The year
2012
marked the tenth anniversary of the entry into force of the Statute of the
international Criminal Court (ICC), signed on the threshold of the 21st century in July
1998
in
Rome. Quite logically for such a young institution, the ICC has faced several challenges with fierce
opposition from many African States and the, at times, troublesome relationship with the UN
Security Council. However, the ICC has undoubtedly also made important strides in becoming art
important player in the international criminal justice arena. With

situations
referred under the four different triggering mechanisms envisioned by the Rome Statute, and
several more under preliminary examination, the Court is anything but an irrelevant player in
international relations. Furthermore, the amendments to the Rome Statute adopted during the
first Review Conference held in Kampala in
2010
were undeniably an important event in the life
of the Court, in particular because the jurisdiction of the Court was extended with the crime of
aggression. The Cock of International

annotated will provide the
first comprehensive annotation of these historic amendments.
While it can thus not be denied that the ICC is alive and: well, becoming the cornerstone of the
system of International Criminal Justice, the Court did not start its work from scratch. Many
elements of the Statute were drafted on the basis of jurisprudential innovations by the two
ac/ /îoc
Tribunals, the
Internaţional
Criminal Tribunal for the Former Yugoslavia
(ICH)
and the
International
Criminai
Tribunal for Rwanda (ICTR), or codified more specifically in the various
instruments of the Court (Statute, Rules of Procedure and Evidence and the Elements of Crime).
Moreover, while the jurisprudence of the ad hoc Tribunals does not constitute applicable law per
se
before the ICC, the latter does not exist in isolation, and, as is seen from the early practice
of the Court, the case law of the ad hoc tribunals is frequently relied upon by participants filing
before the ICC and in the judicial decisions by the different Chambers. Taking this into account,
the editors of this Code decided to provide scholars and practitioners in the field of International
Criminal Law and Procedure with a both practical and valuable tool by compiling the annotations
of the Statutes of the three intertwined Courts into one Code.
