Summary
Management of the Ministry of Education of
the Kingdom of Serbs, Croats and Slovenes
In the book, set as a case study, the question of organization and functi¬
oning of the Ministry of Education as the organ of the state administration
is discussed on the example of institutions of higher education, in terms of
different legal systems. Legal foundation of institutions of higher education
determined the basis on which the research represented a comparative analy¬
sis of the organization and functioning of the University of the Kingdom of
Serbs, Croats and Slovenes in Belgrade and the University of the Kingdom of
Serbs, Croats and Slovenes in Zagreb, along with the Royal Technical High
School, Royal Veterinary High School and the High School of Commerce
and Trade (later Economic-commercial High School), 11 as these three
high schools shared in its organization and manner of functioning certain
characteristics with the University of Zagreb. This is thus set because, on the
one hand, the legal basis of the University of the Kingdom of Serbs, Croats
and Slovenes in Belgrade, was applied to the University of the Kingdom of
Serbs, Croats and Slovenes in Ljubljana, to the Faculty of Law in
Subotica
and to the Faculty of Philosophy in Skopje, so that all these institutions had
the same
fönn
of organization and functioning, while on the other hand, the
legal basis of the University of the Kingdom of Serbs, Croats and Slovenes
and three high schools in Zagreb, caused a different way of its organization
and functioning in relation to other universities and faculties in the Kingdom
of
SCS. AU

SCS,
that had nothing
in common with the form of organization and manner of functioning with
the mentioned universities, faculties and three high schools, have not been
considered.
The application of the comparative analysis to both universities is caused
by the unique historical characteristics in which their development began.
University of Belgrade stems from the Great Academy which was founded
as a vocational school, oriented towards educating officials and public clerks.
University of Zagreb has its roots in Jesuit Academy of the Royal Free City
of Zagreb, which had, since its establishment, educated clergy. Historical
characteristics are particularly evident in the fact that during the WWI

University of Belgrade shared the terrible fate of the entire state and of the
Serbian people owing to the devastation and destruction that the war caused,
while the University of Zagreb operated smoothly throughout the war. In the
Kingdom
SCS
these two universities represented the two largest centers of
higher education, counting
86%
of students and
80%
of teaching staff of the
total number of all students and teaching staff at the institutions of higher
education in the country. For all time of the Kingdom of
SCS,
University of
Belgrade had by far the largest number of students, while the University of
Zagreb and the three high schools in Zagreb had the greatest number of teach¬
ing staff. Tn interwar period students population at the University of Belgrade
had adopted internationalism, as one of the most important principles, while
at the University of Zagreb the influence of Frankists (followers of infamous
anti-Serb chauvinist
Josip
Joseph Frank, a noted representative of the Party
of Rights, later Pure Party of Rights), Ustashes and of ideology of clerical
fascism gained strength.
Organization and functioning of higher education under the auspices of
the Ministry of Education in the Kingdom of
SCS,
was determined by the
parallel existence of myriads of legal systems, which presented the essential
characteristic of the new state.
Namely, the demand for autonomy, which the delegation of the People s
Council of the State of Slovenes, Croats and Serbs represented in negotiations
with the Government of the Kingdom of Serbia, caused that the Kingdom of
SCS
at the beginning consisted of six different legal areas, which represented
separate legal systems.
The First legal system was The Kingdom of Serbia.
The Kingdom of Montenegro had a separate legal system.
The remaining four legal areas which represented separate legal systems
stemmed from the Austro-Hungarian Empire (Dual Monarchy or Dual State,
was a monarchic union between the crowns of the Austrian Empire and the
Kingdom of Hungary in Central Europe) and later became parts of the King¬
dom of
SCS.
The third separate legal system was represented by Slovenia and
Dal¬
maţia,
which were both a part of imperial Austria (Cisleithania), therefore
having characteristics of Austrian legal system.
The fourth separate legal system consisted of:
Bácska, Baranya,
and
Banat,
which were under the direct rule of Hungary (Transleithania) so, on
the whole, these regions had the characteristics of its legal system.
The fifth separate legal system were Croatia-Slavonia, and they belonged
to Hungarian part of the Austro-Hungarian Empire, but having some elements

