Schadensersatz- und Abschöpfungs¬
ansprüche gehören zu den privat¬
rechtlichen Sanktionen im Recht
gegen unlauteren Wettbewerb und
im Recht gegen Wettbewerbsbe¬
schränkungen. Christian Alexander
untersucht den Prozess der Verände¬
rung, den beide Rechtsgebiete durch¬
laufen, und der maßgeblich auf den
Einflüssen des Europäischen Rechts
beruht. Wichtige Änderungen be¬
treffen dabei vor allem die privat¬
rechtlichen Sanktionen. Die private
Rechtsdurchsetzung durch Markt¬
akteure soll weiter gestärkt und aus¬
gebaut werden, wobei Schadens¬
ersatz- und Abschöpfungsansprüchen
eine Schlüsselrolle zukommt. Der
Autor zeigt,
dass
Ausgestaltung und
Anwendung dieser Ansprüche durch
ein mehrdimensionales Zusammen¬
spiel individueller und überindivi¬
dueller Interessen geprägt sind und
ordnet sie in die Strukturen des
Privatrechts ein. Dabei berücksichtigt
er auch die europarechtlichen und
verfassungsrechtlichen Grundlagen.
