SUMMARY
The Judicial Reform of Peter the Great
Dmitry Serov
This monograph is a complex interdisciplinary study of the first judi¬
cial reform in the Russian history, the judicial reform of Peter the Great,
which took place between
1717
and
1723.
The main 4part of the mono¬
graph is devoted to the characteristics of changes in the judicial system
and the law of procedure in Russia, which were implemented in the pre-
reform period between
1696
and
1716
and also during the reform itself.
It is demonstrated in the monograph that the precondition for the reform
was the crisis in the pre-reform justice system, while the political and
legal bases of the main reform were the concepts of the «police state» and
of cameralism. Reviewed in this study is the history of search undertaken
by Peter the Great for Western European models to ensure implementa¬
tion of the judicial reform in Russia. For the first time an attempt is made
to reconstruct the concept of the judicial reform and the process of de¬
veloping in
1718
a new Swedish system-based model of the court system.
Based on a wide range of archival sources, issues of organization, status
and powers of the first common law courts are reviewed, as well as issues
of law application procedures in the common law courts and liquidation
of these courts between
1722
and
1727.
The issue of normative regula¬
tion of separation of judicial from administrative authorities is analyzed
in detail. This study contains a comprehensive review of the development
of special jurisdiction courts in the reform period. The subsystems of
departmental courts are reviewed in detail, i.e. military courts, clerical
courts, town courts and police courts. Seen in the context of analysis of
changes conducted in the domain of legal proceedings, establishment of
a revision-decision procedure of review and approval of judicial decisions
is shown and the beginning of development of the preliminary investiga¬
tion phase in the criminal procedure is demonstrated. The conditions
in which the investigative body was formed during the Russian judicial
reform are reviewed in detail. The innovative character of the monograph
is reflected in the overall review of systemization conducted in the Rus¬
sian procedural legislation in the first quarter of
XVIII
century and in the
analysis of the steps taken towards incorporation and codification of this
legislation. Particular attention is paid to the story of creating the draft
of Russian code of laws «Ulozeniye» in
1723—1726,
which was meant
to become a normative base for the functioning of the reformed Russian
judicial system.

Diese Monographie ist das Ergebnis einer komplexen, interdiszipli¬
nären Untersuchung der ersten russischen Justizreform - Gerichtsreform,
die unter Peter dem Großen im Zeitraum zwischen 1717 und 1723, statt¬
fand. Der Hauptteil dieser Monographie ist den Änderungen bei der Ge¬
richtsverfassung und dem Gerichtsverfahren gewidmet, die in Russland
sowohl vor der Reform, zwischen 1696 und 1716, als auch während der
Reform vorgenommen wurden. In der Monographie wird dargestellt,
dass
die Krise der damaligen Justiz eine Voraussetzung für die Reform
war und die rechtspolitischen Basiskonzepte der Reform der Polizeistaat
und der
Kameralismus
waren. In der Monographie wird die Geschich¬
te der Suche bei westeuropäischen Modellen dargestellt, die Peter der
Große für die Durchführung seiner Gerichtsreform brauchte. Zum ersten
Mal wurde ein Versuch unternommen, das Konzept der Gerichtsreform
zu rekonstruieren. Der Prozess der Entwicklung des neuen Gerichtssy¬
stems im Jahre 1718, das auf dem schwedischen Modell basierte, wird
im Einzelnen dargestellt. Mittels zahlreicher Archivmaterialien werden
die verschiedenen Fragen über die Organisation, den Status und die Be¬
fugnisse der ersten russischen Gerichte der Allgemeinjurisdiktion, ihre
Rechtstätigkeit und schließlich deren Abschaffung in den Jahren 1722 bis
1727 beleuchtet. Die Frage über die normative Regulierung der Gewal¬
tenteilung bei den Gerichts- und Verwaltungsorganen ist tief analysiert.
Die Entwicklung der Sondergerichte während der Reformzeit wird all¬
seitig dargestellt. Ausführlich werden die Subsysteme der Amtsgerichte
betrachtet, d.h. Wehrdienstgerichte, kirchliche Gerichte, Stadtgerich¬
te und Polizeimeistergerichte. Im Kontext der Analyse der Reform im
Gerichtsverfahren, werden die Herstellung der revisionsentscheidenden
Ordnung und auch der Anfang der Bildung der vorläufigen Untersuchung
in Strafprozessen in Russland, dargestellt. Die Entstehung der Unter¬
suchungsbehörden in den Jahren der Gerichtsreform in Russland wird
im Einzelnen betrachtet. Zum ersten Mal wird in dieser Monographie
die Systematisierung russischer prozessrechtlicher Gesetzgebung im er¬
sten Viertel des 18. Jahrhunderts ganzheitlich beleuchtet. Auch werden
die Inkorporation und die Kodifikation dieser Gesetzgebung analysiert.
Besondere Aufmerksamkeit wird der Geschichte der Abfassung des Ent¬
wurfs des Gesetzbuches Russlands (Ulozhenije) in Zeitraum zwischen
1723 und 1726 gewidmet. Dieses Gesetzbuch sollte zur normativen Basis
der Funktion des reformierten Gerichtssystems Russlands werden.