of autonomy (based on Croatian-Hungarian Agreement signed in
1868),
espe¬
cially in the field of education.
The sixth separate legal system was represented by Bosnia and Herze¬
govina, which were under the control of common administration of the
Austro-Hungarian Empire.
During provisional period (until the
Vidovdan
Constitution on July
28,
1921
came into effect) the provinces of the Kingdom of
SCS
have maintained
the same territory and, basically, the same legal competence which they
commonly practiced while they were integral parts of the Austro-Hungarian
Empire. Even after the Constitution was in effect the provinces preserved
their territorial area and legal competence. The Constitution set the provinces
as institutions of transitional importance, jurisdiction of which was supposed
to be abolished by the time the provincial administrations were liquidated
and administrative regions
(oblas
ts) established. After the liquidation of the
provincial administrations, their jurisdiction should have been transferred,
either to the individual ministries or to the governmental authority in admi¬
nistrative regions, so as to achieve vertical centralization of management in
administrative regions.
The functioning and the organization of public administration was large¬
ly determined by the existence of different separate legal systems. On the
example of the Ministry of Education of the Kingdom of
SCS,
it can be seen
that it, until
1923,
or until the abolition of the provincial administrations (in
Bosnia and Herzegovina, the provincial administration was abolished on
September 3rd
1923,
in
Dalmaţia
on July 18th
1924,
in Slovenia on December
3rd
1924.
and in Croatia-Slavonia on January 22nd
1925)
functioned as a kind
of provincial administration for Serbia, Montenegro,
Bácska, Baranya
and
Banat.
As a result of parallel existence of different separate legal systems, the
Ministry of Education held a divided organizational basis in the functioning
of education in the provinces of Slovenia,
Dalmaţia,
Croatia-Slavonia and Bo¬
snia and Herzegovina. Demonstration of separate legal system i.e. implemen¬
tation of laws inherited from the old administrative and legal systems alongsi¬
de the adoption of uniformed rules, were the characteristics of almost the
entire first decade of the existence of the Kingdom of
SCS.
Demonstration of different legal systems, and the implementation of laws
inherited from the old administrative and legal systems in practice, caused
that both universities, University of Belgrade and the University of Zagreb,
along with the three high schools in Zagreb, were based on a separate unique
models of organization and functioning, which were founded in administra¬
tive and legal systems of former Kingdom of Serbia and of province of

Croatia-Slavonia, in which these two institutions of higher education were
located. Those were the two models that were used as basic foundation for
establishing the entire field of higher education in the Kingdom of
SCS.
Under conditions of separate legal systems, the Ministry of Education of
the Kingdom of
SCS
and the Minister of Education, in terms of management
exercised limited power of supreme supervision over the University of
Belgrade concerning the autonomy of the University itself. Supervision of
the Minister of Education over the University of Belgrade consisted only of
receiving Rector s reports on the condition and work of the University itself.
During the autonomy of Croatia-Slavonia, the University of Zagreb
and later the high schools in Zagreb were directly subordinate to the Land
Government
/
Provincial Government of Croatia-Slavonia and Ban (The
King s appointed steward)
/
Provincial Governor. Upon the provincial auto¬
nomy of Croatia-Slavonia all the functions for independent performance in
the field of education were joined.
Based on this, the Ministers of Education of the Kingdom of
SCS
carried
out all their duties towards the University of Zagreb and the high schools in
Zagreb according to that autonomy. The Ministers of Education of the King¬
dom of
SCS
could play an active part in the process of the opening of new
facilities at the University of Zagreb and the high schools in Zagreb. They
adapted their actions to the competent institutions of provincial autonomy,
and thus contributed to the development of higher education in Croatia-
-Slavonia. Their responsibility consisted in receiving complaints that were
directed against the decisions of the provincial administration.
The Council of State of the Kingdom of
SCS
was resolving all disputes
that would emerge between the Minister of Education and the University
of Belgrade while receiving each ministerial order, which was opposed to
provisions on the autonomy of the University of Belgrade, as well as, all
appeals made by individuals, whose rights were infringed by order or decision
of the administrative authorities in the autonomous Croatia and
Slavonia.
In
both cases, until the resolution of a dispute was achieved, the orders of the
Ministers of Education could not be implemented at the Belgrade University,
just as the orders and decisions of the administrative authorities in the auto¬
nomous Croatia-Slavonia could not be implemented concerning both legal
and natural persons.
Autonomy, which was in force at the University of Belgrade, in admi¬
nistrative
tenns
meant that the University included all its teachers, students,

