Inventors, investors, and businesses want
their inventions to be protected in many, if
not most countries, but there is no single
patent that will protect an invention glob¬
ally. Despite attempts in international treaties
to simplify patenting, the process remains
complicated, lengthy, and expensive. Fur¬
thermore, enforcing patents in multiple
jurisdictions can also make the maintenance
of parallel patents infeasible.
In Global Patents: Limits of Trans¬
national Enforcement,
Markéta
Trimble
explains why the absence of a global patent
persists in light of the 140-year history of pat¬
ent law internationalization. Trimble analyzes
the ways in which patent holders attempt to
mitigate the problem, namely by attempting
to concentrate enforcement in one court or
to use litigation to reach outside of a country.
However, both the concentration of proceed¬
ings and extraterritorial enforcement suffer
from significant limitations. Global Patents
explains these limitations and analyzes the
solutions that have been proposed to address
them. The book includes a thorough compar¬
ative analysis of the extraterritorial features of
U.S. and German patent laws, and original
statistics on U.S. patent litigation. Based on a
comprehensive treatment of the various facets
of transnational enforcement challenges,
Trimble proposes the next stage of patent law
internationalization.
MARKÉTA
TRIMBLE is an associate profes¬
sor at the William S. Boyd School of Law,
University of Nevada, Las Vegas, where she
teaches intellectual property and conflict of
laws/private international law. Her research
spans patent law, copyright law, conflict of
laws, and internet law. She holds doctoral law
degrees from both common law and civil
law countries (Stanford Law School and
Charles University), and has practiced law in
the European Union and in a European gov¬
ernment. She is a member of the International
Law Association Committee on Intellectual
Property and Private International Law.
