RESUMÉ
The preparation of the so called Statute of nationalities represents
an interesting attempt of the Czechoslovak Government to improve
the position of national minorities in the interwar Czechoslovakia in
late 1930th and implement liberal legislation in minority question. The
growing tensions between Czechs and Slovaks as well between Czecho¬
slovak state and its national minorities worsened at the beginning of
the 1930th because of international crises in Central Europe. The Nazi
Germany headed by Hitler demanded fundamental changes in position
of German minority.
The internal causes of the crises were closely connected especially
with the developments within the Sudeten German society and policy,
which led to the establishment of the Sudeten German Party chaired
by
Konrad Henlein.
This party, with the support from Nazi Germany,
gradually became the leading political representation of the German
minority in Czechoslovakia. They misused not only the worsening of
the economic situation during the Great Depression, but also some
flaws and misconceptions in the Czechoslovak minority policies.
Especially during
1938
the Sudeten German party presented far
reaching proposals for self-determination, first in the form of autono¬
my. The most severe conditions for Czechoslovakia to accept were set
in the so-called Karlsbad program of April
1938.
The Czechoslovak
Government tried to react and prepared the Statute for Nationali¬
ties, Language Bill and Administrative Reform Bill. The proposed
legislation was very liberal and if put into practice it could lead to
transformation of Czechoslovakia from the national state with minori¬
ties to the state of nationalities close to the Swiss model.
The preparation of the Czechoslovak legislation composed of the
Statute of nationalities and Language law was started only after
a comparative analyze of the position of national minorities in selected

European
countries (first of all Poland and Baltic States) in the inter-
war period was finished.
The study reflects not only historical but also legal aspects. It is
also deals with the internal developments in Czechoslovakia between
1933-1938
as well as with the international politics and diplomacy
in the period of appeasement. From legal point of view the study
describes the proposals and the views of the Czechoslovak lawyers on
the minority question compared with the views of minority parties, not
only the Sudeten German Party but also Polish and Hungarian ones. It
also analyses the importance of the Slovak factor in the negotiations
concerning the possibility to achieve the Slovak autonomy through
implementation of regional diets.
The statute of nationalities was refused by the Sudeten German
Party and the statute was discussed only within the Government and
did not become a valid law. The study argues that the main reason,
why the National Assembly was not allowed to discuss and enact the
proposed legislation was the diplomatic pressure from the British and
French Governments, when the proposal proved to be too inadequate
concession to appease Henlein and Hitler. Instead the Runciman mis¬
sion and cession of territory were applied as more suitable measure to
resolve the Czechoslovak minority question.
The international causes which led to the refusal of the nationality
statute and consequently to the Munich Agreement, could be found es¬
pecially in the violent and aggressive nature of the international policy
of Nazi Germany. The aim of this policy was to crush Czechoslovakia
and to see the Czech lands as a sphere of vital German interests. This
was followed by the changes in the French policy towards Central Eu¬
rope. The French were

the Czechoslovak state. In
1935
the alliance was declared also by the
French-Soviet and Soviet-Czechoslovak Treaties on mutual assistance
in the case of an unprovoked attack by the third party Especially after
the so called Anschluss of Austria and after the fall of the last Govern¬
ment of the Popular Front, the French Government led by
Eduard
Daladier
became more and more dependent on the British policy. The
Chamberlain s policy is usually depicted as a policy of appeasement.
Although there is a lengthy discussion about the reasons for such

a policy, it is important that as a result of this policy the Czechoslovak
Government was forced at first to yield the pressure from the Sudeten
German party and practically all concessions, including the Statute of
nationalities were seen as an obstacle to the Hitler s plans.
