SUMMARY
With the Statute on autonomous rule of Islamic religious, endowment and edu¬
cational affairs in Bosnia and Herzegovina, sanctioned by the Austro-Hungari-
an ruler in
1909,
a new era in religious and cultural life of Bosniaks began.
After several years of the imposed governance, missing people's support, the
Islamic community in Bosnia and Herzegovina transformed into a first-rate and
unique
Bosniak
and Bosnian Muslim national institution, as an authentic expre¬
ssion of
Bosniak
tendency to determine their religious, educational and social
being, without anyone's pressure and tutelage.
During the last four years of the Austro-Hungarian rule, the Islamic com¬
munity in Bosnia and Herzegovina faced different problems
-
the personnel,
the organizational, the financial ones, conditioned by the war difficulties, as
well as the new concept of its activity after the proclamation of the autonomous
statute. The ambitious project of the Muslim educational system reform in Bo¬
snia and Herzegovina faced many obstacles during the wartime. Communicati¬
on problems, financial difficulties, resistance from the ground
-
represent some
of the major causes of partial reform of the Muslim religious education in
1914-
1918.
From the other hand, strengthening of the reformist elements in the Isla-

mic
community leadership had led to the development policy significantly fa¬
vouring secular education among Bosniaks, the fact that provoked the reaction
of the socially endangered religious teachers
-
muallims. Nevertheless, the cen¬
tral ww^w/management used the advantages of the obtained autonomy in a way
it considered to be the best for the
Bosniak
national interests, still without being
able to become aware of the overall potentials of the community and, on the
basis
ofthat
insight, to design a comprehensive program of its development in
the framework of modern historical processes.
By obtaining their religious and educational autonomy
(1909),
Bosniacs
reached the opportunity to develop their spiritual and cultural identity, but the
political and national issue was still unsolved. In the newly established King¬
dom of Serbs, Croats and Slovenes they were recognised only as an individual
religious community, not as a separate people or nation within the new national
and political framework. Their position was additionally deteriorated due to the
violence and crimes perpetrated over them by local Serbs, mostly peasants,
robbers and volunteers. When the rais al-ulama
Džemaluddin
eff.
Čaušević
tried to attract the international attention towards the unfavourable state of Bo¬
sniaks, his move provoked negative reaction of the state officials who even
proposed his retirement. The violence and atrocities had induced new political
organization of Bosniaks, which had indirect impact on the Islamic community,
since the political leaders and activists took control over the highly important
wuquf structures.
The Kingdom of Serbs, Croats and Slovenes legalized the Statute from
1909.
but the question of legal state and organizational system of the Islamic
community was not definitely solved. The Council of Ministers of the King¬
dom of Serbs, Croats and Slovenes
(1918-1929)
did many attempts to accom¬
plish both legal and organizational integration of Muslim religious community
in Bosnia and Herzegovina with those in Serbia, Montenegro and Macedonia.
The first legal base for that unification should have been the document entitled
The Statute on rule of Islamic religious, educational and endowment affairs in
the Kingdom of Serbs, Croats and Slovenes. Its basic elements were written in
the Ministry of Religions in the midst of
1919.
and delivered to distinguished
Muslim scholars for evaluation all over the Kingdom. However, Muslim religi¬
ous authorities in Bosnia and Herzegovina, especially in Sarajevo, did not
approve this method of work, insisting on their sovereign right to treat their
existing autonomous statute independently of the state. The whole project fai¬
led due to the lack of support of Muslim politicians and religious authorities,
but also to the fact that the government was soon replaced including personal
changes in the ministry which had been its initiator.

SUMMARY
The recognition of the Muslim autonomous statute did not mean a consi¬
stent respect of duties the state was supposed to assume regarding the statute's
regulations. One of the most evident examples of violating the autonomous
statute was paying the Muslim religious grant, instead of the Islamic communi¬
ty, to the Main Board of 'Gajret'. Avoiding of already taken obligations and
usurping the competencies of Islamic autonomous structures was a reliable in¬
dication that the state authorities were highly dissatisfied with the existing or¬
der and position of the community, especially the role led by the dominant
Bosniak
political party in the endowment and educational structures, from local
religious community
-jamat
-
to the Wuquf assembly.
On the other hand, the leading
Bosniak
party was predominantly intere¬
sted in stregthening its influence in the Islamic autonomous institutions, expre¬
ssing lack of sense for responsible leadership in financial and educational ma¬
tters, which brought the community in extremely unfavorable situation. The
additional factor of deterioration was coming from the fact that JMO had spent
most of the time in the twenties confronting the Belgrade regime, which was
trying to weaken the
Bosniak
party through the Islamic community.
The social, economic and cultural processes in the Kingdom of Serbs,
Croats and Slovenes were constantly encouraging the Islamic community in
Bosnia and Herzegovina to accept a new understanding of Islam and religious
life of Muslims. But when the rais al-ulama
Džemaluddin

