MACEDONIA AND GREECE
NAME CONFLICT
(Legal mechanisms in the United Nations for returning/usage of the
Constitutional name of Republic of Macedonia)
Republic of Macedonia in September
1991
declared independence on one
part of its ethnical territory and for only one part of the Macedonian people.
Afterwards, the process with the international recognition and the
admittance in the United Nations converted into humiliation since Macedonia
was admitted in the UN under interim name "Former Yugoslav Republic of
Macedonia- FYROM" which is different than the national name and not in
compliance with the conditions stipulated in the general international law and
the UN legislation.
At the same time, two additional conditions which do not have legal
character were imposed on Macedonia

.to accept the interim name "Former
Yugoslav Republic of Macedonia", and
2.
to negotiate about the name).
These legally unfounded conditions signify violation of series of
international legal principles and policies since the election of the states names
is an issue of internal circumstances and not of the international law.
In this context, almost two decades Macedonian-Greek name negotiations
have been conducted under the auspice of the United Nations which do not
have any progress and are still at the initial point.
Thereof we can point out an argument that the negotiations are not leading
to the name solution and thus as the author suggests Republic of Macedonia
should at last encourage itself and make the necessary radical overturn in the
domestic policy and to transfer the name conflict from political to legal ground
where it actually belongs.
In other words, Republic of Macedonia in compliance with the international
law and the UN legislation shall initiate a procedure for returning/usage of its
constitutional name in the UN as the best possible manner for solving of the
two decades name conflict.

Even more, the name conflict is a legal issue which needs to be solved in a
legal
procedine
with application of the international law.
The central issue in the book is elaboration of the legal mechanisms in the
United Nations for returning/usage of the name Republic of Macedonia through
the four main organs of the UN: Secretary General, Security Council, General
Assembly and the International Court of Justice.
Herein, the author takes into consideration the issue of which of these organs
of the UN shall most favorably react if Macedonia initiates legal procedure in the
UN for returning/usage of the name Republic of Macedonia if of course this is an
issue of political assessment of the state government.
This book reviews the period from the independency of Republic of
Macedonia until the present because the publicity of the topic does not end with
crossing the boundaries of the authorizations of the UN key organs (General
Assembly and the Security Council) at the admittance of Republic of Macedonia
into membership in UN since the topic is especially relevant in conditions when
the issues with the name Republic of Macedonia are still ongoing.
However, this is first scientific paper which researches and elaborates the
legal mechanisms which are on disposal of Republic of Macedonia for returning/
usage of the name Republic of Macedonia in UN in an analytical and scientifically
supported approach, taking into consideration that the issue with these legal
mechanisms was not a subject to profound and comprehensive scientific research
in which this process shall be analyzed in its integrity and complexity.
The extraordinary significance of the issue of Republic of Macedonia
influences the research to become bigger than the level of only one theoretical
conflict i.e. to research the selected issue with point to its practical side considering
that it can be useful only if it is sufficiently practical.
