Summary
Paths of Emacipation. A Personal Theory of the Regime
Transformation in Poland By

Kurczewskî
This book summarizes the author s various publications since
1989
and pre¬
sents his brand of
socio-legal
interpretation of social life, focusing on eman¬
cipation as the central concept. Emancipation is considered as an axis which
organizes interpretation of social changes going on ¡n Poland since
1979
when the first ever Polish Pope visited his home country and was publicly
met by millions of people in defiance to the official communist ideology and
polity. The next year Solidarity , the first mass independent anti-communist
organization developed through the strikes ¡n the Baltic sea shipyards. The
main thesis of this analysis says that emancipation is a historical process,
going back to the past, which led in its last stage to the collapse of commu¬
nism and emergence of democracy. Once viewed from the perspective of
agents of transformation, emancipation may be defined as a constant broad¬
ening of activity on the part of individuals and collectives. I analyze emanci¬
pation in three basic dimensions, namely as consisting of: (i) liberation of
expression, (ii) gaining of economic freedom, and
(iii)
emergence of political
rights. Development of theory of rights from T. Marshall through R.
Bendix
up to T. Janoski is followed and the concept of participatory rights is modified
by the author ending up in the following scheme:

The political controversies in Poland in
1989
and after are interpreted by
reference to the triangle of values. The democratic-liberal center focuses on
the individual, liberty and property, thus on protective rights, while there are
in Polish politics two significant versions of the positive social rights policy.
One is post-communist Left which stresses the individual social rights against
the State as in the old paradigm of the welfare state. Second is Catholic
Right which following the Vatican Charter of Family Rights stresses the col-
lectivistic rights of family and nation against the State that is due to support

these independent of the individual. The triangle asymmetry makes the poli¬
tics asymmetrical as well and leads towards permanent fluidity of alliances
and conflicts. This in turn prevents politics from becoming bipolar.
The next three chapters deal with the role of law and the Rule of Law
during the transformation. The old regime is characterized in terms of the
Party-State duality. The disappearance of the Party makes for the explosive
emancipation of the state as embodied in the Parliament. The meaning of
the free mandate is then discussed, pointing to the fact that though theore¬
tically it is free the social reality as H. Pitkin observed limits it. Too far differ¬
ence between the representatives and those represented may lead to the
political conflict subverting democracy and its presumptions. This almost
happened in
1993
when the debate on ban on abortion went to the limits of
tolerance but the sudden change of government back to the former commu¬
nists helped to keep democracy going. The Rule of Law as the development
perspective is understood as the other limitation of the freedom of choice
apart from the assumption of representation. Nevertheless, the efficiency of
the law is to be doubted because at all levels of society structure the law is
treated instrumentally, and corruption is widespread. In the end a new dua¬
lity is observed in the Polish political system developed after
1989,
the inner
world of party politics and the outer world of proclaimed direct participation
in politics (legislative initiative, referenda) which however is under the direct
control of the first. In yet another chapter on anti-politics the author points to
the fact that disinterest of average citizen in the party politics (and vice ver¬
sa) led to the prevalence at local, communal level of the small, ad hoc group¬
ings playing in majority of cases the political role in the self-government while
above the district level the politics is by law limited to political parties.
The other two chapters deal with the effects of economic and political
processes on the class structure. The author continues to use the term mid¬
dle classes referring to Polish society and notes that pro-market and pro-
democracy values are uphold by these classes, including upper workers
(skilled and educated) in contrast to the lower, unskilled classes. However
the claim that the new middle class is constructed after
1989
is rejected as
manipulation that hides the new emerging upper class of capital owners from
public scrutiny. In chapter on Maria s Kingdom author refers to the constitu¬
tional theory that helped since the 17th century to survive the short or longer
periods of lack of secular sovereign by putting in head of Roman Catholic
Church in Poland a role of representative of Holy Mary as Queen of Poland.
This theory finds its expression in the Catholic Right and is supported by
some Polish bishops. The full alternative version of the Polish polity based

upon the already mentioned collective social rights of Family and Nation
versus the State is analyzed.
The last chapter deals with dramaturgical perspective on transforma¬
tion. Using H.D.Duncan s and V.Tumer s schemes the author points to the
fact that there are some rites of passage that are performed during the trans¬
formation. Such a rite is the lustration aimed at the former accomplices of
communist secret police. The campaign which since
1989
is addressed
against the historical leader of
Solidarność
Nobel-Prize winner
Lech Wałęsa
is interpreted as such ritual aimed at symbolic killing of the scapegoat in R.
Girard s terms as compensation for the mass conversion from the at least
passive support for the communism into the active participation in the post-
-1989
liberation. The transformation is then characterized as spoiled drama,
in which the cathartic moment of liberation occurred in
1980/81
and was
suppressed by General
Jaruzelski
with help of the state of emergency so the
proper dramatic sequence could not have developed after
1989.
