Constituţional
democracy is a latecomer to the political landscape of
Namibia. Leading up to the country s independence in March
1990,
it became a constitutive part of a complex international framework
that guided the transition from war to peace, and from oppression
to multiparty democracy. Namibia s constitution is hailed as one of
the most modern basic laws on the globe with its Bill of Rights, the
separation of powers and democratic order. As the supreme law of
the land, the constitution guarantees the rule of law in Namibia and
is the normative guideline for all citizens as well as the legislators, the
judiciary and the government of Namibia.
This timely and reflective book offers nuanced and penetrating
analyses of democratic life in Namibia after the first two decades
of independence, statehood, and nationhood. The different offerings
explore three principal themes:

Constitutional Democracy and Good Governance
•
The Genesis of the Constitution of the Republic of Namibia, and
•
Challenges within the Namibian Constitution.
After a discussion of the construct of constitutional democracy and
its implications for governance, the forerunners, the context and the
drafting of the Constitution of the Republic of Namibia are discussed,
along with the legal philosophy that infused the Constitution and its
principles with meaning. The development of the Constitution since
Independence is investigated next, with a view to its wider implications
for state- and nation-building. Finally, particular constitutional provisions
are critically analysed from the point of view of their formative role
in policy and legal domains. These include environmental rights and
justice, the paradigm of equality and its
actualisation,
and intellectual
property rights.
