THE TRIAL OF KULAKS IN SLOVENIA BETWEEN
1949
AND
1951
Agricultural development in the immediate post-war period proved not only an economic but
also ideological, political and social issue. The authorities regulated it by means of numerous
administrative measures. One of the first measures that affected the farming population was
the introduction of buy-ins and the compulsory delivery of surplus crops with the objective of
ensuring supplies for the population. Other important agricultural measures that significantly
affected the position of farmers included: the system of rationed supplies, the agrarian reform
of
1945,
the establishment of agricultural cooperatives from
1946
onwards
anö
the process
of socialist transformation of villages and collectivization of agriculture with the establishment
of agricultural farming cooperatives from
1949.
Farmers resisted these measures in various
ways. A consequence of such resistance was the onset of the trials as early as autumn
1945.
The onset of
1948
marked the start of the dispute between Yugoslavia and the Soviet Union.
One of the important consequences of the conflict with the
Informbiro
was the culmination
of the Party s relations with farmers since the Informbiro s resolution went on to criticize the
agricultural policy of the KPJ (the Communist Party of Yugoslavia). The process of socialist
transformation of villages and the collectivization of agriculture with the establishment of
agricultural farming cooperatives was set in motion, modelled on the Soviet collective farms,
the so-called sovkhozy. The authorities tried to remedy the problems of supplies and the
impending threat of hunger by increasing the burden upon farmers. The economic and
political pressure was felt particularly by large-scale farmers
-
the so-called kulaks.
The implementation of the process of socialist transformation of villages and the collectivization
of agriculture constituted the most important agricultural project from the beginning of
1949.
The Party tried to achieve this through political and especially economic measures. To mention
but a few of such measures: increased taxes and stricter policy with respect to compulsory
buy-ins. The establishment of agricultural farming cooperatives was supposed to be based
on the principle of voluntary agreement, meaning that the farmers were allegedly to join
these cooperatives on their own accord and not under constraint. The actual situation was
mostly very different
-
the most common irregularity at the establishment of cooperatives
was namely the violation of the principle of voluntary agreement to join: farmers in reality
joined the cooperatives as a consequence of political pressure and in particular as a result of
economic measures exerted by the authorities.
The worst pressure was felt by farmers in
1949
when the greatest number of new cooperatives
was established. At that time the number of court trials against large-scale farmers (the Kulak
trials) also began to increase, reaching its peak between
1949
and
1951.
At these trials,
the courts imposed substantial prison sentences and financial fines and
-
as opposed to
proceedings against farmers in previous years
-
the confiscation of property as the maximum
sentence. The courts actually imposed confiscation of property to enable the establishment of
new agricultural farming cooperatives with these confiscated properties. Despite the fact that
the Party was critical of such practice, the confiscation of property by judicial procedure was
employed as one of the ways to establish agricultural farming cooperatives.

The manner in which the Kulak court trials were conducted was influenced not only by various
agricultural measures of the authorities but also by various instructions of the Party and the
political leadership. Even though these instructions did not refer directly to the administration
of the courts and court trial hearings, they can be labelled as fundamental guidelines to
courts as to the means of implementing punitive policies against farmers. These proceedings
can be labelled as political. The judges, who were also political activists of some sort in the
judicial system of that time, justified their decisions exclusively through political arguments.
These decisions were also in the main a reflection of the political and economic situation in
the country at that time.
The Kulak trials sought to indict farmers who opposed the collectivization of agriculture
and refused to join agricultural farming cooperatives, as well as those who did not perform
mandatory obligations (buy-ins, deliveries). The farmers manifested their resistance primarily
by neglecting the cultivation of land, inventory renewal and cattle farming, by concealing
cultivated land and crops as well as by sabotaging the mandatory deliveries and by not paying
the taxes. Many farmers were also convicted on the pretext they supposedly tried to persuade
others not to join the cooperatives. Among convicted farmers were also members of the
cooperatives who allegedly tried to break up the cooperatives by various means. The courts
imposed substantial penalties upon farmers who allegedly damaged or destroyed the property
of a cooperative as well.
Despite numerous measures of constraint the collectivization of agriculture did not achieve
its expected results. The final consequence of the various pressures and measures of the
authorities, irregularities in the establishment of cooperatives and violence against farmers
was the start in
1951
of the mass withdrawal of farmers from the existing cooperatives
-
this compounded by the fact that hardly any new cooperatives were founded. Furthermore,
following the conflict with the
Informbiro,
Yugoslavia received economic and later also military
aid from western countries, especially the United States of America and Great Britain, which
was in turn conditional on changes in Yugoslav economic policy. This triggered changes also
in agricultural policy and in
1951
and
1952
the authorities gradually started abolishing certain
administrative measures of an agricultural nature, such as compulsory delivery and buy-ins.
Farmers found themselves under decreased pressure to establish cooperatives and in
1951
the
number of the Kulak trials also fell.
The issue of the rehabilitation of farmers, convicted during the period of the process of
socialist transformation of villages and collectivization of agriculture, was raised in
1970
by
a delegate of the Republican Assembly of the Assembly of the Socialist Republic of Slovenia,
Ivan
Pučnik.
The Secretary of the Republic for Justice, Viktor Damjan, rejected the possibility
of their rehabilitation at that time. More than twenty years later the rehabilitation of farmers,
convicted during the period of the collectivization of agriculture, was facilitated by the
Denationalization Act
(1991)
and the Redressing of Injustices Act
(1996).
