Legislation in Bulgaria
(1880-1999)
The subject matter of the research is the Development of social security legislation in Bulgaria
from
1880
till
1999.
From critical point of view a big amount of normative legal acts is reviewed and
attention is paid primarily to statutes. The general and specific peculiarities of statutes and the
other normative acts are taken into consideration and their interconnection with the whole system
of the social security legislation of Bulgaria through different periods of time.
In the research the foundation and development of social security legislation in Bulgaria is
reviewed in its entirety and variety. The foundation and development of separate legal institutes of
the social security legislation are considered not independently, but in the context of the different
statutes and other normative legal acts. Social security legislation is divided in different periods in
accordance with the range of insured persons and their social security legal protection meaning at
whose expense the contributions are due as well as the presence or absence of social security funds.
The work comprises preface, six chapters and conclusion.
Chapter
1
deals with the questions of social security legislation in Bulgaria for the period
1880-1904.
The Law on improvement of the situation of impoverished combatants in different
movements for our liberation and the families of those died in them
( 1880)
lays down the foundations
of social security legislation in Bulgaria. The Law on disabled contents
(1880)
deals with the matter
of pensions and aids for disabled persons on civil service and thus begins the recognition of the
risk disability as an insured one.
The Law on disability pensions for military persons
(1886)
lays down the conditions for
acquisition a right on money aid and right on personal pension for military disability and inheritance
pensions for military disability.
The above mentioned statutes introduce the State pensions.
In
1887
with the Law on disability contents of administrative-police officers lays down the
conditions and the procedure for acquisition of State aid and pension for disability of administrative-
police officers and inheritance pensions for disability.
The Law on teachers' pensions
(1888)
introduces the fund principle of social security in
Bulgaria. This principle is enlarged with the Law on pensions and temporary aids of priests
(1889),
the Law on pensions of military persons and servants at the military department
( 1890)
and the Law
on pensions of officers and civil servants at the civil department
(1891).
In the period
1880-1904
the foundations of social security legislation in Bulgaria are laid
down and more exactly
-
the foundations of pension security of State servants and servants who
had worked at State and municipal institutions. The legislation during the said period introduces
and enlarges the financial system of the means for payment off the pensions for served time.
In Chapter
2
the period from
1905
to
1926
of social security legislation in Bulgaria is embraced.
At statutory the foundations of social security of hired workers in Bulgaria are placed and developed.
The first statute in this line is the Law on women and children labour in industrial enterprises
(1905).
Afterwards the following statutes are adopted: the Law on aid fund of workers from public

establishments
and the privileges for their wages
(1906),
the Law on facilitation of State workers in
case of disability and illness
(1909),
the Law on union of workers' insurances
(1915).
Until
1918
the social security of workers in Bulgaria was constructed in pieces, with interruption
and embraced certain categories of workers.
The Law on insurance of workers and officers in case of accident and illness
(1918)
introduces
for the first time the compulsory social security of all workers and officers in State public and
private enterprises and establishments who had received less than
2400
leva per year (on the
current rate of leva by that time).
The Law on social security contributions
(1924)
introduced mandatory insurance for the
social risks accident, professional illness, general illness, maternity, disability, old age and death
for workers and officials in State, private and public establishments and enterprises to whom no
deductions of the salary had been made according to any pension law. For this purpose the Social
Security Fund was established. The said Law repeals the Law on social security of workers and
officials in case of accident or illness
(1918).
The Law on allocation of work and insurance against unemployment
(1925)
officially
recognizes as insured the social risk unemployment.
Along with the creation of social security legislation for workers and officials the pension
legislation of servants at elective departments was introduced and elaborated starting from
1909.
With the Law on pensions of officials at State and elective departments
(1921)
the legal regime of
pensions of officials at State and elective departments was unified. For this purpose a Pension
Fund for officials at State and elective departments was established. The disability pensions of
these categories of persons was at the State budget's account.
In Chapter
3
the topics of social security legislation in Bulgaria for the period
1926-1945
are
under review. During that period certain statutes on pensions for served time and disability pensions
were adopted.
With the Law on pensions for served time
(1926)
encompasses not only officials at State and
elective departments, but also clerical persons. The said Law consolidates the Pension fund of the
clerical persons at the department of the Bulgarian orthodox church and the Pension fund of the
officials at the State and elective departments. The unified fund was called Pension fund for served
time.
The Regulation-Law on disability pensions
(1938)
includes in its range categories of persons
who had not been on paid State or elective job. The disability pensions were paid off by the State
budget means.
During the period
1926-1945
several social security laws were adopted. For example Regulation-
Law for allocation of work to unemployed persons with secondary or higher education, Regulation-
Law for pensions of artists-members of the Union of artists in Bulgaria, Regulation-Law for insurance
of artisans, Law on insurance of intellectual workers, law on pensions for served time and disability
of officials and workers at the State mines, Law on pensions of farmers.
The Law on Social Security Institute
(1941)
is the first organizational law on social security in
Bulgaria.
For the period
1926-1945
the legislator had amended and supplemented several times the
Law on pensions for served time, the Law on social contributions and the Law on allocation of
work and insurance against unemployment. Characteristic traits of the social security of the said
period is the ungrounded enlargement of the scope of insured persons and therefore
-
a financial
uncertainty of the pension funds.
In Chapter
4
the questions of social security legislation during the period
1945-1951
are
tackled. During that period a gradual legislative equalization of the rights of workers and officials

