Summary
Voluntary work, that is work provided voluntarily and freely for others, is in Poland more and more
popular. The growth of the third sector along with the gradual growth of the number of volunteers,
working primarily in non-governmental organizations and in public institutions, the creation of vol¬
unteering centers and finally comprehensive, legal regulation
ofthat
phenomenon confirms this ob¬
servation.
Voluntary work is the way the third sector operates, namely a method of obtaining cheap or
even free and very often also effective help for the community in its broad sense as well as a form
of building a conscious, civil society.
For a long time voluntary work in Poland had not been regulated in detail until the Act of Law
of April 24th
2003
on Public Benefit and Volunteer Work and the provisions on its implementation.
The act institutionalized voluntary work which changed from informal and spontaneous activity to
legal operations conducted within the framework of the rights and obligations of volunteers and
entities which use their services. However, some questions arise at this point
-
on the one hand, the
questions whether voluntary work is overregulated and, on the other, whether the legal provisions
are actually exercised.
The description of the practice of operation of voluntary work and implementation of statutory
norms were possible due to the use of the analyses conducted primarily by the
Klon/Jawor
Associa¬
tion surveying the third sector and the author s own research conducted in July/October
2008
on the
representative sample of
380
non-governmental organizations.
In the first chapter of this monograph the third sector is presented
-
including brief definitions,
legal basics of the activity and the basic empirical data from that period.
In the second chapter the theoretical aspects of voluntary work are presented specifically tak¬
ing into account the legal definition of voluntary work and its different features compared to the
common meaning of that notion. The legal aspect of voluntary work is

narrower than its popular meaning because of the fact that it was normatively regulated
much later than it was practically adopted.
Although the notion of voluntary work is new, its concept has a long history. In the third chap¬
ter the search for the origin of this idea is presented. Two sources of contemporary social work were
drawn from classic philanthropy and Christian charity as well as the ideas connected with citizenship
and civil society. Additionally, a short history of social work in Poland was also presented.
The next chapter covers the issue of reconstruction of the normative model of voluntary work.
Special reference was made to the Act of Law of April 24th
2003
on Public Benefit and Volunteer
Work as well as to other regulations regarding volunteers by presenting applicable legal regulations
in this respect as well as their interpretation and existing controversies.

Summary
In the fifth chapter, practice of voluntary work in the third sector is presented. It describes the
engagement in social work in comparison with other forms of activity and social operations in other
countries. It should be noted that voluntary work in Poland does not look impressive at all in this
context. Voluntary work is also looked at from the perspective of non-profit entities. In this respect
that chapter indicates in particular the number of organizations employing volunteers, the kind of
work performed by them as well as the advantages and disadvantages of the cooperation with com¬
munity workers. Another analyzed problem was the implementation of legal norms in reference to
the cooperation with volunteers, taking into account both the obligatory and optional rules.
The research findings indicate that the professionalization of social work gradually continues.
More and more organizations follow the legal regulations, making voluntary work formal and legal
activity. Their number, however, is far from assumed, complete implementation. As a result, there is
still a dissonance between the institutional ization of voluntary work assumed in legislation and ac¬
tual operation of social work which in a lot of organizations is not standardized at all, or at the most,
it is regulated in reference to some selected volunteers. It seems that social activity will always re¬
main to a certain degree informal. For instance, due to the preferences of both parties to the contract
that do not always expect its institutionalization. It should be also noted that the specific phenomenon
of overregulation does exist whenever the formalization is in a way forced or when some statu¬
tory regulations are deliberately not applied as presumably being unnecessary or impossible to im¬
plement (primarily due to the shortage of funds.)
It should be noted then that the present law is a good starting point for the discussion on the
status of volunteer work and introduction of such changes which would improve and not impede the
cooperation with volunteers.
