THEORETICAL FRAMEWORK
OF LOCAL DEMOCRACY DEVELOPMENT
The spread of democratic ideas and the emergence of a global system
have contributed to a resurgence of the local democracy. The pressures
for
below the level of the nation-state. Today, however, the local government
has become visible internationally, and the context of any political legiti¬
macy and democracy must also include local levels of government. But
most studies on local autonomy and local democracy
distinguish between the two terms. As a consequence, there is an assu¬
med bilateral relationship between them, in which changes in one are al¬
ways deemed to affect the other -particularly in policy formulation. The
author develops a stronger analytical distinction between them, briefly
examines contemporary discussion on local democracy and the assump¬
tions that are made about its role in a broader democratic polity, analy¬
ses different theoretical insights into the concept of local autonomy and
addresses the tensions that exist between local autonomy and broader
democratic polity. To understand recent changes in local politics and po¬
licy making and renewing local democracy the author uses the concept
of local governance. Governance does not just seek to describe a more
networked

LOCAL SELF-GOVERNMENT IN SLOVENIA:
CENTRALIZATION OR DECENTRALIZATION?
Decentralization as the process of exercising the principle of subsidiarity
is modern trend in European and other countries around the world. In
Slovenia this process hasn t started yet. There are several reasons for that:
ignorance about the essence of local self-government, resistance to the
transfer of public affairs to the municipal or future regional level, (too)
small municipalities, the absence of regions, but especially the lack of
political consensus about the contents and future course of the local self-
government reform in Slovenia.

HISTORICAL ASPECTS OF ESTABLISHING
LOCAL SELF-GOVERNMENT IN SLOVENIA
Goal of the paper is to analyse the historical evolution of Slovenian muni¬
cipality as the basic form of local self-government on Slovenian territory
throughout the history until today. We will try to confirm the thesis, that
contemporary municipality is based on long-lasting tradition; tradition,
that even in the era of active negation of local self government after the
second World war could not be broken. In first chapters we will analyse
the first origins of local self-government in medieval cities and in the era
of absolutists ruler ship of Maria Theresa and fosefII. which have with
the common societal and economic reforms importantly influenced the
establishment and activity of the municipalities of that time. In middle
chapters we will analyse the functioning of local self-government system
in the period of Great World Wars, which was the time without mayor
changes. But therefore the period after the second Word war is much
more turbulent, because the municipal status was for the first time defi¬
ned by the constitution, but the boundary between the state and munici¬
pality was in that time the most undefined.

SIZE AND TASKS OF SLOVENE MUNICIPALITIES
The author tries to analyse the connection between the size and the tasks
of the municipalities on the basis of theoretical and empirical arguments.
It is important to achieve the optimal solution when forming local com¬
munities. The rational arguments are in favour of bigger communities
because of their economical strength and greater possibility to provide
with better public service but on the other hand only smaller and closer to
the citizens communities are able to provide the citizens with the needed
mechanisms to co-create and participate in the policy-making processes
in their local community. In Slovenia there is currently a great problem
in finding the middle way with which the local communities would be of
the optimal size. This presents not only the local but also the national Slo¬
venian problem. In this paper the author also presents comparative
analyses of this problem and outdraws the survey on Slovenian mayors
opinion about the size and the content of the tasks of Slovenian munici¬
palities.

DECENTRALIZATION OF SLOVENIA
AND REGIONALIZATION PROCESS
The Slovenian Constitution among other things assures local self-govern¬
ment, which is exercised in municipalities and other forms of local self-
governing communities. Municipalities are established as basic units of
local self-government and have the right of autonomous decision-making
upon connecting in wider forms of local self-government. Na Wider

territory as municipalities. On this, wider level of government the most
important linkage between central, state government and local self-go¬
vernment is taking place. Most countries across Europe have two- or even
three-levels of authority below the state government, that comprehends
wider or narrower geographic territory. But in Slovenia there is only one
level of authority below the state government
the space between the state and the municipality; in this space the actual
needs are born, needs that are in their essence authentic interests of local
significance, but are also exceeding capacities of single municipality. It
has to be emphasized that the regions in Slovenia actually do exist, as the
allegiance of citizens to distinctive region is more than obvious in some
parts of the country. Besides that we can also define some other forms of
dividing Slovenia; like regions based on natural characteristic, regions

based on architectural characteristics, etc. Although all these so called

venia finally going to establish regions as the missing wider forms of
local self-government system; does Slovenia due to its size and number of
inhabitants really needs regions and if yes, what is primary reason for
the regionalization process to happen; and finally how is future regiona¬
lization viewed from the viewpoint of mayors and leading economists in
Slovenian municipalities.

PROBLEMATIC OF MUNICIPALITY FINANCING
This paper gives a review of the financial system from the time of adop¬
tion of local self- government till now. Trough the results of analyses and
trough the exposed problematic on the financing of municipalities it is
evident that the actual system is not in accordance enough with the prin¬
ciples of the European charter of Local self government which proceeds
from the presumption that municipalities should be ensured with ade¬
quate and sufficient financial resources which they dispose autonomy.
Therefore changes and improvements of the existing financial system in
direction of better vertical fiscal equalization and larger financial auto¬
nomy of Slovenian municipalities are necessary with simultaneously im¬
provement of the financial management in municipalities.

SUPERVISION OVER LOCAL
SELF-GOVERNMENT S ACTIONS
The paper deals with supervision and auditing of local authorities action.
Local representatives and bodies are autonomous within the constitutio¬
nal order. The state is responsible for local self-government performing its
duties and responsibilities within the limits of legal system. The control
and auditing should be limited and balanced between the public interest,
local interests and individual rights. Control and auditing should be limi¬
ted with the law to the limit that provides proportionality of measures res¬
ponding the illegal acts. The paper describes the legal basis, extent and
sorts of state supervision and auditing of local authorities action.

