IN CROATIA: CENTRAL STATE INSTITUTIONS IN TRANSFORMATION
SUMMARY
In the period of instability in the Hapsburg Monarchy, started by the Vienna re¬
volt in March
1848,
the central authorities in Vienna accepted the demands of the
strongest, Hungarian national movement by which Hungary achieved independence
in the form of a personal union with Austrian lands, and the Hungarian Parliament
pronounced Croatia an integral part of the unique Hungary. The Croatian national
movement disclaimed the legality of the Hungarian parliamentary laws and, along
with the formal opposition of the Imperial Court, took over the traditional central
political institutions originating from the estates system and then put through social
and political reforms. The Ban (Viceroy)

Josip Jelačić
took over
the duty of Ban
-
was part of the traditional Croatian political system and in the new
system remained an independent political factor, standing at the head of the legi¬
slative and executive administration. The Ban also became the commander of the
army in the civilian Croatia and the Croatian Military Border. The
Sabor
that
Jelačić
convened was not any more the estates
sabor
but a body of representatives elected
on the basis of the citizens' equality. However, in accordance with the principles of
early liberalism, the right to vote was limited to a high means and education census.
The
Sabor
abolished serfdom and started working on reforms that were supposed to
form modern institutions of civil society in the area of administration, judiciary, edu¬
cation and military system. It severed former relations of Croatia with Hungary, and
opposed to the programmes of the creation of great Germany and great Hungary the
programme of the so called Austro-Slavism that envisaged the preservation of the
Hapsburg Monarchy and their reorganizing on the principles of federalism. The uni¬
ted Croatia (the united historical territories of the Kingdom of Croatia,
Slavonia
and
Dalmaţia)
was to be one of these federal units. The Ban
s
council
(Bansko vijeće)
within the traditional political system was a body that was occasionally convened,
while
Jelačić
and later the
Sabor,
too, turned it into the authority in charge of all ad¬
ministrative works except those that had to remain in the jurisdiction of central state
institutions in the framework of the federalist regime of the Hapsburg Monarchy.
However, the Ban's Council was not responsible to the
Sabor
but to the Ban.
Due to the expected war against the Hungarian government the
Sabor
postponed
their sessions but it never assembled again. Yet, its boards and committees continued
with the preparation of reform laws. Since September of the year
1848
Jelačić
stayed
permanently on the battlefield in Hungary, though he held intensive communica¬
tions with the Ban's Council that had also been preparing legal acts. Since March of
the year
1848
and the proclamation of the Octroi constitution, and then reinforced
after the collapse of the Hungarian revolution in August
ofthat
year, a pressure was
set on the Croatian central institutions with the aim of subduing them to the central
institutions of the authorities in Vienna in the framework of the centralistic system.
Till the middle of the year
1850
Croatian independent central political institutions
created in the year
1848
ceased to exist. The
Sabor
was convened no more and the

Ban was given the role of the imperial Governor
(Statthalter).
The Ban's council was
dispersed and instead of it Ban's administration was established, with departments
submitted directly to the ministries of the central government.
The Croatian movement from the year
1848
took over the traditional central
Croatian political institutions and replenished them with new contents. It gave them
the form of institutions of societies based on the principles of citizens' liberalism
and simultaneously as institutions that secured for Croatia an independent political
position in the framework of the Hapsburg Monarchy. Under the onrush of central¬
ism and later absolutism, these institutions stopped existing or were submitted to the
central government in Vienna. However, in the second half of the 19th century, the
Croatian social elite continued, with varied success, to fight for the independence of
Croatia and the building of institutions of modern society.