Čaušević
had
finally opted for a new alliance of the
ulama
and intelligentsia, for a more con¬
temporary wuquf politics and educational emancipation of
a Bosniak
woman
-
it was a brave voice of a religious leader confronted by a strong unit of con¬
servative religious scholars and cautious
Bosniak
politicians. Only a small
number of religious modernists and secular intellectuals supported him and that
was a clear evidence that the Islamic community was still not ready for a su¬
bstantial reform at the end of the twenties.
By the establishment of the Sixth of January regime in
1929.
substantial
preconditions were provided for the change of legal position and organizational
structure of the Islamic community in Bosnia and Herzegovina. Since the
Vi¬
dovdan
constitution had been abrogated, there were neither legal nor political
obstacles for the abolition of the Islamic religious and educational autonomy.
The authorities of Yugoslavia were finally unfettered to arrange the Muslim
religious question in accordance to their optimal interests and ambitions. The
dissolution of political parties, in the case of the Islamic community, led to the
systematic removal of the JMO leaders and members from its organs and bodi¬

structures. At the same time, the doors of the Islamic community were opened,
thanks to the Minister of Justice Milan
Srškić,
for secular intelligentsia and pro-
regime
ulama
-
prominent opponents of Spaho's party during the twenties, with
obvious intention to build a loyal religious administration through which the
state would control the Islamic community, but also, indirectly, the political
and social mood of Yugoslav Muslims. The popular and highly respected rais
al-ulama
Džemaluddin
eff.
Čaušević,
being uncapable to improve the new legi¬
slature of the community, chose to resign from his position, which helped his
opponents to choose Ibrahim eff.
Maglaj
lie for the new rais al-ulama of the
unified Islamic community of Kingdom of Yugoslavia.
Maglajlić,
along with
the new imposed administration, contributed to the construction of the Islamic
community

octroyed system of governance and management of Islamic affairs in Bosnia
and Herzegovina.
The most important feature of the organization and work of the Islamic
community after the establishment of the Sixth of January regime was its tran¬
sformation from a relatively democratic community into a hierarchically consti¬
tuted organization under the leadership of high
ulama.
This system had its advan¬
tages, since the new management, protected by the state, had enough time to de¬
vote itself to highly significant issues of legal system building and religious edu¬
cation improvement. But at the same time, the new administration, thanks to
inescapable conflict between the religious traditionalists and secular modernists,
missed the chance to continue with reformist tendencies initiated by
Džemalud¬
din
eff.
Čaušević
and his supporters in the late twenties. The majority of moder¬
nist elements left the Islamic community administration disappointed with unwi¬
llingness of Salim eff.
Muftié
and other traditionalists to build a new community
open to cultural and national values of the Sixth of January Yugoslav society.
Passing the Decree with legal strength on changes and amendments in the
Law on Islamic religious community of Kingdom of Yugoslavia on

was a consequence of political agreement between Milan Stojadino-
vić
and Mehmed Spaho concerning the entering of JMO into a new Belgrade
government
-
a highly significant event which, for a whole decade, defmied the
legal status and organizational structure of Islamic community in Bosnia and
Herzegovina. The Decree abolished the set of laws from
1930,
dismissed the
existing religious and wuquf authorities and renewed the autonomy of the com¬
munity. A new concept of organization and management was introduced
-
lai-
cism, with the dominant role of secular elements in the Islamic community. The
professional
ulama
was marginalized and politicians ideologically attached to
JMO became promoters of the new regime.

SUMMARY
The main figure of the new establishment was Fehim Spaho, Mehmed
Spaho's brother. Fehim Spaho did not have a professional religious career, his
moral profile was far from laudable, but nevertheless he faced no obstacles in
becoming the new rais ul-ulama of the Islamic community in Kingdom of Yu¬
goslavia. Spaho's arrival in the Islamic community, along with the new consti¬
tution his arrival enabled, was a consequence of extreme politization of the
community. However, the results of the previous administration produced
assumptions for a new religious and educational initiative. The relationship
with state officials were significantly improved, the normative activity was
continued, new impulses to religious education and combating illiteracy were
given. On the other hand, the new administration proved itself incapable of
approaching Islam without the legacy of formalism and traditional attitudes.
The period of the first Yugoslav state was a turbulent time for a religious
community which, considering a great power of state, directly depended on
political events affecting life of social groups and institutions. Reduced materi¬
al revenues, existing prejudices and conservative views, political and cultural
conflicts
-
these were the additional ballast halting its unhindered development.
In such circumstances the main priority of the Islamic community in Bosnia
and Herzegovina was only to maintain the existing religious, cultural and soci¬
al realities, rather than their revision and transformation. Other objectives ma¬
inly depended on decisive individuals' initiatives, who were aware that repea¬
ting the existing realities was an insufficient guarantee for a long-term progress
of Bosniaks and their faith, conditioned by the political, cultural and social
changes in their closer and wider environment.