THE PARTICIPATION OF THE ROMA COMMUNITY
AT THE LOCAL LEVEL OF GOVERNMENT
The Slovenian Constitution and the Local Self Government Law both en¬
sure the Roma community, the minority in Slovenia, the right to partici¬
pate at the decision-making process on public affairs on local level. One
may wonder how this assured right is actually realised in all local com¬
munities (municipalities) where Roma traditionally live. Roma minority
has the same rights to participate in policy making process in local af¬
fairs, as any other group of citizens. This includes exercising active and
passive voting right as well as the right to exercise all other mechanisms
to express their political will. In addition to all these constitutionally gua¬
ranteed rights to express political will, the Roma minority is also in title
to a representative in a local council. This paper serves as a whole and
elaborate research and presentation of »Roma problem«. Within the re¬
search all Roma representatives in local councils, as well as all mayors of
municipalities where this representatives are obligatory, were intervie¬
wed. Empirical data will enable evaluation of problems of Roma mino¬
rity and also the comparative analysis of policy makers (on a local level)
opinion on this matter. However the results of the research can also be
used as an evaluation and as a template for making alternative solu¬
tions for this problem,

The Slovenian constitution assures local self-government. With this sim¬
ple fact Slovenia has joined those contemporary (European) countries
that recognise basic citizen s right to participate at the local level of go¬
vernment, where their rights are most directly represented. Local commu¬
nities are one of basic columns of each democratic state and the citizen s
right to participate at the local level of government is one of basic demo¬
cratic principles in a modern world. These rights demand the existence of
local communities with democratically established decision-making bo¬
dies that have broad range of autonomy and responsibility, but also
means and ways to exercise the right to self-management. Authors are
analysing the activity problems of narrower parts of Slovenian munici¬
palities through the case study of urban municipality of Ljubljana. Ljub¬
ljana s quarter communities have been established in

E-DEMOCRACY ON THE LOCAL LEVEL IN SLOVENIA
THE ATTEMPT OF THE CONCEPTUALIZATION
The author speaks infavourofthe termination of the unsuitable trend of
the introduction of e-democracy tools, particularly in view of the satisfac¬
tory introduction of ICT at other levels in Slovene politics, as is evident
from the Economist Intelligence Unit comparative study carried out in
August
tools on the websites of Slovene municipalities. The author sees a possible
solution in relying on deliberative democracy as a suitable conceptual
basis for the application of e-democracy tools and ends the text with gui¬
delines for the applicative project of e-democracy introduction in Slovene

PROBLEMS
OF LOCAL DEMOCRACY IN SLOVENIA
The local self-government reform is present all around the globe and is es¬
sential part of modernisation processes. Local self-government is a key
element in European liberal democratic political system. Local authority
and relations toward central, state authority are changing rapidly; local
democracy is of a key significance for the democratic pedigree of the
state. Also ideological premises, which are base of those processes, are
changing rapidly; beside traditional values of local self-government (au¬
tonomy, participation and effectiveness) also some other values as rule of
law (legal state), territorial redistribution and macroeconomic manage¬
ment are no less important. Classical dichotomy centralisation
tralisation is no longer suitable model; two new models have emerged,
the subsidiarity principle and integration model. In this framework local
democracy in Slovenia is carried out. The author judges local democracy
in Slovenia from the viewpoint of local autonomy (financial and admi¬
nistrative), from the viewpoint of local authorities capacity for decision-
making and goal-placement, administrative capability and the responsi¬
bility for regard of basic social values. Special attention is devoted
towards the problems of political extensiveness of local democracy in Slo¬
venia, that is the distribution of political power in the local level, the parti¬
cipation of citizens in various modes of decision-making and consecuti¬
vely on the political culture on the municipal level.

E-DEMOCRACY ON THE LOCAL LEVEL IN SLOVENIA
THE ATTEMPT OF THE CONCEPTUALIZATION
The author speaks infavourofthe termination of the unsuitable trend of
the introduction of e-democracy tools, particularly in view of the satisfac¬
tory introduction of ICT at other levels in Slovene politics, as is evident
from the Economist Intelligence Unit comparative study carried out in
August

solution in relying on deliberative democracy as a suitable conceptual
basis for the application of e-democracy tools and ends the text with gui¬

PROBLEMS
OF LOCAL DEMOCRACY IN SLOVENIA
The local self-government reform is present all around the globe and is es¬
sential part of modernisation processes. Local self-government is a key
element in European liberal democratic political system. Local authority
and relations toward central, state authority are changing rapidly; local
democracy is of a key significance for the democratic pedigree of the
state. Also ideological premises, which are base of those processes, are
changing rapidly; beside traditional values of local self-government (au¬
tonomy, participation and effectiveness) also some other values as rule of
law (legal state), territorial redistribution and macroeconomic manage¬
ment are no less important. Classical dichotomy centralisation
tralisation is no longer suitable model; two new models have emerged,
the subsidiarity principle and integration model. In this framework local
democracy in Slovenia is carried out. The author judges local democracy
in Slovenia from the viewpoint of local autonomy (financial and admi¬
nistrative), from the viewpoint of local authorities capacity for decision-
making and goal-placement, administrative capability and the responsi¬
bility for regard of basic social values. Special attention is devoted
towards the problems of political extensiveness of local democracy in Slo¬
venia, that is the distribution of political power in the local level, the parti¬
cipation of citizens in various modes of decision-making and consecuti¬
vely on the political culture on the municipal level. |
