SUMMARY
The subject matter of legal customs, i.e. customary law is analyzed and
reviewed by using a broad comparative method, in order to show that in many
instances the rules and institutes of unwritten or customary law, which have
been developing spontaneously throughout the history, were in some ways of
similar character, although created in different parts of the world. This phe¬
nomenon is undoubtedly due to same or similar conditions in the social, eco¬
nomic, and cultural-historical spheres, while geographic factor, too, has not
to be neglected.
The elaboration of many features concerning customs in the field of
law and legal regulation goes deeper in the history, and even, as one might
say, prehistory of law. Such an approach means also the reviewing of custom¬
ary law conceptions and theories in several great intercontinental systems of
law, such as Roman law, Canon law, Moslem law, as well as, speakings in
terms of relatively modern law, of reviewing the Public and Private Interna¬
tional laws, where usages, practices and customary way of conduct have played,
and still play, a significant role.
Treatment of various issues and topics in the present monographic study
does not result in a strict classification and analysis of elements of legal cus¬
toms, since the very subject matter treated has not yet been analyzed in a
systematic way in relevant Yugoslav literature. This book therefore should
be accepted by the reader only as a modest contribution toward a deeper
analysis, and as a kind of reviewing world literature and conceptions of cus¬
tomary law. In addition, detailed rules in that sphere, in spite of the above
mentioned similarities in some general principles and institutes, escape strict
frameworks which would be comparable to contemporary branches of wri¬
tten law. Moreover, legal customs cover the subject matter of several disci¬
plines
-
namely, law, ethnology, sociology and history, but also psychology,
which suggests the need for special approach within the broader limits of
mentioned disciplines.
The contemporary aspect of legal customs is also treated in the present
monograph, since in some branches of law the role of customs, usages, and

practices, which sometimes give rise to the creation of legal rules, remains
still significant for the practice
-
as a kind of living law , particularly at the
local level of decision-making in the sphere of disputes. Besides the tradi¬
tional and old usages, there emerge also new ones in such fields as disciplin¬
ary law, commercial law, transportation, and maritime laws.
Particular emphasis is also put on some characteristics of legal customs
in the Balkan Peninsula, and South East Europe in general.
The book is divided into six sections. The first is dedicated to the gene¬
ral notions of legal customs, including relevant definitions. Tracing the early
definitions goes down to inevitable Roman law, where one finds that of Ulpi-
anus: mores
sunt
tacitus consensus populi
longa consuetudine
inveteratus (cus¬
toms are tacit agreement between people which is established by long usage).
The first conceptions of unwritten law of Roman scholars remain still the
foundations of later theories, even in the Common law world. Early defini¬
tions are then submitted of Western-European legal theory of the Middle
Ages, to be followed by those of South East Europe, and more particularly of
Rumania
-
whose legal literature on the subject is rather abundant. This elab¬
oration includes the Anglo-American law and, to a lesser degree, the laws of
India and China. This section contains the conceptions of the French school
of
ethnologie juridique,
covering legal customs of the so-called primitive soci¬
eties. The stand-points of that school help in understanding some essential
elements of legal customs in general.
The second section deals with the role of symbols in the sphere of law.
That topic is treated as an early stage in the general development of law,
which is, naturally, characteristic of unwritten, i.e. customary law . Through
the symbols one is able to better understand the first steps of mankind to¬
ward regulating social relations at all levels. The first three primeval spiritual
creations of man
-
religion, fine arts and law
-
have been characterized by
considerable use of symbols and even poetic fictions. According to the French
nineteenth century conceptions in this matter, symbols are therefore an im¬
portant link in the overall understanding of the beginnings of law, as well as
customary law.
Legal customs maybe found not only in the classical legal institutes and
instruments, but also in the proverbs, sayings, and ancient legal terminology,
so that these issues are the topics of the third section of the book. The fourth
one deals with the specificities in the development of legal customs in South
East Europe, while the position and role of legal customs in some contempo¬
rary legal systems are the subject matters of the fifth section. That section is
also a review of some relatively new research results in several South East
European countries (Greece, former Yugoslavia, Rumania).
Relevant problems of legal customs in contemporary legal systems are
treated also within this section, and Belgium has been chosen as a represen¬
tative example in that respect.

The sixth section is a presentation of the brief conclusions and an attempt
to point out at several common elements, categories, and principles in the
subject matter treated in the book. Even today legal custom is a reality for
many under-developed countries in Africa, Asia, Oceania, etc.
Custom in the legal sphere, altogether, has played an important role in
the general development of law, while in some regions, even in Europe (the
Balkan Peninsula), it still has its position in the regulation of activities con¬
nected to local level, especially in the mountainous regions, where the march
of that side of civilisation is somewhat slower than in the urban environment.
On the other hand, legal customs are not any more the general source
of law as they used to be, particularly in the formal sense, which applies both
to substantive law and the procedure.
It has been pointed out in the theory that one of the permanent charac¬
teristics of customary law is its oral element, the other ones being informality
and flexibility. But sometimes former codes and statutes, after long periods,
became in a way customary law. There were also attempts at writing down
legal customs, as well as of their introduction into statutes (the case of the
General Property Code of the Princedom of Montenegro, of
1888 -
which is
a fine example of using the rich folk tradition in a code). Sometimes, law¬
makers even confiscate customary rules (the case with the law in India), in
order to impose solutions otherwise contrary to genuine feelings in the sec¬
tions of society as to justice and honesty.
As a general rule, the legal custom has been suppressed and eliminated
by the positive law in most of the legal systems of the world, becoming in
many respects only a subject treated in the history of law.
In the countries of the Anglo-American law in connection with legal
custom there is a specific question of the notion

judge-made law or the
one of judge-recognized customary law.
Another general rule is that the custom has to be in accordance with
the constitution and the general legal system of a given country in order to
play any role at all in the legal life. Thus, in the sphere of constutional law, for
instance, like in Belgium, the custom serves as a basis for some new legal
precept, as well as practice. In France, also, usages are utilized in the sphere
of agricultural relations even today. The law-merchant, as is known, plays an
important part in the regulation of commercial
activités
in the common law
world, etc.