officials and officers. Also, the University was the supreme self-governed
body for higher professional education and scientific research which had its
own authorities, which consisted of the Rector, deans of the faculties, Uni¬
versity Council, University Chamber, University Administration, faculty
councils and the University Court.
In terms of its property, University also was an independent legal entity. It
was dependent on state expense regarding the budget determined each year in
agreement between University Administration and faculties, with subsequent
approval of the Minister of Education.
University authorities had the right of administration over the entire
University of Belgrade, as an institution of higher education.
Tenns
of
administration included: managing external affairs, conducting administrative
affairs, disposing of funds from the budget, managing finances, managing
and disposing of endowments and funds, organizing work, keeping order,
managing the staff, everything related to the maintenance of teaching and
examination, and all responsibilities in connection with resolving students
issues.
University of Belgrade had the sovereign right to constitute each body
of University authority. This right was exercised in regular elections, which
were held in the relevant bodies like: University Council, University Chamber
etc.
Land Government

Provincial Government and Ban
/
Provincial Go¬
vernor, had the power (the opportunity) based on University Law and all
basic laws and legal acts that regulated the field of higher education, to jointly
operate at Zagreb University and at the high schools in Zagreb. Yet, in some
cases, the jurisdictions of the autonomous authorities of Croatia-Slavonia
were not separated entirely. In administrative terms, their responsibilities
included the entire area of higher education, with all facilities and with all
teachers, students, officials and employees.
The provincial administration of Croatia-Slavonia had the right to propo¬
se to the monarch all legal acts related to Zagreb University and high schools,
which he confirmed. Since the legal acts would be confirmed by the monarch,
the provincial administration of Croatia-Slavonia was entitled to realize the
full organization and functioning of Zagreb University and the high schools
by prescribing orders and issuing charters for them and individual facilities
on these institutions. As a part of that, the administration was enacting the
supreme supervision of Teaching, determining the amount of fees and regulat¬
ing the holding of an exam. These authorities also had the sovereign right

to manage human resources on higher education institutions and institutes,
and they could also appoint all categories of teaching and other staff, except
teachers who, on their proposal, could be set by a monarch only.
On the day of abolition of the Provincial Administration of Croatia-
Slavonia on 22nd January
1925,
the Law of Belgrade University of 27th
February
1905
and the General University Regulation of 1st October
1905,
with all amendments and supplements was stretched to the Zagreb University.
In this way, the basis of organization and functioning which was in force
at the University of Belgrade was transferred to the University of Zagreb.
In addition, Zagreb University has also come under the supervision of the
Ministry of Education i.e. Minister of Education.
Basics of Belgrade University with Faculty of Philosophy, Faculty of
Law and Technical Faculty were determined in the period before WWI.
During the period of the Kingdom of
SCS,
the development of the entire
Belgrade University and of its faculties, was continued, and it was proceeded
with the building of research and teaching base of each of the faculties. This
development was more intense on the Faculty of Law and the Faculty of
Philosophy than on the Technical Faculty, where the research and teaching
capabilities were developed to a more modest extent. The basis of the Belgrade
University was expanded with the foundation and construction of three new
faculties: Medical, Orthodox-theological and Agricultural.
During the period of the Kingdom of
SCS,
the development of the
University of Belgrade was marked with the establishment of new faculties
and building the scientific-teaching foundation on them, as well as on the
already existing faculties.

cation of the Kingdom of
SCS
were collected, and then their quantification
was made. This procedure was applied since the norms in general defined the
action of every organ of state administration, as well as every organ of the
provincial administration, because they all had the right to operate through
the following functions: organizational, normative-legal, financial, personnel,
and others.
Thus, on the basis of methods of measurement in historical research,
in the prescribed acts, separately to faculties and to the entire Belgrade
University, since the founding of the University until the academic
1929/30,

functions were specified.

