SUMMARY
Bosnia and Herzegovina, due to internal ethnic split under influence
from surroundings, hardly achieves political, economical, legal and administrati¬
ve criteria for
EU
expansion from Copenhagen and Madrid. That is why Interna¬
tional Community would try harder and apply specific mechanisms to motivate
BH leaders to move and realize reforms, being prerequisite for BH step ahead
towards
EU
membership.
Having on mind mistakes of „omission" or „wrongdoing" done by European
Union
(EU)
and other international factors with regard to pre-war, war and post-war
crisis, in actual integration process,
EU
has special obligation to help BH integration
into
EU
membership.
EU
is responsible for large space left for nationalist's activities
by Dayton Agreement, hindering necessary integration and transition reforms. There
is present or is being developed conciseness on additional
EU
responsibility towards
BH, as outlined in European Parliament by Polish Representative Richard Chernecky:
„We should be ashamed because of war and atrocities committed. And what has
EU
done that time? It was silent. BH was left on its own. Now we have to help it to join
EU as
soon as possible, and do not see us encouraging it much."199
European historic experiences with wars between countries on its gro¬
und where hard and tragic, especially because of huge casualties and destruction
in XX-eth Century wars.
EU
emerge and European integration process is respon¬
se to negative experiences from clashes and wars, aimed to provide prosperity in
peaceful and safe environment. That is why
EU
has especial interest to remedy
political and development crisis in BH and its surroundings, to overcome peace
and safety hazards in the area of Western Balkan. Additional efforts
EU
would
put to make BH compatible to its political, economical, legislative and admini¬
strative criterions is actually effort to preserve and stabilize lasting peace and
safety at European ground.
Having on mind that political controversies in BH and its surroundings
are deep and conflicted,
EU
would have to be persistent and patient striving to
achieve goal of its expansion to Balkan. That is why experiences in modes and
conditions for clashes between countries overcoming, in process of interconnec¬
ting through European Union
(EU),
instead of fear from repeated hostilities to
provide its citizens with harmonized and prospective living ambient. This kind
of experiences would be applied through integration process management for
Bosnia and Herzegovina and its neighbors.
Economical needs and interests of European countries and peoples are
main cause for their interconnection, and European Union
(EU)
is form of high

scale organization for harmonization of mutual interests and goals. Realization
of economic interests and goals through European integration process world of
European citizens, peoples, States and their leaders is emancipated. Mythical,
ethnic, nationalist understanding and behaviors where passed over in favor of
higher degree of political integration, interconnections, identification of mutual
interests and goals. Stronger supranational position of
EU
Common Institutions,
efficient obligatory decisions making for its members, narrowing blockades and
obstructions. Actually, history of European integration process so far is history
of harmonization of separate, national, State and general European interests.
Therefore, just in dimension of decision making significant crisis where apparent
through European integration process.
Integration process symbolized by European Union, overpowers obstac¬
les apparent on the path of new federal association of States establishment.
Indicators proving that
EU
has passed good part of way towards joint State of
European citizens, peoples and States where: establishment of common mar¬
ket, legislative identity, unique currency, capability of joint Institutions to make
significant decisions by simple of by qualified majority of votes, veto narrowing,
capability to control decisions in conduct and to impose sanctions for omission,
affirmation of European Budget, respectable possibilities to use development
funds, common foreign and security politics, beginning of establishment of mi¬
litary and security identity, taking responsibility in crisis management (EUFOR,
EUPM, EULEX), people where identified as „European citizens", enlargement of
possibilities that „European citizens" directly or indirectly participate decisions
making. According to that, emancipation on the way towards efficient, modern
common State of „European Union" could not be stopped, though it is slow pro¬
cess. Disputes on
EU
Constitutional identity will probably be resolved, blockade
in that sense will be removed and all countries will ratify agreed
EU
Constitution
Draft. That would accomplish puzzle of still „unclear" political character of Eu¬
ropean Union.
Unique European Market is main driving mechanism of integration pro¬
cess, in which variety of political, legislative, environmental, customs, fiscal,
banking and other mechanisms where unified, as well as other mechanisms for
harmonization of common and individual interests. Unique market is basis for
economical and general social development of European peoples and States,
since via its mechanisms economical autarchy of segmented markets is resolved,
as expression of obsolete ideologies and politics. Unique market unify local and
regional markets in one entity, in which rules of conduct where established by
laws under principles of rule of law. In example of unique European market in¬
tegration apparent is mutual conditioning of political and economical system of
States, since in such process their market rules must necessarily be harmonized

