The Henrician Articles were a normative Act passed by the resolution of the Diet
of the Polish Commonwealth
(Sejm)
on 12th May
1573,
during the first com¬
mon and free royal election, when Henri
d Anjou, a
French Duke, was elected to
the Polish throne. The Act stated the fundamental principles of governance of the
constitutional institutions of the Commonwealth, the rights, liberties and consti¬
tutional guarantees of their binding. Taking into account the Henrician Articles
founders intensions, the content of the arrangements as well as the legally binding
acquisition process, the Henrician Articles became a principle Act in the constitu¬
tional system of the contemporary Polish Commonwealth. Essentially, considering
their character as an Act prepared by the States of the Commonwealth, being then
understood as the Nation, and during the interregnums thought to be the embodi¬
ment of the Commonwealth, the Henrician Articles can formally be seen as the
first Polish written principle constitution made in the Commonwealth. Understo¬
od as such, the Henrician Articles were an Act that, with their solutions and most
importantly the content and significance of its conclusions touching the fundamen¬
tal laws for the State system as well as various rights and liberties, was an expres¬
sion of the will of the whole political Nation of the contemporary Commonwealth
and, with its aims and importance, was superior to similar political acts shaped at
this time in Europe. The conferment ceremony giving the Henrician Articles legal
biding force finally took place during the coronation Diet of the King Stephen
Báthory
in
1576
and was a turning-point in the history of the Polish state legal
and political systems. Despite their limited character, especially in their content,
the Henrician Articles definitively closed the period marked with the lack of any
regular norms concerning the political system of the Commonwealth, regulating
the status of its key elements such as, for instance, the King. The royal status
was practically never defined before and its elements were, if anything, based on

regulations derived from tradition; if any norms were observed, they were only of
partial nature. The significance of the regulations contained in the Henrician Artic¬
les did not lie so much in their legislative excellence or in their comprehensive
and exhaustive approach to the political system of the Commonwealth (as this one
was still evolving) but in fact they were granted a specific constitutional function.
This function was to establish and specify norms regulating the functioning of the
main institutions of the Commonwealth such as the Royal Power and the Diet of
the Commonwealth; additionally, along these norms, it was attempted to sanction
the norms and regulations most important to the current political system as well as
to grant some political and social rights and liberties and constitutional guarantees
considered crucial for the constitution of the Commonwealth. This did not mean
introducing in the Articles some new regulations but describing in a more particu¬
lar and precise manner the already existing institutions of the Polish constitution,
such as free election, military levy in mass, or the Royal Council; this was to
constitute the fundamental principles of the constitution. From one point of view,
the real sense of the introduction of the Articles was to organise and settle the con¬
stitutional order, which was in a sense a close of a certain era in the functioning of
the system of the Commonwealth. From another point of view, the significance of
the Articles lay, through their formation as a specific system of rules, in their struc¬
ture; they were not of a fully cohesive nature in their content but still a concrete
collection of constitutional laws, which constituted a law of a more fundamental
nature. Formally, taken as a normative act, the Henrician Articles had a distinct,
precise character. Despite the changes to their normative form taking place since
passing the resolution of the Polish States on 2th May
1573,
the Henrician Artic¬
les were always viewed as an Act of particular constitutional importance. The
12th May
1573
resolution, together with the collection of the laws annexed to the
resolution and planned for the elect as a States of the Commonwealth proposal
concerning the principles of political system of the Commonwealth, was origi¬
nally prepared in the form of a monarch privilege, until the moment of bringing
the Articles as a law into constitutional practice, which finally took place after
the confirmation of the Henrician Articles by the King Stephen
Báthory
during
his Coronation Diet and through the publication in a legal acts of this Diet on 30th
May
1576.
The significance of the Henrician Articles, considering all the political and ide¬
ological conditions of their origins, and the expectations of their founders, is to be
examined in terms of it being an act of fundamental importance in the history of
Polish constitutionalism. In spite of the legal decisions the content of which was
deeply rooted in the previous era and focused on the preservation of the forms
and solutions adopted in the past, such as the free election, the institution of the

