Transformation of the Czechoslovak Federal Parliament
during the Velvet Revolution
The Czechoslovak Federal Assembly established in
1969
as part of the
fédéralisation
of Czechoslovakia played an important yet paradoxical role in
the Velvet Revolution twenty years later. In the power vacuum created by the
panic-stricken Communist Party of Czechoslovakia, the Federal Assembly
suddenly emerged as the key and sole institution that could guarantee a peaceful
and constitutional transformation of the political system. The opposition
movements (the Czech Civic Forum and Slovak Public against Violence)
accepted the communist constitution as a basis for the transformation and
the constitution could only have been changed through the Federal Assembly.
There was no credible alternative to this strategy since the constitution as well
as the Federal Assembly were seen as a historical achievement by a significant
part of the Slovak elite, both communist and post-communist. Other options,
such as a return to the
1920
Czechoslovak constitution were completely
unacceptable to the Slovaks. The problem however was that the deputies
of the Federal Assembly were elected in communist-style elections with
single candidate ballots in
1986
and were not seen by society as legitimate
deputies.
Zdeněk Jičínský,
the reform communist, one of the authors of the
1968
constitutional amendments, and the main constitutional expert of the
Civic Forum, came up with the concept of co-options . Some of the deputies
were supposed to resign or were to be recalled from the parliament, which
would then elect new members from the ranks of the opposition movements.
This would allow the postponement of the election, gain some credibility for
the Federal Assembly and preserve it in the role of a stable institution in the
revolutionary turmoil. This was not unique in Czech modern history, in which
elections were never used as a solution to a political crisis. In fact the
1969
cleansing of the newly established Federal Assembly was taken as a model
and many of the deputies who were purged in this process (most notably
Alexander
Dubček)
returned through the practically identical legislation
to the parliament twenty years later. The co-options , though unique to
Czechoslovakia, were part of a broader phenomenon of constitutional
improvisations in Central and Eastern Europe, which were all trying to cope
with the complex constitutional legacy of the communist era.

This study is part of a broader research project on the Federal Assembly in
the years
1989-1992
that looks into mechanisms of self-parliamentarisation ,
i.e. the process of gradual emancipation of legislature vis-a-vis the excecutive
power. The study has three primary ambitions: First, it continues the line
of investigation started by
Jiří Suk
about the revolutionary changes of late
1989
and early
1990
and using the same methods and sources (transcripts of
negotiations of the Civic Forum movement, Archives of the Civic Forum) it
tries to explore one of the side passages of the labyrinth of the revolution .
The co-options are seen by many commentators as an original sin that stood
at the start of many ills of the post-communist transformation of the
1990s.
It is therefore worth exploring in which ways the decisions were taken and
whether there were any credible alternatives. Second, the very topic of the
Federal Assembly and the sources it created (minutes of the plenary sessions,
parliamentary committees, presidium or interviews with the deputies)
provide an opportunity to look at the Velvet Revolution from the perspective
of the marginalised and defeated actors. The struggle for the control of
parliament reveals two visions of change: against

moral and aesthetic revolution destroying all evil and ugliness there stood
the reform agenda of paragraphed revolution of
Zdeněk Jičínský,
with his
deep scepticism towards the genius of the crowd and its leaders. Two political
times are clashing here: the dynamic time of the revolution against the slow
motion of the parliamentary democracy. One can also follow here the world-
view of the losers, i.e. the parliamentary deputies who did not want to be
merely used by the revolutionary movements and then discarded but wanted
to be part of the political transformation. They fight for the right that even
the communist regime gave them, the right to agree . This was particularly
apparent during the extraordinary parliamentary debate over the co-option
in which the parliament discussed whether it should deprive more than one
hundred of its members of their seat in the parliament. For the first time in
its history the Federal Assembly did not pass a law, yet under the pressure
it quickly changed its mind. This debate was broadcast live on television,
its absurdity heightened by the sudden appearances of external visitors:
deputations of revolutionary students demanding immediate approval of
the law,
Václav
Havel, recently elected by the same parliament to the office
of President, who sparked the so-called hyphen-war by his speech, and
Frank Zappa on the parliamentary gallery who was making a documentary
about the Velvet Revolution. Finally, based on the biographical research, the
study asks where and how the new deputies were found and to what extent
they became part of the new post-communist political class. It follows the

gave rise to a strong generational group of young right-wing politicians
(Petr
Čermák, Miroslav Macek, Jiří Pospíšil, Vlasta Parkánová, Libor Kudláček)
with a shared
program
of political anti-communism, aimed, of course, at the
key figures of the
1960s
reform communism, such as
Zdeněk Jičínský.
Not
all the new deputies were young right-wing politicians; we can find among
them some of the future leaders of the social-democratic party, such as
Lubomír Zaorálek
or
Miloš Zeman.