with
EU
market legislative, which is obligation of their political factors in State
Parliaments. Access to unique European market understands making political
decisions to change economy systems and economy politics of countries invol¬
ved into European integration area.
EU
Laws become superior to national legisla¬
tive, and local and regional markets where exposed to control mechanisms, with
possible sanctions application.
Through European integration process, no one term related to role of
State does evaluate its character as „sovereignty". In this notion are most signi¬
ficantly emancipated political philosophy, ideology and practice. Through Euro¬
pean integration process controversy and harmony of contemporary and tradi¬
tional is mixed. Under excuse to protect „traditional" integration process could
be hindered, and under motives of „contemporary" harm could be caused to
national identity and tradition. That is why practice of harmonization is applied
to integration process, and not practice of exclusion, domination, negation and
monopoly, since citizens and peoples of Countries joining
EU
must swiftly feel
that their identity is not harmed, and that they gain in all aspects of life, from
freedom of movement through entire
EU
area, to higher individual and general
social standard and prosperity.
For BH and other Western Balkan Countries, integration i.e. transition
process include period of informal and period of formal activity to join
EU
mem¬
bership. Impact of International Community to development in BH before and
during the war, in broader view, had sense of preparation for its inclusion into
EU.
Another issue would be quality of such impact. Establishment of Conference
on Yugoslavia, opening of negotiations process and subsequent Cutillero, Vance
-
Owen and Owen
- Stoltenberg Plan,
and Contact Group Plan, and finally achi¬
evement of Dayton Peace Agreement where efforts of European Union
(EU)
and
other international factors to establish in BH and in its environment conditions
to commence formal procedure for their reception to
EU
membership. That pe¬
riod include entire
EU
engagement in post-war management to establish peace,
implement Dayton Agreement and stabilize political, economical and general so¬
cial circumstances. By application to join
EU
membership, formal procedure of
BH preparations and adjustment to
EU
standards commenced.
Dayton Agreement is political-legal frame of activities for BH preparati¬
ons and adjustment for acceptance to
EU
membership. Among number of hin¬
drances and obstacles to be removed in BH integration process, the most diffi¬
cult are these entered to BH Constitution, as part of Dayton Agreement. From
aspect of integration goals, BH Constitution is loaded with number of deviancies
and anomalies. That is why BH integration process is actually process of
dévian¬
ces
and anomalies removal in its constitutional and legislative framework. Since
the end of war, with significant
EU
influence, significant reforms where conduc-

ted in
BH,
which have already removed some of
déviances
and anomalies, which
could be taken as part of successfully passed way to integration preparations
and adjustment. However, the most significant part of the way, where largest
hindrances lay, is just to be passed. Starting prerequisite in this sense has already
been achieved, since BH has signed Agreement on Stabilization and Accession
with
EU.
Practically, signing this Agreement, relevant BH political factors have
promised to act to remove obstacles and make BH
EU
member.
Mood of citizens with regard to BH accession to
EU
is very positive, since
it is in their interest. However, BH citizens do not manage to elect and affirm le¬
aders capable to achieve compromise and consensus to speed-up constitutional
and legislative reforms under conditions of complex social and inter-ethnic con¬
troversies. BH citizens must be better-explained benefits from
EU
integration, to
make them more resolute in affecting political leaders to abandon nationalist
positions and behaviors, and to accept values and interests of integration. That
is why large role in BH is on civil society factors, which could, out of governmen¬
tal institutions and political parties affect them to behave responsibly towards
historical challenges of integration. It must be known what BH citizens and State
lack to remove blockades to integration process. It is rather clear that BH as a
State has no enough institutional capacities to conduct necessary reforms, i.e.
that existent institutional capacities where destructed from inside, by activity of
anti-reform leaders, being thus disabled to play role in realization of given
EU
criteria and values. It is also very clear that BH lacks bold leaders, and that actual
leaders, due to their nationalist loads, where incapable to comprehend essence
of their role.
No one criteria imposed by
EU in
context of its expansion is neither con¬
flicted to universal values of humankind nor opposing separate values and real
interests of particular ethnic groups or States. On contrary, criteria imposed by
EU in
process of its expansion comprise and connect harmonized universal
-
ge¬
neral, with separate ethnic, individual and State interests. Therefore, anti-reform
oriented leaders and political subjects in BH did not manage to close up values
they propagate to universal values of people and humankind in general. In terms
of value characteristics harmonization within activities of local leaders with value
characteristics comprised in criterions for BH joining
EU
membership, large role is
on civil society factors. They could and need to humanize political attitudes and
priorities, exerting influence to local leaders and make them refrain from anti-re¬
form positions and value, mostly nationalist projections of BH future.
These are also political and moral-ethic aspects of the integration pro¬
cess. Parliamentary Assembly, Council of Ministers and BH Presidency are points
where through democratic dialogue reforms could and must be given priority,
which would actually have character of confirmation of citizen's political eman-