with those of State officials in the field of social security. Along with this the conditions for
acquisitions of personal pension for old age, people's pension for disability and hereditary people's
pension were set at legislative level.
The Law on deprivation of right to pension of persons with fascist activity was adopted.
The legislator introduced a rule that the contributions due by the worker or official are at the
employer's account and had to be paid by him. This rule was effective since February 1st
1948.
The principle of mutuality was introduced
-
between the pensions for served time fund and
the funds of the Social Security Institute. After the introduction of the said principle the calculation
of the whole time the worker of official had worked was counted as a served time no matter in what
establishment or enterprise he had worked.
In
1949
with the adoption of the Law on social security the legal regime of social security was
codified. For the realization of the social security a special State Institute of social security was
founded.
In Chapter
5
the questions of social security legislation during the period
1951-1989
are
considered. That period is very dynamic and not always consistent and expedient from
contemporary point of view.
In the Labour Code
(1951)
the legal regime of social security relations was included. In
Chapter
3
of the Labour Code the social security relations of workers and officials are laid down.
The short-term social insurance (right to money compensations and aids) as a whole was set in the
Labour Code.
With the Labour Code a significant part of the legal regime contained in the Law on social
security was repealed. In other words the codification framework of the social security relations
included in the Law on social security was in pieces not in accordance with the following statutes
and ordinances. The State Institute for social security was replaced by Social Security Directorate
and Pensions Directorate.
By ordinances of the presidium of the National Assembly in
1953
the conditions for
acquisition of pension right of aviators from civil aviation, recognition of labour length of
service for pension of tobacco workers and persons dismissed due to their antifascist activity,
for social security and pension of culture figures, for mutual insurance of members of labour
productive co-operatives.
The Law on pensions of agricultural masters co-operators
(1956)
introduces the social risk
„old age" as compulsory for all men and women agricultural masters co-operators who have
reached the age of
16
years. Moreover the agricultural masters co-operators did not make social
security contributions. With the Law on pensions
(1957)
the legal regime of pensions was extracted
from Chapter
3
of the Labour Code. That Law repeals the Ordinance of the presidium of the
National Assembly for special merit pensions and people's pensions. In this way a significant
unification of pension legislation was achieved.
The revocation of the Law on retirement of agricultural masters co-operators from July Is'
1975
leads to application of the Law on pensions to them.
Chapter
6
deals with the problems of social security legislation during the period
1989-1999.
That period is characterized with the replacement of payment of social security contributions at
the employer's account and participation of the insured workers and officials.
In
1995
the Law on Social Security Fund was adopted and it marked the beginning of the fund
principle in social security since
1997.
This law established National social security Institute and
it dealt with the State social security means.
The free medical aid was abolished and social security contributions at the insured persons'
account were introduced. In
1998
the Law on medical social security was adopted.

Unemployment was recognized as an insured social risk and included in the social security
legislation.
The complementary voluntary pension social security and the complementary mandatory
social security were introduced in legislation. In
1999
the Code on mandatory social security was
adopted in order to respond to the requirements of the market economy.
