d immigration et d asile de l UE
Migration is an
international
phenomenon. In spite of this, developing the external
dimension of the European Union s immigration and asylum policy has proved no easy
task. This volume comprises the contributions of experts that illustrate the difficulties that,
since the adoption of the Treaty of Amsterdam, have accompanied the emergence of this
dimension. The introductory chapters analyse the terms of the compromise reached between
the
EU
and third countries of origin or transit of migrants and refugees, and consider the
relationship between European immigration and asylum law, international law and human
rights law, as well as the role played by the Court of Justice of the European Union in this
relationship. The volume next addresses the complexity of the distribution of competences
between the European Union and the Member States in this area (visas,
readmission
policy).
A subsequent section examines the general instruments of the external dimension (mobility
partnerships) and undertakes a sector-by-sector analysis of the instruments pertaining to
asylum (e.g. regional protection programmes) and to migration (admission and status of
workers). The link between migration and development, which the
EU
is trying to strengthen
even while it fights against irregular migration and promotes the management of legal
migration, is also covered, in line with the latest developments in the external dimension,
namely the Global Approach to Migration programme which the
EU
adopted in
2005
and is
in the process of evaluating during
2011.
La migration
est un phénomène
international.
Toutefois, la mise en oeuvre d une dimension
externe de la politique d immigration et d asile de l Union européenne n est guère aisée.
Cet ouvrage regroupe des contributions d experts sur les difficultés qui, depuis le Traité
d Amsterdam, illustrent l émergence de cette dimension. Après une introduction dévoilant les
termes du compromis entre l Union européenne et les pays tiers d origine ou de transit des
migrants et des réfugiés, les relations entre le droit européen de l immigration et de l asile, le
droit international et les droits de l homme, ainsi que le rôle joué par la Cour de Justice dans
leur agencement, sont traitées ainsi que la complexité de la répartition des compétences
entre l Union européenne et ses Etats membres dans ce domaine (visas et réadmission).
Suit une étude des instruments généraux de la dimension externe (partenariats pour la
mobilité), et une analyse sectorielle de l asile (programmes de protection régionale,...)
et de l immigration (admission et statut des travailleurs). Les liens entre migration et
développement que l Union européenne tente de nouer à côté des volets de lutte contre
l immigration irrégulière et de gestion de la migration légale sont intégrés, suivant ainsi les
derniers développements de cette politique externe que l Union européenne a baptisée
«
Approche globale des migrations
»
en
2005
et se prépare à évaluer en
2011.