was much smaller. In this way, individually on faculties and on
the entire University, the actions were directed mostly towards building the
organizational and personnel base. Significantly low number of normative-
legal and material functions that were given, indicate neglecting of these two
types of action.
Of the
24,338
functions,
9,078 (37.30%)
were given for the operation
of the University, while for the operation of the Faculties
15,260 (62.70%)
functions was specified. Of the total number of functions for faculties and
universities,
11,816 (48.55%)
functions were given in the period before the
WWI, and
12,522 (51.45%)
functions in the period of the Kingdom of
SCS.
In the course of their mandates, the Ministers of Education of the King¬
dom of
SCS,
subscribed acts for the University of Belgrade and its faculties,
in which they gave
11,195
or
46%
of the total of
24,338
functions.
Svetozar
Pribićević
(Yugoslav Democratic Party and The Independent
Democratic Party) at the time of his mandates, subscribed
5,730
or
23.54%
of
functions, from a total of
24,338,
which was more than all the other Ministers
of Education of the Kingdom of
SCS
subscribed altogether. Based on the
given function, he significantly improved and modernized the organizational
basis of the University of Belgrade. He expanded and improved the structure
of the administrative staff, provided the admission of officers who were
disabled in wars
1912-1918,
to the University, established and appointed
greater responsibilities to the University Council and University Chamber,
and defined the position of Assistant Professors and Assistants. He determined
the base and the
mies
for organization and functioning of the Medical Fa¬
culty, Orthodox-Theological Faculty and the Faculty of Agriculture, by
undersigning appropriate regulations for them.
Comparing the operating of the autonomous Croatia-Slavonia during the
period of Austro-Hungarian Empire
(1868-1918)
and during the period of the
Kingdom of
SCS
(1918-1925.),
in the field of educational activities, on the
example of higher education, it can be clearly observed, that in the fifty years
•n the period of the autonomy of Croatia-Slavonia in Austro-Hungarian Em-
pire, in the field of higher education, the University of Zagreb was founded
with its three faculties: Roman-Catholic Theological, Law and Philosophy.
In the next six years, in the period of autonomy of Croatia-Slavonia in the
Kingdom of
SCS,
the institutions of higher education were much more
developed. During that time, the process of forming of the three existing
faculties was finished, and three more faculties were fully established: Medi-

cine, Agriculture-Forestry and Eastern-Orthodox Theology. Faculty of East¬
ern-Orthodox Theology worked for only two or three years before it was
closed. In the same period, apart from the faculties of the University, the three
high schools were fully formed. During the period of autonomous Croatia-
Slavonia, they were upgraded to the level of university faculties. Those were:
the Royal Technical High School, Royal Veterinary High School and the
Royal High School of Commerce and Trade.
In the autonomous Croatia-Slavonia,

part related to higher education from the time before

At the University of Zagreb, from the period of stretching of the Uni¬
versity law and the General Regulation of the University of Belgrade, onto

the development and the construction of the University of Zagreb were conti¬
nued, and for that purpose

When it comes to the establishment of new institutions and the deve¬
lopment of science-teaching basis, most of the attention was dedicated to the
Faculty of Philosophy, because for that purpose

At the University of Zagreb, during the four school years, during his
mandates as Minister of Education, Milan
Grol
(Yugoslav Democratic Party),
assigned most functions
2,608 (83.05%)
out of
3,140.
Concerning the activities of all Ministers of Education in the Kingdom of
SCS,
it is possible to conclude that the major contribution to the development
of organization, developing management and improving the scientific-teach¬
ing basis at the University of Belgrade and at the University of Zagreb, was
given by the Ministers of Education from the Yugoslav Democratic Party.
State administration bodies of the Kingdom of
SCS
i.e. in our case, the
Ministry of Education, were equally managed by the regulations inherited
from the old administrative and legal systems, and according to regulations
issued in the Kingdom of
SCS.
This type of administration of the Ministry
of Education is reflected in the respect of the autonomy of the University of
Belgrade, and in the respect of provincial autonomy of Croatia-Slavonia. In
practice, the existence and functioning of both autonomies was confirmed
with successful organizational development and management, building sci¬
entific-teaching basis and creating conditions for its implementation at the
University of Belgrade, and at the University of Zagreb and the three high
schools in Zagreb. Remarkable development of the University of Zagreb and
the three high schools in Zagreb in autonomous province of Croatia-Slavonia,
points to the essential existence of provincial autonomy and its realization
in practice, in the field of education. The continuing of that development in
the period after the abolition of the provincial administration, points to the
existence and implementation of the autonomy on the Zagreb University. Con¬
sistent application of provincial autonomy at first, and then of the autonomy
of the University, resulted in multiple development and construction of this
center of higher education in the Kingdom of
SCS.