cipation
and their representatives in governmental institutions. Though it could
seem as if anti-reform forces in BH institutions where stronger than pro-reform
ones, however, they finally will not be given a chance to prevail in favor of re¬
trograde, anti-civilization ideas and political attitudes. Political emancipation of
citizens, peoples, their leaders and variety of institutions is unstoppable pro¬
cess, for which patience must be exerted, especially in terms of resolution of
the key consequences of recent ideological, political and war conflicts. The most
severe and most harmful consequence is provocation and deepening of distrust
between people of different ethnicity and religions in BH. International Commu¬
nity, domestic political factors of reform orientation and elements of civil society
in BH do not take necessary and possible measures for renewal of inter-ethnic
trust in BH. This is more important BH renewal than reconstruction of devasta¬
ted dwelling, economy and infrastructure facilities in war.
Political and total social, moral and ethical emancipation in BH is not an
abstract obligation. Rule of Law enhancement, establishment of constitutional
and legislative framework according to
EU
standards, internal integration of BH
society, building and enhancement of common political, State, cultural, econo¬
mical, educational and other institutions and organizations are specific issues,
where actual generation of citizens, all peoples, their leaders, political subjects
and elements of civil society prove their emancipation, political mature, moral
and ethic responsibility towards their future.
Globalization issues are exceptionally important for BH integration pro¬
cess in adjustment to
EU criterions
and values. Building compact, humanized
and emancipated society in BH and its interconnections through regional am¬
bient of South-East Europe and Europe in whole, by adjustment and accession
to
EU
membership, means preparation of citizens, people and BH State for glo¬
balization challenges. To stay apart from
EU
integration process would mean for
BH to stay apart from unstoppable process of globalization. BH accession to
EU
membership must be considered organized inclusion into globalization proce¬
sses. Adequately, BH exclusion from
EU
membership adjustment process would
mean rejection of organized inclusion into globalization processes and acceptan¬
ce of spontaneous, passive exposure to negative aspects of globalization. By BH
accession to
EU
negative impacts of globalization could not be entirely avoided,
but could be blocked in organized, active and conscience manner, and enable
use of positive aspects of globalization for welfare of citizens, peoples and BH
society in whole. In globalization process, once it becomes
EU
member, BH co¬
uld apply many other instruments and possibilities of
EU
for protection of vital
national and State interests. Though not
EU
member, BH and its peoples and
citizens already use
EU
instruments for protection of their vital interests. Their
vital interest is peace and security. Without
EU
and international community im-

pact BH would not have peace and security. It is highest interest with regard to
existence, and it could be best achieved if BH adjusts to
EU criterions
and values,
preserving its traditional values.
BH adjustment to
EU
criterions brings huge development benefits to its
citizens and various subjects. BH could get instantly, without waiting, large fi¬
nancial funds in variety of forms of unreturned aid and getting very convenient
loans. It would be irrational to reject help from variety of
EU
funds and programs
for Western Balkan countries membership adjustment. BH must be capable to
consume
EU
readiness for its expansion. BH must not allow missing opportuniti¬
es offered with regard to financial and other help for its reconstruction and de¬
velopment in favor of retrograde, irrational attitudes and ideas. Having on mind
scale of devastation of dwelling, economy and infrastructure facilities, BH has
larger need in comparison to other countries in region to accept
EU
integration
criterions and adjust them to its needs, since international community demon¬
strate readiness to accept specific BH internal political and ethnic structure.
Protection of human and minority rights and freedoms in BH is espe¬
cially problematic issue. Strive for ethnic domination in BH is generator of bru¬
tal breach of human rights and freedoms. On the scene in BH there is practice
of ethnic based discrimination, and in some parts even with characteristics of
apartheid and segregation. Such situation is shame for modern humankind in
general, so is for
EU.
Reforms necessary in BH adjustment to
EU
criterions where
significantly related to cancellation of negative practice to breach human rights
and freedoms, extermination of discriminatory practice, apparent in some areas
in especially severe forms of segregation and apartheid.
BH will adjust
EU
criterions and become its member. That time in BH
there will not be „two schools under one roof
".
BH children will attend lectures
within same education groups, like colored and white children in
USA. As EU
member BH will not have territories, municipalities, cantons or entities being
exclusive „Serbian", „Croatian" or „Bosnian", but entire BH will be as guaranteed
by Constitution
-
equally „Serbian, Croatian and Bosnian". Each BH citizen will
have the same passive and active elections rights, which is not case now. Besides
BH citizenship, citizens will have
EU
citizenship. Their dignity will be respected
more than it is case now, when they cannot move free worldwide. BH citizens
will faster reach living standard of
EU
developed countries. Politicians, intellec¬
tuals and citizens will understand term of "sovereignty" in more contemporary
and emancipated way, and extend it to entire
EU
territory.
Benefits of BH membership to
EU
are huge. Brutal harm that would
occur by BH distancing from
EU
membership would be prove of totally irrational
attitude towards BH future, as State of equal people^and citizens populating it.
