SUMMARY
This book describes founding of the Republic of Estonia, defining its
borders, and the ordeals that during long years of history have befallen
the people of this small country. The research focuses on the process
and the backgrounds related to the New Border Treaty between Esto¬
nia and Russia that was finalised in
1996
and signed in
2005.
As ma¬
jority of the documents about negotiations that took place have been
declared confidential and are still unavailable to the researchers, this
task has been rather difficult and complex.
The border between the Republic of Estonia and Russia was defi¬
ned in the Tartu Peace Treaty that was signed with Russia on February
20th
1920
after Estonia had won the Independence War. In that treaty
Russia solemnly declares to honour Estonia's independence and to
denounce forever all rights Russia has had in the past against Esto¬
nians and their land. That solemn, for ever, promise was kept for
20
years only, and in
1940
the Soviet Union occupied Estonia. Brutal mass
repressions, arrests, murders and deportations to Siberia of innocent
persons started immediately.
Nazi-German forces arrived in summer
1941,
and assisted by the
Estonians who had already freed several areas from the Soviet rule, the
Red Army was forced to retreat. Instead of the freedom Estonians had
hoped for, one occupation was replaced with another
—
however, pur¬
posely much less repressive one. Unlike the Soviets, the Germans did
not plan to annihilate the Estonian nation, and Germans knew that the
deceitful promises made to Estonia in
1939
and brutal repressions du¬
ring the
1940
to
1941
occupation by the Soviet Union had made all Esto¬
nians profoundly hate Russians. Estonians also believed that at the end
of the World War II, Estonia will some how regain their independence
—
provided that the Soviets are prevented from returning. Guided by
individual aspirations and the assessment described afore, thousand
of Estonian men joined the German forces. The Germans were not
our friends, but we had a common enemy. In the fall of
1944
when

the German forces were retreating and Estonians in German uniform
and with Germans weapons were slowing down the approaching Red
Army, Estonian national leaders were able to form a Government and
issued a plea to the Western world to recognise the re-establishing of
the Republic of Estonia.
The hurriedly formed Government was able to exist for a couple of
days only. The over whelming large enemy forces occupied Estonia,
and annexation to the Soviet Union followed soon. Before completing
the conquer of Estonia, Stalin relocated illegally the eastern border of
Estonia, by declaring the territory east of Narva river and the Petseri-
maa county
—
a total of
5,2
percent of the territory of Estonia
—
to be
part of the Soviet Union.
The arrests, deportations, mental repressions and genocide were
restarted again. About
20
percent of Estonians lost their lives due to the
Soviet occupation. Close to half a million Russian speaking persons
were resettled to Estonia. Forming one third of the population, the Rus¬
sian speaking colonists were given preferential status in all aspects of
every day life and Estonians were forced to learn Russian language to
survive. Estonians were not content with the communistic regime
—
armed resistance lasted to the middle of the fifties, and other forms of
resistance until the disintegration of the Soviet Union.
In
1991
Estonia declared regaining its independence as the succes¬
sor of the state founded in
1918.
The succession of the Republic of
Estonia within its borders defined in the Tartu Peace Treaty was recog¬
nised by all other states. Estonian Congress and Supreme Council (ac¬
ting as Parliament) declared illegal the unilateral changes to the border
location made by the Soviet Union. The border location defined in the
Tartu Peace Treaty was incorporated into the new Constitution and into
the Act of State Borders. Estonian Congress and Supreme Council deci¬
ded to demand Russia to relocate the border markings to the positions
established in Tartu Peace Treaty.
Paradoxically no lustration took place in Estonia, and the collabo¬
rators with the Soviet rulers and repression system
—
now posing as
freedom fighters
—
took to power. An election system that conceals
the ranking of candidates and allows votes received by a party to be
freely distributed between the eligible candidates has made it possible
for most of those initially elected to stay in power to this date. Russia,
ruled by former KBG officials, behaves aggressively and hostilely like
the Soviet Union, and makes efficient use of the colonists that were left
here to undermine the independence of Estonia.

