Wars
The Politics of Land Use
Not long ago, few places ever said no to new
real estate development. Growth meant jobs, tax
revenue, and progress. Smoke a cigar with the
building inspector, pick up your permit, and in¬
vite the mayor to the groundbreaking photo.
Then came smart growth, the anti-sprawl and
antienvironmental movements, historic preser¬
vationists, and NIMBYs (those who said not in
my backyard ). At the same
tíme,
savvy business
operators realized that using land use regula¬
tions to keep competitors out could protect
profits far better than cutting prices after a
rival s new store opened.
NIMBY Wan shows how the arena of local land
use regulation has been politicized and describes
in explicit detail what developers
—
and their
opponents
—
must do to win.
Land use politics is a completely new and differ¬
ent discipline from the old-fashioned local
fixer method or the press release approach to
project approval. Its practitioners make no effort
to peddle influence or to waste time trying to
educate people who resolutely oppose a proj¬
ect. They do not treat the public as a market
to whom they sell the project, and they do not
harp on the developer s vision of the benefits
that the project will bring the community.
Instead, practitioners of land use politics prac¬
tice politics

the process by which citizens de¬

citizen advocacy, not professional lobbying or
presentation. The difference is considerable, and
the benefits of this approach are many.

The Authors
P. Michael Saint is founder and CEO of The
Saint Consulting Group and a pioneer in the
new management consulting field of land use
politics. Starting in
1983
after careers in journal¬
ism and politics, he built a global organization
bringing together the skills, training, and con¬
stantly advancing technologies needed to win
the most contentious land use permitting battles
across the United States, Canada, and the
United Kingdom.
Robert J. Flavell is an attorney with wide expe¬
rience in government, politics, and land use
strategy. During more than
20
years with Saint
Consulting, he successfully managed hundreds
of land use campaigns and developed the firm s
defense practice. His articles on land use issues
have appeared in numerous trade and profes¬
sional publications. He is a member of the
Massachusetts, U.S. District, and U.S. Supreme
Court bars.
Patrick
F.
Fox has managed or consulted on
hundreds of land use projects across the United
States, Canada, and the United Kingdom. An
experienced political campaign strategist, he is
an innovator in adapting state-of-the-art grass¬
roots political campaign techniques to win im¬
portant land use disputes. He also developed the
Saint Index®, die world s only international sur¬
vey that quantifies and analyzes opposition to
