It product became an undissolved nobility committed to the principles of humanity and chivalry, it has developed through peoples moral plasma and state organism into a grandiose form of liberty, creative spirit and freedom oriented drama where all traits of human character were at constant test on the stage of endless knightly tournament of people and collective attributions of communities build up out and tailored according to rigid laws of moral values and virtues. 471 The utmost cause of such dramaturgy through centuries were man s freedom, man s dignity and equality of all men, regardless of their national, so¬ cial and philosophic views, their social standing or origin; moreover, such dramaturgy has forged and systemized notions, categories and institutions in the field of juristic ethos based on the pillars of freedom, moral, customs, justice, right and courage man-centred and human-centred life criteria, unveil¬ ing the phenomena of nature and spirit of common laws, and its most beautiful reflexion acquired in the multiethnic and multi-confessional mirror of Mon¬ tenegrin life. Finally, all ofthat has yielded persistent incentives and unending beauty of social and cultural heritage of Montenegro. This is why the Court, as an institutionalized phenomenon of justice did not rise only out of justice itself, as a place of origin of the law, but also out of moral - the most reliable thermom¬ eter of health of social life, dressed up in the robes of dignity and humanness, a moral pillar of human be¬ ing, since legal norms are, as quoted by Habermans, „worth because they morally abide, because if they were insulting for their sanctions they would have not been abiding but enforcing to submissiveness. That is how human rights rest on moral vision of human nature which basically means admission of every human being as equal and having equal rights. That is Montenegrin moral codex expressed by a maxim: Man is the true God and Saviour of Man, The more Man you are, closer to God you are; „Čojstvo is ability to defend others from yourself; Even what is not forbidden may not be honest (OIZ, 999) „Even in 472 pursue of the law do not be too persistent (OIZ, 1014). In this way the judge as a human being, Kant points out, has to, „Serve Mankind as general purpose . Thus customary-legal norms, moral codex and written Montenegrin laws have become the expression of ra¬ tional conception of natural law, which Sula Radov - Montenegrin labourer, captain, ethicist, wise man, leader and hero without any knowledge of scholastic messages of European Rationalism led by Kant and his thought that laws are discovered through postu¬ lates: „Laws exist, they are not prescribed, they must be protected ; „The law that does not protect justice is not a law Without such knowledge of the true nature of Montenegrin system one could never become a judge! This awareness of such a noble approach to justice shone brilliantly for centuries penetrating into peoples legal consciousness. „Sessions of such justice executors , as said in his addressing speech during the promotion of judicial reforms of 1902, Montenegrin Prince Nikola I Petrović said „shone with its witty and sound reason of a highlander, pride of the House and the Tribe, shone with wonderful foïk costumes and glow of arms, you shone with inherited eloquence and justice, if not so our knight camp would have never existed . Law as a cultural phenomenon and phenom¬ enon of peoples life is a creation of human spirit and historical verification of wisdom for the sake of maintaining the culture of life. In his work „Slavic common laws , dr Valtazar Bogišić says: „Montenegro is an original legal phenomenon that has transformed customs into a comprehensive system of common law, so the priority task of history is to prove identity of people 473 and identity of folk customs, where the best evidence is the common law firmly rooted in the spirit of common people. Ethos as general substratum of the spirit of one people, is made of not only out of the product of living generations and their system of thinking, culture and life, but also out of the passed generati¬ ons as outstanding triggers left to heritage that de¬ fines their identity in a diverse culture. That s how our predecessors represent everlasting guardians of moral and consistent part of forces preserving and protecting cultural property as a duty imposed on human kind. That s why spiritual and moral force of Montenegrin and legal monuments, its institutions rest in special legal culture that has outgrown space and time, because they were produced by а sound wit, bright mind, honest heart and word of honour, shaped the best and wisest sons of Montenegrin people, and history handed them over to its posterity as an eter¬ nal endowment. The Code of Ivan Crnojević, known as „Code of Tsar and Patriarch the right of refuge - place of safety or the right of exterritoriality was established confirming the ecumenical character not only of its creator, but of Montenegrin State as an open and free society of universal and undivided freedom. That is why this Code is a monument to freedom opposite to European Medieval Inquisition. Philosophical- legal foundation of this institution known under the modern name - the right to asylum, had been formulated by Petar I Petrović, Bishop and Ruler of Montenegro, her legislation author, priest, military 474 commander, free man and polyglot gave her univer¬ sal values of general mankind character so that this institution draws its force from moral springs of life based on the respect of dignity of a man as an indi¬ vidual: „Cursed be every fellow Montenegrin who would deliver a refugee on faith to the unfaithful from this land. Whoever steps on this soil regardless of his origin or Tri¬ be, must be free and is free but not enslaved again after he had escaped from slavery to search for freedom. Our Door of Freedom shall he open forever to any freedom seeker. In a customary-legal codex of our compatriots Albanians - the Code oí Leké Dukagjini (Kanuni і Lekë Dukagjinit), that is founded in the holy institu¬ tion of Besa, which many renown sociologists deem to be the most noble institution of human kind, the right of refugee (place of safety) was warded: „Open the door to the fugitive, and close door to the chaser. Montenegrin legal heritage, as the most exalted guardians of our memories keep watch over our di¬ gnity, enlightening endeavours of our previous gene¬ rations and our cultural heritage through tempestu¬ ous and distant past of Montenegrin history giving the identity to a people and differentiating it from others» That s why the following thought was carved into a Hellenic monument: »People that fails to safegu¬ ard its historical memory, is condemned to extinction. From many a century Montenegrin State- Legal History and organization of its jurisdiction, from Doclean Methods, Bar s Chronicle, Kotors 475 and Budvas Statute, over the Code of Ivan Crnoje- vić (1482), customary courts, Stega (1796), General Montenegrin and Highland Code (1798), General Montenegrin Code (1855), The General Proprietary Code for the Princedom of Montenegro (1898), Great judicial - Nikoljdan Reforms (1902) and Constituti¬ on of the Kingdom of Montenegro (1905), from the top judicial instances: Court Council oí Montenegro and Highland (1798), Ruling Senate oí Montenegro and Highland (1831), over the High Court of Justi¬ ce (1879) to Supreme Court (1945) - that treasure the oldest and the most famous tradition of Monte¬ negrin State-legal history, up to the present day - la¬ sts an uninterrupted tale of Montenegrin judiciary, woven out of history and reality, legend and reality, wisdom and pragmatism, past and future vision, tradition and modernity, customary laws up to wri¬ tten laws, trials based on justice and on „soul and consciousness to trials based on Constitution and Law and principles of international law, Montene¬ gro found herself in the vestibule of the enormous changes where she entered with its whole social structure opening the new chapter of Montene¬ grin History embedded into European rationalist thought, her civilization and culture carrying into it as precious gifts of its identity and cultural he¬ ritage, but integrating herself into a general flow of cultural and legal norms of enlightened peoples that committed to the cause of raising the human kind into a single gigantic planetary community of mankind. 476