In
1993
Estonia and Finland pulled back their sea borders at the
Gulf of Finland from the median line and thus gave away for no reason
what so ever the control over thousands of square kilometres of terri¬
torial waters. As later explained to the Parliament this «voluntary self
discipline» was proposed by President
Lennart
Meri
and the Foreign
minister Trivimi Velliste. In both countries the opposition considered
that act to enhance the military and economical interest of the Russian
Federation only. It surely provided totally free and uncontrolled access
through the Gulf of Finland for the Russian warships.
In the mutual negotiations that began in the early fifties, Russia
refused to acknowledge the existence of the Tartu Peace Treaty. The
Russian occupation forces left Estonia in
1994
as stipulated in the July
Agreements made by Presidents Men and Jeltsin (leaving about
20 000
fully trained army privates and officers to retire in Estonia together with
their families). The Russian military units are to this date still stationed
as occupation forces on the Estonian territory that was illegally anne¬
xed by the Soviet Union. The Russian Federation erected unilaterally
border milestones to coincide with the location that defined the terri¬
tory of violently formed Estonian Soviet Socialist Republic (ESSR). Es¬
tonia initially protested this action, but later on, the Minister of Foreign
Affairs, Andres Tarand, without duly authorised to do so, agreed to give
up the occupied territories in case Russia recognises the existence of
the Tartu Peace Treaty.
Russia rejected that proposal. Despite that rejection, the Estonian
delegation continued to participate in negotiations where no one wan¬
ted to listen to their arguments. Russia reported legally valid Estonian
claims to be unjustified requests to obtain Russian territory. Further
more they incriminated Estonia to be a Nazi state that discriminates
Russian nationals. These lies and propaganda made Estonia to refrain
from making just demands in a number of important matters. Instead
of stoutly presenting the truth and asking the Western states to support
our legally valid demands, the Government preferred to silently ignore
the lies blared out by Kremlin. Reticence was deemed to accentuate
dignity. This decision made it possible for Russia more effectively vilify
Estonia.
At Petroskoy in
1996
Estonian Minister of Foreign Affairs, Sum
Kallas,
paraphrased (without being duly authorised to do so) a new Border
Treaty with Russia without any reference to the Tartu Peace Treaty and
the illegal border markings erected by Russia. The public was infor¬
med that without a new Border Treaty Estonia can not obtain member-

ship in the European Union and in NATO. No such official demand was
made. Russia refused for various other unrelated reasons to sign this
treaty until the year
2005,
when on May 18th the Estonian and Russian
Ministers of Foreign Affairs signed it in Moscow. With the May
2005
Bor¬
der Treaty Estonia freed the Russian Federation from the obligation to
make good the crime against humanity committed by the Soviet Union
by annexing part of territory that belonged to the Republic of Estonia.
Further more, this act legitimised a serious crime of communism. Es¬
tonia gave freely in to all demands of the Russian Federation
—
who
had no need to place their armed forces in combat readiness at the
Estonian border as they did during the
1939
«friendly» negotiations.
In an opinion poll conducted by ERV on the day of signing the new
Border Treaty,
82,5
persent of the respondents disapproved conceding
the rights to state border defined in the Tartu Peace Treaty. Disapproval
expressed in other opinion polls, petitions and demonstrations failed
to influence those in power. The parliament ratified the new Border
Treaty signed in Moscow on May
1
8th
2005,
hurriedly in a special ses¬
sion.
Due to an indirect reference to the Tartu Peace Treaty that the Par¬
liament inserted into the Act of Ratification, Russia refused to ratify
the treaty and advised taking back their signature. Russia maintains
that the reference will allow Estonia to request at a later date to get
back Estonian territory that the new treaty ceded to Russia. It is dif¬
ficult to assess whether Russia seriously feels so, or is this just another
opportunity to discriminate Estonia. Presently the situation is beneficial
to Estonia. Unfortunately some of our politicians still believe that the
border location defined in the Tartu Peace Treaty needs to be adjusted
to correspond to existing situation, and are thus demanding to abolish
the clarifying stipulation in the Act of Ratification.
Estonia had no need for a new Border Treaty with Russia. This has
been confirmed by Prime Minister, Andrus Ansip, under whose term of
office the new treaty was signed. In accordance with international law,
the Tartu Peace Treaty and the state borders herein defined are still le¬
gally valid. Long duration of occupation does not legitimise annexation
of Estonia into the Soviet Union. The new treaty that is based on the
territory of ESSR together with our Parliament's decision to grant legal
resident status to all Russians living in
1991
in Estonia, could allow in
accordance with international law to rule that
de
facto Estonia joined
freely the Soviet Union.

Relinquishing territories with natural resources and those which
are highly vital to Estonian energy systems, will adversely affect natio¬
nal security and cause Estonia to loose many billion dollars. The inha¬
bitants in our most quaint county have due to the new Border Treaty
been forced to leave their homes and property, and due to relocation
into different parts of Estonia, their unique culture is thus bound to
vanish.
In addition to other reasons defined above, the new treaty viola¬
tes the stipulations in our Constitution. This «minor matter» did not
prevent those in power
—
mostly former communists
—
to present
the new Border Treaty with Russia as a great diplomatic achievement.
Those deeds prompt justifiably to ask what have been the real motifs
to do so, and what has affected officials of the national security sys¬
tems to refrain from assuring compliance with our Constitution and
from seriously protecting our independence.
It is most obvious that Estonia must before a designated date de¬
nounce the new Border Treaty. Instead of doing so, the Government
has initiated demarches to obtain Western help to urge Russia to ratify
the new Border Treaty.
The eastern border of Estonia is
de
facto located where the Russian
Federation unilaterally wanted it to be. There is no need to change its
original
de
jure location. Any act that would permit Russia to claim that
the Republic of Estonia was in
1991
founded by the residents of ESSR
is fatal to Estonia. There are no legal, political, economical or moral
reasons to change or eliminate even a single sentence in the Tartu
Peace Treaty where Russia solemnly declared to refrain for ever from
any rights Russia has had in the past over Estonians and their land. We
were able to wait
50
years to be freed from Russian domination, and
we surely can demand and wait for our eastern border to be located
where it was before the Soviet Union annexed Estonia. Justice and
rights will always prevail.
