A Judge at the Time of Justice and Injustice.
Memoirs of Dr. Vaclav
Nedělka
(1881-1965)
This issue publicizes a memoir of the judge Dr.
Václav Nedělka,
which has up to now been kept by his family. This memoir is an in¬
teresting material that documents proceedings of the juridical ad¬
ministration at the end of the Austro-Hungarian monarchy, throughout
the entire First Czechoslovak Republic and during the Protectorate
of Bohemia and Moravia.
Václav Nedělka
was born to the family of a poor trackman on the
Austrian North-West Railway; he studied the Gymnasium in
Německý
Brod
(now
Havlíčkův Brod)
and law at Prague University. In
1905,
after
his studies, he entered juridical services in Moravia and attended
a school for quartermasters during his military service. He worked
as a judicial candidate in
Znojmo, Mikulov
and
Jihlava.
In
1911,
he
was appointed a judge; he initially worked in the
Vsetín
District Court,
then in
Město Žďár
(now
Žďár nad Sazovou).
He served on the front
(Galicia,
East Slovakia and
Bukowina)
and in the rear (Brno) as
a quartermaster throughout the entire World War

When he returned
from the war, he worked as a judge in the
Zdar nad Sázavou
District
Court in the
1920s
and in the
Znojmo
Regional Court and Brno
Higher Court in the
1930s.
In
1937,
he was appointed president of
the
Jihlava
Regional Court, the peak of his career. He experienced
the critical moments of Czechoslovakia s dawn and the start of Nazi
occupation in this town, where the nationalistic conflicts had been
very tense since the break of the century. The court was forcibly
moved to
Třebíč
in
1940
and
Václav Nedělka
was retired one year
later. He spent his old age in
Hrotovice
and Prague.

The memoir is very detailed; it is based on many personal and
family documents (some of them are deposited as a personal material
in the Moravian Land Archives in Brno). Passages from World War I,
which report the dates and locations very accurately, suggest that
they were based on certain, now vanished diaries.
The first aspect that appears in the memoir is the author s intel¬
lectual world. He himself introduced his memoir with the words:
Our generation emerged when the era of the
monarcas
was ending,
liberalism developed and capitalism and socialism were still in their
early stages. We experienced an amazing advance of technology with
a social and cultural development trailing behind. Vaclav Nedelka s
perception of the world was inspired by the humanism of
Tomáš G.
Masaryk,
whose philosophical lectures he had encountered during his
studies and became his follower in the political aspects. As he claims
in his memoir, when
T. G.
Masaryk
failed to renew his realistic move¬
ment after World War I, he felt disorientated. Even attitude to religion
resembled T. G. Masaryk s viewpoint. He justified his conversion to
the Czechoslovak Church in
1930
with its public role rather than the
content of its faith. He became more active in the church after his re¬
tirement in the 40s and 50s. Despite this, however, the memoir con¬
tains references to his personal belief.
Václav Nedělka
was confronted with escalating conflicts concerning
the Czech-German ethnic disputes and the division of political stand¬
points. In the early years of his court service, the judge or the state
officer had to be a supra-national and apolitical person. Meeting these
requirements in real life, however, was becoming rare; the First Czecho¬
slovak Republic gradually resigned to the political neutrality of the
judges.
Václav Nedělka
joined the Social Democratic Party, but did
not become involved in it. His public involvement coincided with his
profession of a judge, but did not extend over his obligations.

and participated in cultural and public education associations in
smaller towns.
During World War II, he became a direct actor in clashes between
the
Reichs
and Protectorate offices, which tried to defend the last
traces of autonomy. As a president of the
Jihlava
Regional Court,
Nedělka
had a conflict with the local
Oberlandrat,
who initially de¬
manded a part of the regional court and later the complete building.
His enforced movement to
Třebíč
and the successive retirement
probably saved him from a worse destiny.
Václav
Nedelka s memoir
records moments of dangerous courage as well as concessions. His
attitude to the semi-democratic establishment between
1945
and
1948
and the communist state following
1948
was similar, but different in
certain aspects. As a member of the burgouise regime , he was dis¬
placed and his rent was confiscated for some time. As a person who
had spent most of his life in the Czech-German conflict, he found the
totalitarian regime, based on a domestic origin and represented by
the local people, hardly comprehensible.
The memoir is not much concerned with actual judicial matters;
it concentrates on the process as a whole and Nedelka s career is in¬
serted into this framework. In addition, it describes in great detail
the political and social life in towns where he worked. A detailed de¬
scription of the housing situation views the everyday history. The
author paid a great attention to the health matters, recorded his own
problems and problems of his relatives, injuries and illnesses that
meant serious danger to life as well as banal ailments.
A special passage at the end of the memoir is dedicated to Ne-
delka s relations with women. His first marriage ended in a divorce
in
1920,
but he soon married again; his second marriage was happy
and produced two children. It is clear that he considered it a sensitive
matter even

he wrote the memoir. His first unsuccessful marriage
is the only point in the memoir where he acknowledges his own mis-
take. This passage thus contrasts with his narration on the judicial
and other public work, which he performed very carefully and which
he himself characterized as diligent .
Another dimension of the material is the facts that the memoir
conversely does not mention. The description of his free time and his
own cultural interests is only marginal and unsystematic. The memoir
may thus leave a false impression that he devoted all his free time to
public work. Reading and going to the theatre was a standard, but
his cultural activities penetrated into the memoir only in places where
they were related to social events. Sporadic mentions comment his
staying in the open or the natural beauties that he noticed during
troop movements.
The edition is based on a typewritten copy. Footnotes were added
identifying mentioned personalities and places and specifying other
facts using other sources (e. g. Vaclav Nedelka s personal archive,
archives of Ministry of Justice in Prague, Higher Court in Brno, and
Regional Court of
Jihlava).
