although the criminal law protected the
life and property of citizens against the acts by natural persons it did not protect them
against the acts by the state. Neither the Supreme Court had a competence to decide
in favour of the citizen in such cases. Given that it was not in the interest of the state
to make the public aware of the political crime trials before the Court, reports from
hearings were almost never published even in the state-run press.