military levy in mass and a number of rights and freedoms fundamental for the
nobility, as well as on formulating new arrangements such as the guarantees of
religious tolerance, the appointment of senators-residents (a body of special regu¬
lar councilors setting up the grounds of the new constitutional regulations), the
resolutions of the Articles, constituting one legal act, acquired fundamental signi¬
ficance. Understood as such, the Henrician Articles established the basis for being
accepted as a formal fundamental law stating the main constitutional principles.
As a result of being perceived to be an act suggested by the Nation acting indepen¬
dently as a sovereign during interregnums, the Henrician Articles revealed, in spite
of their relatively short text, the most essential factor on which their functioning
was based, namely a contractual element on which they were founded. The Hen¬
rician Articles, being an act of a special constitutional meaning, composed a part
of political contract concluded, according to the contemporary understanding of
constitutional relations, between the Nation, representing the People and the Com¬
monwealth, and the elected king, who, during his Coronation had to first accept
the conditions settled in the time of his election, to become a king with full rights.
The political and legal grounds of the monarch election were therefore the legisla¬
tion of the interregnum period,
1572-1573,
containing the norms of a contractual
law. These norms, then accepted by the king elect within the agreement concluded
with him, opened a new chapter in the development of political and constitutional
relations in the Commonwealth. The commitment of the elected king to adopt
and confirm the constitutional articles, the Henrician Articles, contained also the
arrangements of the so called
pacta
conventa, a
private legal agreement betwe¬
en the States of the Commonwealth and the king elect, which, at the same time,
composed for the elected monarch
sui
generis, the program of his reign in the
Commonwealth. The Henrician Articles, formally depicting the concept of power
dualism, which, in accordance with the contractual character of the state relations,
had to be, in general terms, an element of the consensus to decide about the politi¬
cal and constitutional relations of the nation with the ruler, expressed new tenden¬
cies in the origin and formation of the fundamental acts in the political system of
the Kingdom, and provided evidence for high levels of political consciousness. In
this way the content, character and the meaning of this act opened the road to new
system solutions, proper constitutional acts known in Europe in later times. Thus,
in the constitutional sense, the Henrician Articles, as a political and constitutional
act, built a unique bridge connecting different eras demarcated by the development
of the legal forms of the European principle acts. From the very beginning, since
the moment of their coming into force, the Henrician Articles, being a result of
a political compromise concluded during the interregnums, played a specific poli¬
tical and constitutional function in the history of the Polish Commonwealth. Their

binding force and application as a fundamental law was determined by the circum¬
stances and political realities of the posterior era. It was, however, the current poli¬
tical practice that was the decisive factor in respecting and applying the Henrician
Articles. They, as a collection of the constitutional laws regulating the fundaments
of the political system of the Commonwealth, played an important role in the
second half of 16th and first half of 17th century.
The Henrician Articles, despite the arguments that their resolutions were viola¬
ted, were a constant element of common political consciousness. They were refer¬
red to as to the rules forming the fundaments of the political and constitutional
order of the Commonwealth, often pointed as being disregarded by the kings. This
led to quarrels and conflicts between a nation and the ruler. In each of these cases
it was the fundamental character of the Henrician Articles, established during the
election of the king Henry of
d Anjou
in
1573,
that was brought up as the basic
act of the Commonwealth. The permanent inclusion of some of the points of the
Articles into the
pacta
conventa,
which took place during the election of the King
Ladilaus 4th
Vasa
in
1632,
did not change the status of the Henrician Articles as
a fundamental constitutional Act in the Commonwealth, but through the process of
consolidation of some resolutions of the Articles in the
pacta
conventa,
had only
strengthened the binding force of these points that in this way acquired a character
of a regular constitutional instrument, equipped with the resolutions permanent in
force.
It was not until the second half of the 17th, when the political situation changed
and the main power centers, the king and the Diet of the Commonwealth, weake¬
ned that the importance of the Henrician Articles in political and constitutional
practice of the Commonwealth was reduced.
The Henrician Articles, indeed not rescinded, remained to be a strong element
of the Nation political consciousness. They were not forgotten as the laws con¬
taining fundamental solutions to the system of the Commonwealth, despite the
fact that some of their institutions and principles were not followed or they were
selectively applied. Yet, the Henrician Articles maintained their position of an act
regulating the fundamental constitutional law, despite one alteration made to the
political system of the Commonwealth in the form of the so-called Cardinal Laws
passed in
1768
whose role was to designate special laws which, in accordance
with the cardinal laws, made the system of the Commonwealth remain unchanged
-

facto to the end of the Commonwealth in
1795.
