At the biginning
óf
the
XIX
century, after many years of Turkish rule,
Serbian people started to establish its own sovereign state similar to existing
state organization in Europe.
In
1804,
the very year of Serbian Uprising, leader Karadjordje and other
national leaders realised the necessety of establishment of modern state legal
order with organized legislative, executive, legal authority as basic
atributes
of
a state. Special attention was paid to the establishment of modern legal system
of the new Serbian state. Stable, independent from other state functions and
assigned to the framework of law, judiciary presents a guarantee of legal secu¬
rity of citizens in every state community.
During the first rule of Prince
Milos,
Serbian state finished the process
of liberation and independence from Turkish Empire, and the independent le¬
gal system of the young Serbian state was completed too.
During the Constitutionalists special efforts were made in order to or¬
ganize the legal system in the direction of bourgeois civil states
ofthat
time.
It was the time when the first codification of Serbian civil law was done and
since than it has been considered that the application of written legal sources
in the work of courts started. Up to the first half of the
XIX
century, the base
of trials in Serbia was practically unwritten, common law according to com¬
mon sence and clear conscience .
In
1865
the organization of judiciary in Serbia was finally formed and
stabilized by the Law of organization of district courts, appellate court and
the court of cassation. The following normative legal laws did not change the
organization of courts established by the mentioned law. The basic principle
of legal authority can be seen in its independence in relation with the legisla¬
tive and executive
función
of the state, and as such
,
this principle in Serbian
law got its final, real application after the establishment of the Constitution in
1888.
By the same Constitution, insignificant change in the organization of
courts refers to the change of the name of district into courts of original juris¬
diction and that organization of legal system of Serbian state of the
XIX
centu¬
ry will await the new state community

The Kingdom of the Serbs, the Croats
and the Slovenians.
The fact that the Court of Pozarevac was established as the first district
court in Serbia, shows the importance of Pozarevac city in economic, polit¬
ical and social milieu of the state. Established as The
Sovjet
of Pozarevac in
1821,
through magistratus (municipal court), district court of Pozarevac and
the court of original jurisdiction, this court will continue to work up to now.
Today, legal successor of The
Sovjet
of Pozarevac, as original jurisdiction in¬
stance, is Municipal court in Pozarevac.

Fragmentary archive materials about the work of Pozarevac court in the
XIX
century are preserved and it makes it very valuable in the sense of testimo¬
ny from the period of establishment of Serbian new-age state.The documents
from the funds of Historical Archive of Pozarevac and Archive of Serbia are
summerized illustrating the work of Pozarevac court in the mentioned period.
The displayed documents, as original historical sources, are exceptional base
for advancement of law knowledge of today s followers of
Jovan
Protic, Stevan
Maksimovic and other eminent names of law in Serbia in the
XIX
century.
Should the folk wisdom be belived in law keeps the country and the cit¬
ies or according to Justinian law science is the knowledge of divine and hu¬
man rights, the knowledge of what is right and what is wrong , we state that
the common good is the highest law and we say, as the Serbian Minister of
Justice M. Kr. Djordjevic said, long time ago in
1890

As justice is done by judges, their task is to
apply it with the utmost cautiousness and the deepest conscience, keeping to
legal regulations only , civil equality in front of the Constitution and laws of
one state so necessary to its citizens, can be secured only by stable, independ¬
